TITLE: Accept Donation of $350,000 from Newport Harbor Yacht Club and
Budget Amendment for Central Avenue Public Pier and Plaza
(17H12)
ABSTRACT:
Pursuant to City Council Policy F-3, Section (D)(2), the City Council is asked to accept a
$350,000 donation from the Newport Harbor Yacht Club (NHYC). The $350,000 donation is
required as condition of approval of NHYC's Coastal Development Permit to rebuild their
clubhouse. If accepted, the funds are earmarked for the upcoming Central Avenue Public
Pier project and adjacent plaza renovation. Staff also requests a budget amendment to
recognize the donation and allocate funds towards the upcoming project.
RECOMMENDATION:
a) Find the acceptance of the $350,000 donation for Central Avenue Public Pier exempt from
the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the CEQA
Guidelines; and
b) Accept NHYC's donation and approve Budget Amendment No. 17BA-014 to increase
revenue estimates by $350,000 in Account 10103-561005 and appropriate $350,000 to
Account 10101-980000-17H12 for Central Avenue Public Pier and Plaza Improvements
project.
FUNDING REQUIREMENTS:
The Budget Amendment records $350,000 in additional revenue from NHYC's public access
improvements contribution and $350,000 in increased expenditure appropriations. The
revenue will be posted to the Tidelands Capital Private Donations account, 10103-561005,
and expenses will be posted to the Tidelands Capital account in the Public Works
Department, 10101-980000-17H12, Central Avenue Public Pier and Plaza Improvements
project.

DISCUSSION:
On May 27, 2016, the California Coastal Commission (CCC) issued a Notice of Intent to
Issue Permit to NHYC for its clubhouse reconstruction (Permit Application No.: 5-15-1459).
Pursuant to Special Condition #3, NHYC is required to contribute $350,000 towards public
access improvements. The City of Newport Beach's (City) Fiscal Year 2016-17 Capital
Improvement Program budget identifies Central Avenue Public Pier project to provide a new
public pier at the Central Avenue street -end in Lido Village. This pier will be used to meet
boating and docking demands in the area. On September 13, 2016, the CCC Executive
Director authorized NHYC to contribute the $350,000 to the City to help fund this pier project.
Pursuant to Council Policy F-3, Section (D)(2), staff recommends acceptance of NHYC's
donation and approval of the Budget Amendment to recognize and appropriate the funds
towards the Central Avenue Public Pier project. As a condition of acceptance, the City is
restricted from spending the funds until it has entered into a Memorandum of Understanding
(MOU) with the CCC regarding the construction of the pier project. Staff is currently working
on this MOU with CCC staff.
ENVIRONMENTAL REVIEW:
Staff recommends City Council find this action exempt from California Environmental Quality
Act (CEQA) pursuant to Section 15303 (Class 3, New Construction of Small Structures) of
the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment. The Class 3 exemption allows for
the construction and location of limited numbers of new structures and is applicable to the
proposed new public dock. The examples listed in the Class 3 exemption are not intended to
be comprehensive but include, among other small projects, new structures up to 2,500 or up
to 10,000 square feet in urbanized areas. The proposed construction of a 900 square foot
dock with an 80 foot gangway fits within the construction of small structures contemplated by
Categorical Exemption Class 3. An Eelgrass and Caulerpa survey was conducted by Coastal
Marine Resources (CRM) in 2013, and the survey confirmed that no Eelgrass or invasive
algae were found at the site at that time. The Southern California Eelgrass mitigation policy
requires timely pre and post surveys for Eelgrass and invasive algae and the construction of
the public dock must comply with the future pre and post construction surveys. City standard
best management practices during project construction will further ensure that the project
does not significantly impact the environment.
