TITLE: Central and Mariners Libraries Restrooms Rehabilitation Project -
Award of Contract No. 8135-1(15F02)
ABSTRACT:
Staff has received construction bids for the Central and Mariners Libraries Restrooms
Rehabilitation Project and is requesting City Council approval to award the contract to
New Dynasty Construction Co.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301(a) of the CEQA Guidelines for Existing Facilities because
the in-kind and in-place rehabilitation of the existing interior restrooms will not result
in a physical change to the environment, directly or indirectly;
b) Approve the project drawings and specifications;
c) Award Contract No. 8135-1 to New Dynasty Construction Co. for the total bid price
of $429,810.00, and authorize the Mayor and City Clerk to execute the contract; and
d) Establish a contingency amount of $43,190 (approximately 10 percent) to cover the
cost of unforeseen work not included in the original contract.
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for this project. The following
funds will be expensed:

DISCUSSION:
Purpose

The Central Library and the Mariners Branch Library facilities were constructed more
than twenty and ten years ago respectively. The restrooms in these two library buildings
are heavily used and have not been renovated since they first entered service. In
addition to the aesthetics, the Facilities Maintenance Master Plan (FMMP) identified a
number of items such as partitions, sinks, flooring, countertops, lighting, and fixtures
that need to be either updated or replaced.
Rather than addressing these needs at different times, staff has determined that it will
be more economical overall and less disruptive to the libraries' operations if the various
deficiencies are addressed through a complete rehabilitation project at one time.
Contract documents for both libraries were therefore prepared and advertised for
competitive public bids.
At 10 a.m. on November 1, 2016, the City Clerk opened and read the following
electronic bids for this project:

approximately one-third below the engineer's estimate of $650,000 that was computed
using inputs received from the Record Architect and local contractors not bidding on this
project.
New Dynasty possesses a California State General Building "B" Contractor License as
required by the project specifications. A check of New Dynasty's references indicated
they have satisfactorily completed similar projects for other local agencies.

Although staff considered requiring the reconstruction of these restroom facilities when
the libraries were closed, the added labor cost for night work would have been
substantial. So to best accommodate the public while still maintaining cost efficiencies,
the Contract Documents were developed to stage the construction so as to provide for
overlapping and operable restrooms at each library while others were being
rehabilitated, and additionally encourage the Contractor (at its own cost) to try to
perform night and/or early morning work as such operations conducted without the
public's presence around the work zones could result in higher production.
To minimize inconvenience to the library patrons, the contract staging requires New
Dynasty to complete all of the work at one restroom(s) before starting work at the next
location. Since the Central Library has one set of restrooms on each floor, staff does
not anticipate issues with restroom availability as one set of restrooms will be open at all
times. At the Mariners Branch Library, either only the Men's or Women's restroom will
be under repair at any time and the other not under construction will be converted to a
"family" facility to serve all patrons and vice versa.
Pursuant to the contract specifications, New Dynasty is allowed seventy-five (75)
consecutive working days to complete the work at the Central Library and an additional
twenty-five (25) working days at the Mariners Branch Library, for a total of one hundred
(100) work days. Liquidated damages in the amount of $2,500.00 per calendar day will
be assessed in case of tardy completion.
ENVIRONMENTAL REVIEW:
The project consists of in-kind and in-place rehabilitation of existing interior restrooms
that will have the same purpose and capacity as currently. As such, staff recommends
the City Council find this project exempt from the California Environmental Quality Act
("CEQA") pursuant to Sections 15301(a) of the CEQA Guidelines for Existing Facilities
because this work will not result in a physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
