Since the posting of the agenda, the Public Works Department requests a substitution
of the staff report for Item No. 27. Following review and deliberation of the bids and
contractor responses to the original staff report, the substitute staff report now
recommends that the City Council reject all bids and direct staff to re -advertise the
Project.

Staff has received bids for the construction of the Fire Station No. 6 Apparatus Bay
Replacement Project. Staff believes the best course of action is to reject all bids, re -
scope and re -advertise the project.
RECOMMENDATION:
a) Staff recommends the City Council find this project exempt from the California
Environmental Quality Act ("CEQA") pursuant to Section 15302 (Replacement or
Reconstruction) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential to have a significant effect on the
environment;
b) Reject all bids received for Contract No. 6422-1; and
c) Direct staff to review the scope of work and re -advertise for bids.

At 10:00 AM on August 31, 2016, the City Clerk opened and read the following
electronic bids for this project:

While reviewing the bids, staff discovered that the apparent low bidder, Caltec Corp
(Caltec), did not submit all of the documents per the bidding instructions and their bid
documents contained incomplete information. Initially staff recommended that the
apparent low bidder be deemed non-responsive and deemed non -responsible. Staff
discussed this with the contractor and they have submitted further information for the
record challenging the initial recommendation and challenging bids received by other
bidders. With legal and technical complexities of evaluating new information post bid,
staff recommends that City Council reject all bids. Staff intends to review the scope of
work, update the bid package and add additional technical requirements to the project
specifications prior to re -advertisement.
ENVIRONMENTAL REVIEW:
The project consists of the demolition of an existing fire station garage and the
construction of a new taller garage to house fire vehicles that are taller than existing
garage openings. The new garage structure will occupy the same space as the existing
garage and will have the same purpose and capacity to house fire station vehicles. As
such, Staff recommends the City Council find this project exempt from the California
Environmental Quality Act ("CEQA") pursuant to Section 15302 (Replacement or
Reconstruction) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
