Introduce the attached Cost Recovery Ordinance, amending Exhibit A to Chapter 3.36 of the Newport Beach Municipal Code, and pass to second reading; and 2. Adopt the attached draft Resolution with Master Fee Schedule. DISCUSSION: Background: The City's first user fee study and cost allocation plan was conducted in 1995. In 2006, the City contracted with Public Resources Management (PRM) to update the cost allocation plan and cost of services study. PRM studied approximately a thousand different services for which fees are imposed and calculated costs based on the City's 2006/07 budget expenditures. It had been more than ten years between cost studies, processes and costs for many services had changed significantly, and PRM's findings reflected the disparity between costs and fees charged was large for many fee based services. In adopting the 2008 Fee Schedule, Council decided to phase in the full cost recovery for fees with the most significant increases over a three year period. Newport Beach Municipal Code Chapter 3.36 establishes the percentage of costs to be recovered from direct user fees and authorizes Council to modify the fee resolution upon a determination that there has been a change in one or more of the cost factors relevant to the calculation of the cost of providing the service. Chapter 3.36 also states that cost studies should be conducted every five years. Between cost studies, PRM Cost Recovery Ordinance and Fee Resolution Report September 8, 2009 Page 2 recommended the City annually update their cost calculations with the change in the Consumer Price Index, Los Angeles- Riverside - Orange County (CPI). There are three elements to this year's update to the Fee Schedule: 1. Phasing - applying the second level of phasing to fees subject to phasing 2. CPI - adjusting fees subject to the CPI change 3. Updates - identifying changes to cost factors or new services Phasing There are three distinct phasing efforts. First, Council directed staff to implement a 3 -year phasing of all fees where the charge exceeded $100 and the increase resulting from the fee study increased that charge by 100% or more. Second, a number of Recreation fees were subjected to a four -year phasing schedule. Finally, valuation based building permit fees are calculated using a Building Valuation Table and Council directed staff to update the valuation table over a two -year period. Fees subject to phasing were updated, reviewed by departments and are denoted with a "P" in the first column of the attached schedule. The difference in charge relating to phasing is specified on the attached schedule in the column titled "2009 Phasing ". CPI The CPI has increased 2.97% between July of 2007 (the first month following the period PRM based costs on) and June of 2009. Staff applied a 2.97% increase to fees subject to such adjustment. Some fees are not subject to the CPI adjustment (i.e. those set by State law) and are denoted with an "N" in the first column on the attached schedule. The proposed Fee Schedule also identifies the specific amount the fee will change based on the application of the CPI increase, in the column titled "2009 CPI ". Updates Several departments provided recommendations for Fee Schedule changes based on changes in the level of service provided and for services not listed on the fee schedule. Proposed new fees are highlighted on the attached proposed Fee Schedule, and include: • Sound Amplification Permits (Administrative Services) • Solar Systems (Building) • In Service Building Public Radio (Fire) • Three Massage Licenses — Holistic Care Operator, Chair & Manager Add On (Police) • Water Shut Off Tag Delivery (Utilities) • OASIS Wellness Center (Recreation & Senior Services) • School District Maintenance (Recreation & Senior Services) • Pint Size Campers (Recreation & Senior Services) • Preschool 101 (Recreation & Senior Services) • Room Rentals - NCCC & CYC (Recreation & Senior Services) Cost Recovery Ordinance and Fee Resolution Report September 8, 2009 Page 3 Staff also identified changes in service levels that result in reduced costs and the attached schedule proposes to reduce the fee for the following services: • Dog License (Administrative Services) • Weekend Inspection Request (Fire) • Medical Gas Permits (Fire) • Water Reconnection Charge (Utilities) The Police Department is recommending the City subsidize 50% of the cost of the Juvenile Substance Abuse Program. The current cost recovery for that service is 100 %, as established in Chapter 3.36. The proposed subsidy requires amending Exhibit A of Chapter 3.36 and the attached proposed ordinance for introduction reflects the Police Department's recommendation. The ordinance change to Chapter 3.36 will require two readings and 30 days to become effective. The resolution establishing the fee schedule can be implemented upon adoption, however, Government Code Section 66017 provides that development related fees will not become effective for 60 days following adoption of the resolution. Environmental Review: This project has be analyzed under the requirements of the California Environmental Quality Act and determined to not be a project under CEQA. Public Notice: In addition to the public notice posted with the agenda, the public notice requirements imposed by Government Code Section 66000 et.seq. for planning fees were published in the Daily Pilot. Danner Administrative Services Director Attachments: • Proposed Ordinance (includes Exhibit A, recovery percentages) • Proposed Resolution (includes Exhibit A, Master Fee Schedule, and Exhibit B, Building Valuation Table) ORDINANCE NO. 2009- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING EXHIBIT "A" TO CHAPTER 3.36 OF THE NEWPORT BEACH MUNICIPAL CODE REGARDING THE RECOVERY OF COSTS FOR THE PERFORMANCE OF CERTAIN MUNICIPAL SERVICES WHEREAS, the City Council of the City of Newport Beach adopted Ordinance No. 2008 -148, amending Chapter 3.36, Cost Recovery for User Services, to the Newport Beach Municipal Code; and WHEREAS, Chapter 3.36 establishes the percentage of cost to be recovered for services and that the recovery shall be one hundred percent (100°/x) for all services unless another percentage is specified in Exhibit "A" or otherwise limited by statute; and WHEREAS, Section 3.36.030 provides that the City Council may modify the cost recovery percentage for any service by amending Chapter 3.36: and WHEREAS, the City Council desires to update the percentage of cost recovery and actual fee for the Juvenile Substance Abuse Program. NOW, THEREFORE, the City Council of the City of Newport Beach hereby ordains as follows: SECTION 1: Exhibit "A" to Chapter 3.36 of the Newport Beach Municipal Code shall be amended to read as shown in Attachment 1 hereto. SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. Review 57% Revenue Parking Reviews Parking Hearings 0% Admin Cite Hearings 0% Dog License — Sterilized 500/0 RESOLUTION NO. 2009- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING THE CITY'S MASTER SCHEDULE OF FEES TO BE CHARGED FOR USER SERVICES WHEREAS, in 2006, the City of Newport Beach retained Public Resources Management ( "PRM "), to update the cost allocation plan and cost of services study for City services previously conducted by KPMG Peat Marwick LLP in 1996; and WHEREAS, the PRM study determined the actual cost of providing the services including direct labor costs, administration or "overhead' costs and the cost of materials and supplies based on 2006/07 actual costs for the majority of City fees for service; and WHEREAS, the City Council adopted Ordinance 2008 -14, amending Chapter 3.36 (COST RECOVERY FOR USER SERVICES) of the Municipal Code; and WHEREAS, Chapter 3.36 of the Municipal Code contains cost recovery percentages for specific services contained in the 2006 PRM study and provides that the City Council may modify the fee resolution to upon a determination that there has been an increase or decrease in one or more cost factors relevant to the calculation of the actual cost of providing the service; and WHEREAS, the City Council of the City of Newport Beach adopted Resolution 2008 -67 on July 8, 2008, adopting a Master Fee schedule for municipal services based on the 2006 PRM study and Chapter 3.36 of the Municipal Code; and WHEREAS, the City Council desires the Master Fee Schedule to be updated to reflect the decreases and increases in costs, the cost recovery percentages pursuant to Chapter 3.36, the change in the Consumer Price Index, and to add new fees for City services pursuant to the PRM study. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: SECTION 1: The schedule of fees for service attached to this Resolution as Exhibit "A" and the 2009 Building Valuation Table attached to the Resolution as Exhibit "B" are hereby adopted. Except as provided in Sections 2 and 3 below, all fees in Exhibit "A" shall become effective immediately. SECTION 2: The fees for development related services imposed by this Resolution shall take effect sixty (60) days following adoption of this Resolution. SECTION 3: The fee for the Juvenile Substance Abuse Program shall become effective upon the effective date of Ordinance No. 2009- updating Exhibit A of Chapter 3.36 to reflect the subsidy of that service.
