As a result of some changing conditions involving the dredging, staff believes the best course of action is to reject all bids, re -scope the project and re -advertise for bids. a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304(H) — Minor Alteration of Land, of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; b) Reject all bids; and c) Direct staff to review the scope of work and re -advertise for bids. FUNDING REQUIREMENTS: No fiscal impact: DISCUSSION: At 10 a.m. on August 23, 2016, the following bids for this project were submitted to Planet Bid: BIDDER BASE BID AMOUNT Low Summit Contracting (Bid Withdrawn) $ 940,370.02 2 Minco Construction (Unbalanced Bid) $ 1,186,000.00 3 Earth Construction and Mining $ 1,237,360.00 4 KEC Engineering $ 1,443,250.00 5 Beador Construction Company, Inc. $ 1,537,700.00 6 Los Angeles Engineering, Inc. $ 3,949,850.00 6-9 Semeniuk Slough Maintenance Project — Reject all Bids September 27, 2016 Page 2 The City received a letter from the low bidder, Summit Contracting on August 25, 2016, formally asking its bid be withdrawn due to clerical errors that occurred using the bidding software. While reviewing the other bids, staff discovered that the second low bidder bid, Minco Construction, contained an unbalanced bid. Additionally, staff has been unable to obtain the necessary permission from an adjacent property owner to perform removal of some desired additional material. With these legal and technical complexities of these evaluations, staff recommends that City Council reject all bids. Staff intends to quickly revise the bid package by removing the additive bid items, adding the Caltrans storm drain box maintenance work as part of the base bid, remove work in the privately owned portion of the Slough, and add additional technical requirements to the project specifications and immediately re -advertisement the project for new bids. ENVIRONMENTAL REVIEW: A Categorical Exemption for this project was filed with the Orange County Clerk on November 16, 2015 and the California Coastal Commission also found this project to be Exempt. This project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304 (H) (Minor Alterations to Land) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
