Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Antony Brine, City Traffic Engineer PHONE: 949-644-3329, tbrine@newportbeachca.gov TITLE: Residential Parking Permit Ordinance (Corona del Mar High School Area) — Second Reading Residents and property owners in the area around Corona del Mar High School have expressed concerns with high school students and visitors speeding, parking in the neighborhood, leaving trash on streets, making noise, etc. A petition was submitted and a letter was received from the Eastbluff Homeowners Community Association requesting to expand the existing Zone "3" Preferential Parking Zone. On August 9, 2016, the City Council approved a Resolution and Ordinance proposing the establishment of a residential parking permit program for Arbutus Street, Aleppo Street, Alder Place, Almond Place, and Alta Vista between Aleppo Street and Aralia Street to reduce student parking impacts. A second reading is now up for consideration. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Conduct Second Reading and adopt Ordinance No. 2016-15, An Ordinance of the City Council of the City of Newport Beach, California, Amending Subsection 12.68.060(C) of the Newport Beach Municipal Code to Establish a Residential Parking Permit Program for Arbutus Street, Aleppo Street, Alder Place, Almond Place, and Alta Vista Drive between Aleppo Street and Aralia Street. 3-1 Residential Parking Permit Ordinance — Second Reading September 13, 2016 Page 2 FUNDING REQUIREMENTS: Staff anticipates there will be a small cost associated with the installation of traffic signage, the administration of a permit program, and necessary enforcement which will be accommodated within the existing budget. DISCUSSION: At the August 9, 2016 City Council meeting, Resolution No. 2016-100 and Ordinance No. 2016-15 were introduced amending Section 12.68.060 of the Municipal Code to Establish a Residential Parking Permit Program for Arbutus Street, Aleppo Street, Alder Place, Almond Place, and Alta Vista Drive between Aleppo Street and Aralia Street. Municipal Code Section 12.68.060 authorizes the City Council to designate certain residential streets or any portion thereof as preferential parking zones for the benefit of residents adjacent thereto, in which vehicles displaying a permit may be exempt from parking prohibitions or restrictions otherwise posted, marked, or noticed. There are a total of eighty-three (83) residential addresses on Arbutus Street, Aleppo Street, Alder Place, Almond Place and Alta Vista Drive between Aleppo Street and Aralia Street. A petition was received indicating that, of the 83 homes, 69 homes were contacted and 66 homes supported the petition request. This result indicates 80% support for the permit program. Ordinance No. 2016-15 establishes the recommended parking permit program for a One -Hour Parking Limit, 7 a.m. — 4 p.m., School Days only, except by permit on the previously noted streets. Letters will be mailed to each address which will advise and outline the details of the proposed permit program. Per Municipal Code Section 12.44.150, each residence within the new zone would be allowed up to 3 parking permits, which can include a combination of visitor and permanent permits. Any guests, contractors, service workers, students, etc. that are parked on Arbutus Street, Aleppo Street, Alder Place, Almond Place and Alta Vista Drive between Aleppo Street and Aralia Street without a permit would be limited to one hour. However, residents with a parking permit would not be subject to the imposed time limit. If approved, implementation would begin in thirty (30) days. Signs will be posted, and warning citations will be issued in the first two weeks followed by full enforcement. ENVIRONMENTAL REVIEW Staff recommends the City Council find this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15301 (Existing Facilities) and 15311 (Accessory Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, as the only physical change to the environment will be the installation of new, small regulatory signs within the existing developed public right-of- way to alert motorists of parking restrictions and no other changes to the streets, sidewalks or parking spaces is authorized. 3-2 Residential Parking Permit Ordinance — Second Reading September 13, 2016 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). THE CITY COUNCIL OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Section 12.68.060 C. of the Newport Beach Municipal Code is amended to read as follows: 12.68.60 C, Zone "3" -- Eastbluff. Parking on the following streets shall be limited to one (1) hour duration on school days between the hours of 7:00 a.m. and 4:00 p.m., except by permit. 1. Aralia Street 2. Arbutus Street 3. Aleppo Street 4. Alder Place 5. Almond Place 6. Alta Vista Drive between Aleppo Street and Aralia Street Section 2: The recitals provided in this ordinance are true and correct and are incorporated herein by this reference. Section 3: f any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared invalid or unconstitutional. Section 4: The City Council finds the approval of this ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change 3-6 in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. Ser,tion 5: Except as expressly modified in this ordinance al other Sections, Subsections, terms, causes and phrases set forth in the Newport Beach Municipal Code shall remain unchanged and shall be in full force and effect. Section 6: The Mayor shall sign and the City Cleric shall attest to the passage of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be published in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption.
