Lin International (15T09) ABSTRACT: Prior Community, Commission and Council deliberations have contemplated the planning and future improvement of the Lower Sunset View Park area at the northeast corner of Pacific Coast Highway (PCH) and Superior Avenue. The City's Facility Financing Plan identified starting the design effort in 2016. Additionally, the recent PCH Corridor Study conducted by the Orange County Transportation Authority (OCTA) and Caltrans recommended installing pedestrian/bicycle bridges at the intersection of PCH and Superior Ave to improve intersection capacity as well as pedestrian/cyclist movements. Staff now recommends that the City begin efforts to develop a Concept Design Plan that would identify the various components that would be included in the design such as possibly more parking, bicycle node features, pedestrian bridges and other recreation features. Upon approval of a concept design plan by the community and City Council, staff would then be able to begin the environmental review and permitting process, apply for grant funding, as well as guide the future design and construction of Lower Sunset View Park. Professional Engineering, Landscape Architecture and related consultant services are needed to develop and complete the conceptual design for Lower Sunset View Park. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Approve a Professional Services Agreement with T.Y. Lin International of San Diego, California, for the Lower Sunset View Park Conceptual Design at a not -to - exceed price of $125,325.00, and authorize the Mayor and City Clerk to execute the Agreement. 16-1 Lower Sunset View Park Conceptual Design — Approval of Professional Services Agreement with T.Y. Lin International (15T09) September 13, 2016 Page 2 FUNDING REQUIREMENTS: The current adopted FY 16/17 Capital Improvement Budget includes sufficient funding for this service. It will be expensed to the Lower Sunset View Park Concept Project budget 56201-980000-15T09. Once a concept plan has been developed and approved, staff will further pursue grant funding opportunities to supplement construction funding needs. The Lower Sunset View Park project is included in the current Facilities Financing Plan (FFP) and is being developed in an effort to add additional park and recreation amenities to the West Newport area. Funding for this effort was included in the FY 15/16 budget and was re -budgeted into the FY 16/17 Capital Improvement Program. On November 3, 2015, staff requested proposals from five firms to provide professional Engineering and Landscape Architectural services to complete the conceptual design for Lower Sunset View Park. After a pre -proposal meeting and follow-up phone calls, only one proposal was received from T.Y. Lin International. Upon review of the proposal and discussions with representatives from T.Y. Lin International, staff determined that T.Y. Lin International and its consultant project team has the qualifications, project understanding and expertise to complete the scope of services. Staff previously recommended City Council approval of a broader overall project wide Professional Services Agreement (PSA) with T.Y. Lin on April 26, 2016. During the Council discussion on the item, several Council members expressed reservation with approving such an extensive scope and design work effort for the project as well as the corresponding larger design fee, and asked that staff work to scale back the effort to just the basic concept development and approval and bring the item back at a later date. Since the April 26, 2016 meeting, staff has revised the scope of work, removing all tasks that may be completed at a later date as part of the final design phase. T.Y. Lin was also able to significantly reduce their proposed design fee accordingly. A summary of the scope of services is provided below: • Project Administration; • Develop three (3) conceptual designs for the pedestrian/bicycle bridges, parking lot/structure and recreational area; • Present conceptual designs to City Council, PB&R Committee, and the community, and recommend the preferred design; • Develop 15 percent level planning documents. Upon approval of this consultant agreement, staff will begin conceptual design efforts for the Lower Sunset View Park project on the northeast corner of PCH and Superior Avenue. Lin International (15T09) September 13, 2016 Page 3 approval of a concept design plan for the lower area of Sunset View Park. Elements of the Concept Design Plan may include the construction of pedestrian/cyclist bridges over Superior Avenue and PCH, a bicycle node, community park amenities (such as open landscaped space), recreation features and related amenities, possible transit connection features such as Park & Ride spaces, and additional parking to serve the parks, beach and surrounding areas. Refer to the attached location map (Attachment A). The conceptual plan will review the high vehicle, bicycle and pedestrian volumes on PCH and Superior Avenue to improve the safety of all users. The existing topography also may play into the overall design and connection of pedestrian/bicycle bridges. Additionally, over the years, the Park, Beaches and Recreation (PB&R) Commission has received a large number of requests for additional dog park facilities in the City. After undertaking a review and public discussion of the item in March 2015, it was determined that the undeveloped lower portion of Sunset View Park would be the number one choice for a new dog park. Refer to the attached March 3, 2015 PB&R Committee staff report (Attachment B). Pending the County's recent action at the Santa Ana River mouth, further discussion and re-examination by staff and the community regarding a possible future dog park at this location will be included in this effort. In accordance with the City's Bicycle Master Plan, and the high volume of bicyclists passing through the area or stage at the existing parking lot, as well as the three bus lines that run by this location, a bicycle node and a Park & Ride facility could be explored and incorporated into the site design. In addition to these possible items, the conceptual design may include more public parking to support future park uses, beach demand, and possibly Sunset Ridge Park (via a bridge if approved) and the surrounding area. To this end, staff recommends approving a PSA with T.Y. Lin International (Attachment C) to complete the scope of services listed above, which is further described in the consultant's scope of work. The proposed not -to -exceed engineering and architectural services fee is $125,325.00. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
