TITLE: Fire Station No. 6 Apparatus Bay Replacement Project - Award of
Contract No. 6422-1(16F11)
ABSTRACT:
Staff has received bids for the construction of the Fire Station No. 6 Apparatus Bay
Replacement Project and is requesting City Council's approval to award the
construction contract to Archico Design -Build.
RECOMMENDATION:
a) Determine that this action is exempt from the California Environmental Quality Act
("CEQA") pursuant to Section 15302 (Replacement or Reconstruction) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment;
b) Approve the project drawings and specifications;
c) Find that the apparent low bidder, Caltec Corp, as non-responsive and non -
responsible;
d) Declare that the second low bidder, Archico Design -Build, as the acceptable low
bidder;
e) Award Contract No. 6422-1 to Archico Design -Build for the total bid price of
$999,000.00, and authorize the Mayor and City Clerk to execute the contract; and
f) Establish a contingency of $100,000.00 (approximately 10 percent) to cover the cost
of unforeseen work not included in the original contract.
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for this project. The following
funds will be expensed:

At 10 a.m. on August 31, 2016, the City Clerk opened and read the following electronic
bids for this project:

Upon bid opening, staff discovered that the apparent low bidder, Caltec Corp (Caltec),
did not submit all of the documents per the bidding instructions and their bid documents
contained incomplete information and is therefore non-responsive.
Additionally, staff contacted the references submitted by Caltec for an understanding of
their previous work experiences. All of the references indicated their agencies
encountered contractor performance issues on their non-essential building tenant
improvement projects including the lack of superintendence; certified payrolls; late
completions; unsubstantiated claims; safety violations; and a job shutdown by one of
these agencies. Caltec also does not have any experience working on Fire Station
essential facilities. Due to the critical infrastructure need of this building, the Public
Works Department and Fire Department have a significant concern with the contractor's
ability to perform. Given these responses, staff recommends the City Council find
Caltec Corp as non -responsible for this project.

Staff also reference checked the second low bidder, Archico Design -Build (Archico).
The references indicated Archico has satisfactorily completed larger scale building
improvement projects for other municipalities, including the retrofitting of a fire station
for a local Orange County Fire Department. Staff therefore recommends the City
Council declare Archico Design -Build as the low acceptable bidder.
The bid amount submitted by Archico Design -Build is approximately fourteen percent
(14%) below the engineer's estimate of $1,160,000. Archico possesses a California
State General Building "B" Contractors License as required by the project specifications.
BACKGROUND:
The existing fire station was constructed in 1957 with its apparatus bay sized to
accommodate equipment used in that era. Since then, fire engines and medical
response rolling equipment have grown in size to the extent that the new fire engine
assigned to this station no longer fits through the existing garage doors. That truck is
currently parked under a tent when it is on the station property.
The remaining station building has been receiving updates through the years, has been
modified to accommodate female staff and is in serviceable and functional condition.
Staff therefore focused this project on replacing only the non-functional apparatus bay.
As the project developed, staff, through a value engineering process, determined that it
will be more economical in the long-term to construct a structurally independent and
self-supporting new apparatus bay rather than reattach the new bay to the existing
building. When it is time to replace the living quarter's portion of the station, the new
offices and living quarters can simply attach to the new bay constructed by this project.
Additionally, the Facilities Maintenance Master Plan identified a number of maintenance
items that need to be addressed at the station. Rather than interrupting the Station
operations twice, staff waited for this project to complete those repairs and maintenance
items at the same time. These proactive maintenance items include replacing the 25+
year old roof over the offices and living quarters; replacing the kitchen skylight with a
11solatube"; installing rain gutters and down spouts all around the roof perimeter for
controlled discharge and to keep storm runoff from damaging the building; refurbishing
interior doors and floors; exterior painting to match the new apparatus bay; and
repairing and painting the exterior perimeter CMU plaster walls.
Pursuant to the contract specifications, Archio is allowed 150 consecutive working days
to complete the work. Liquidated damages in the amount of $1,000.00 per calendar day
will be assessed in case of tardy completion.
ENVIRONMENTAL REVIEW:
The project consists of the demolition of an existing fire station garage and the
construction of a new taller garage to house fire vehicles that are taller than existing

garage openings. The new garage structure will occupy the same space as the existing
garage and will have the same purpose and capacity to house fire station vehicles. As
such, Staff recommends the City Council find this project exempt from the California
Environmental Quality Act ("CEQA") pursuant to Section 15302 (Replacement or
Reconstruction) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
