The Orange Coast College Crest is getting nation-
wide publicity from a recent ')an Smoot ~eport-one in
a series of commmts on the U.S. Su!)feme Cou rt's de-

made addiction to narcotics a crime; the other revers--
ing contempt-of·Congress judgments against t>NO men
convicted for refusal to give the House Committee oo

The July 23 Smoot ~eport cites several cases of

calls It a strange liberal conceot of liberty-"that the
t::on stitution gives unrestrained license to the propa-

school children and others, but Pfohiblts the distti-

be held responsible for the .. ph ilosophy"
expressed in those wr it ings. Dr. Pet erson said:
"While I wou ld, pe rhaps, have edited it
more car efully from a standpoint of taste, I
do feel that this writing is the r esult of the

Young people who never go to college, o r

Lyons Now let me tum from the composJte
resutta of the opinlona to the box acore
repterecl by tbe 1ndlv1dual Judaes . Buao Black Ia the senior Ju~e on the
Supreme Court. He has been on the
Court since AUIUSt 1937. Aa to cases
involvtnw commun.tam or aubve1'Stve ac-
tivities, tt is lmpo&Slble tor a man to
demonstrate greater conslateney than he
has evidenced. Over this span of 24
years, he participated tn 102 decWons
where his position could be ascertained.
He supported the poattlon ura-ed upon
the Coun by the Communist Part7 or
Ita sympathizers exactly 102 times. B1a
suPport of declslons contra.rJ to the
position urged by the Communists is
zero.
Justice Douglas participated in a total
of 100 cases. Out of this total he
reached a conclusion favorable to the
position urged by the Communists 97
times and held to the contrary 3 times.
Chief Justice Warren participated in
65 decisions. His box score fs 62 pro
and 3 contrary.
Justice Brennan has participated in 51
cases. His score is 49 pro and 2 con.
Justice Frankfurter participated tn a
total of 103 decisions. His record re-
veals 69 votes pro and 34 votes con.
Now the pendulum swings to the
Judges who have opposed the position
urged by the Communists more than
they have supported it. Justice Clark
has th e longest record of vigorous op-
position to the position favoring com-
munism or subversive activities. Out of
a tota l of 82 opinions. he has been on
the pro side 'only 21 times and contrary
61.
J ustice Harlan's decisions total 65-
30 pro, 35 con.
Justice Whittaker , 42 decisions-12
pro, 30 con.
Justice Stewart. 20 decisions-6 p ro.
14 con.
Mr. JAVITS. Mada m P resident, will

Mr. EASTLAND. 'Ibat has been put
in the RJ:CORD.
Mr. JAvrrs. May I ask who sets the
criterion that these are pro or anti-
Communist declsions?
Mr. EASTLAND. Any lawyer with any
sense at all could do that. Intelllgent
lawyers have done lt.
Mr. JA VITS. Could the Senator tell

want to ara-ue the matter with the
Senator from New York. Thla Ja what

pleaae tbe Seilator from New York, bu'
the record sbowa it. The teat was. If the
decision of the lnd.lvtdual Juctse wu 1n
favor of the position ach'ocated bJ' the
CommUJlln Party or the Commim.lst
~pathizer involved 1n Ule partJcular
case. it was scored a pro, meantna pro-
Commun.ist. If the· Judge's declaton was
contrary to this poaitlon. tt waa acored
as a con. or contrary poattton.
Mr. JAVITS. Can we say, therefore, in au fairness that it Is the Senator htm-
selt. then, who determined that stand-
ard, 1n the Senator's Judament?
Mr. EASTLAND, I think anybody
with any Intelligence. Madam President,
must real1ze that these cases speak for
themselves. This 1s taken from the doc-
uments of the Government of the United
States. It Is a publlc record. ,
Mr. JAVITS. There ls no other au-
thority, other than the Senator's state-
m ent. then?
1wf.r. EASTLAND. There is no other
authority than the oftlclal record. That
record speaks for itself.
Mr. JAvrrs. The Senator's state-
ment is that that ls the oftlclal record.
Mr. EASTLAND· That is the oftlcial
record. It 1s the record that has gone
into the RECORD Of thi..q debate.
This is the grim picture of the indi-
vidual and aggregate results of the at-
titudes and predilections of both the
individual judges and the Court as a
whole on issues that have involved the
relationship of our laws with aetivtties
and manifestations of the Communist
conspiracy or related subversive activi-
ties within this country. The present
balance of oplnlons on thP. Court is such
"hat each new decision oecomes a grab
bag or a game of chance as to which way
*be Court wU go. This is a most narrow
balance when fundamentally the issue
involved is the security of this country
and its ability to protect itself from the
machinations of communism.
The Court must be restricted. Unless
it b. i~ will not only snap and bite, but
will tear to pieces and devour constitu-
tional aovernment.
