TITLE: 2014-2015 Citywide Slurry Seal Program — Notice of Completion for
Contract No. 5895 (Project No. 15R04)
ARSTRACT-
On April 28, 2015, City Council awarded Contract No. 5895 for the 2014-2015 Citywide
Slurry Seal Program to American Asphalt South, Inc. of Fontana, California. The work is
now complete and staff requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for
the project (On April 28, 2015, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301);
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of the
Civil Code; and
c) Release the Faithful Performance Bond one year after acceptance by the City Council.

This asphalt slurry seal project addressed local and collector streets in the Irvine Terrace,
Corona del Mar (south of East Coast Highway), and Shorecliffs communities. The work
necessary to complete this contract consisted of distributing construction notices to affected
businesses and residents, clearing existing pavement surfaces of debris, soils and other
loose materials, crack sealing, placing emulsion aggregate slurry seal and restriping. The
contract also provided for parking lot seal coating at Beacon Bay, Old School Park, Corona
del Mar Main Beach and Bayside Drive Parks.
The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final cost of contract bid items constructed was $54,645.37 less than the original bid
amount due to the removal of Carnation Avenue from the slurry seal list. Carnation Avenue
was part of the recent Corona del Mar Water Transmission Main Improvement project in
which it received a new pavement cap between Bayside Drive and East Coast Highway.
The project also included several change orders for a total amount of $52,043.58, which
was approximately 10.7 percent of the original bid amount. Notable change orders were for
remobilization and slurry seal work associated with water main improvements in Corona Del
Mar, additional costs to slurry seal existing asphalt sidewalks on Coast Highway, and
sealcoat and restriping work for the Newport Beach Police Department parking lot.

Work on this slurry seal project was delayed many months due to conflicts associated with a
separate water main replacement project in Corona del Mar that was also delayed due to
unknown conditions and underground utilities. The project's Notice to Proceed was issued
on July 27, 2015, and the majority of the planned slurry seal and sealcoat work was
substantially completed by September 30, 2015. Public Works staff decided to reschedule
some slurry seal work on several streets to a later date to accommodate the delayed water
main replacement work. A second Notice to Proceed was later issued to go back and pick
up the streets that were removed earlier, as well as include additional parking lot seal coat
and striping work at the Newport Beach Police Department resulting in extending out the
final completion date to November 5, 2016.
ENVIRONMENTAL REVIEW:
At the April 28, 2015 City Council meeting, the project was found to be exempt from the
California Environmental Quality Act ("CEQA") pursuant to Section 15301 (for repair,
maintenance and minor alteration of existing public facilities with negligible expansion) of
the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it had
no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).
