CALL TO ORDER—The meeting was called to order at 3:32 p.m. Staff Present: Patrick J. Alford, Zoning Administrator Rosalinh Ung, Associate Planner Chelsea Crager, Assistant Planner David Lee, Planning Technician II. REQUEST FOR CONTINUANCES ITEM NO. 3 Annual Review of Development Agreement for Hoag Memorial Hospital Presbyterian (PA2009-064) Site Location: 1 Hoag Drive Council District 2 The Zoning Administrator noted a request for continuance regarding this item and continued the item to the regular scheduled hearing on September 29, 2016, to provide additional time related to noise compliance issues. Action: Continued to September 29, 2016 III. APPROVAL OF MINUTES of August 11, 2016 Action: Approved as amended IV. PUBLIC HEARING ITEMS ITEM NO. 1 2007 Diana Lane Modification Permit No. MD2016-009 (PA2016-106) Site Location: 2007 Diana Lane Council District 3 Chelsea Crager, Assistant Planner, provided a brief project description stating that the proposed project was a modification request for a 25% addition, or 497 square feet, to an existing single family home with nonconforming garage dimensions. The Zoning Code requires minimum dimensions of 20 feet wide by 20 feet deep, and the existing garage provides dimensions of 21 feet 6 inches wide by 19 feet 2 inches deep. The Zoning Code limits additions to residences with nonconforming garage dimensions to 10% unless a modification permit is approved. Increasing the garage depth results in a practical difficulty to the applicant because it would require significant structural alterations and is located on a separate area of the home. The garage dimensions complied with Zoning Code requirements when the area was annexed in 1956, and the garage provides two usable parking spaces. Staff recommended approval of the project subject to conditions of approval. Applicant J.R. Walz stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved Page 1 of 2 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 08/25/2016 ITEM NO.2 Royal Hen Minor Use Permit No. UP2016-033 (PA2016-128) Site Location: 311 Marine Avenue Council District 5 David Lee, Planning Technician, provided a brief project description stating that the proposed project was to amend use permit number UP987 to add a bar area to an existing restaurant at 311 Marine Avenue, located on Balboa Island. The existing use permit(UP987)allows for the restaurant to sell beer and wine. There is no change proposed to the alcohol license. Mr. Lee explained that Zoning Code Section 20.48.090 states that an increase in floor area principally devoted to alcohol sales by 25 percent or more, or by 250 square feet, whichever is less, shall obtain new permits. The proposed bar area is approximately 232 square feet, with a maximum of 9 seats.The bar area makes up approximately 23 percent of the restaurants net public area and will provide alternative dining options for patrons without significantly changing the character of the restaurant use. In terms of parking, the property is legal, nonconforming due to having no parking available on site. The proposed addition of the bar reduces the net public area from 1096 square feet to 1018 square feet. This reduces the required parking from 22 spaces to 21 spaces. No additional parking is required. Mr. Lee stated that the Police Department reviewed the application and had no objections related to the improvement. Staff recommended approval of the project subject to conditions of approval. The Zoning Administrator requested that staff address the comments made by Lee Pearl. Mr. Lee explained that Mr. Pearl was concerned about noise and other disturbances from the back alley of the restaurant. Mr. Lee stated that he worked with the applicant to provide additional conditions to address these issues. Applicant Leslie McElroy, on behalf of the Owner, stated that she had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Maridee Banis, spoke and stated that she was excited for the restaurant to open. There were no other public comments. Action: Approved V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI. ADJOURNMENT The hearing was adjourned at 3:52 p.m. The agenda for the Zoning Administrator Hearing was posted on August 18, 2016, at 11:05 a.m. in the Chambers binder and on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City's website on August 18, 2016, at 11:00 a.m. Patrick J.
