The Newport Beach City Council and reporters covering
the City Hall "beat" have enjoyed excellent relations
during all these years that I have been here. From many
other areas of the nation have come stories of reporters
being barred from meetings, and of incidents of subter-
fuge and some downright censorship on the part of public
officials. But here, public matters have been handled in
open and above-board manner -actually with no need of
any mention of the Brown AcL At least, so it has been up
to now.
Last weelc there occurred a violation -at least of the
spirit of the Brown anti-secret-meeting law, if not ttle
letter of the law. A committee rveeting studying the Bal-
boa Bay Club expansion Pfoposals •as joined by other
City Council members, and 5 of the 7 Council members
were present, maldng it in effect an informal, unannounced
study stssion of the Council itself. It was not a "closed
door" meeting, but it might just as well have been as far
as the Ensign was concerned, fol the Ensign received no
notice, and no one from th is paper was on hand to report
thl s important discussion.
Coincidentally, JUSt in the past few days came a memo
from our Publishers Assn. office in Los Angeles, r~ort
ing on a comprehensive opinion issued by Atty. Gen.
Stanley Mosie on the Brown Act. Here are highlights from
the opinion:
All meetings of public bodies, except those specifi-cally
exempt (personnel sessions and some "lawyer-client"
tallcsl, are open to press and public, and this includes
all the so-called informal, study, discussion, intorma-
tional, fact-finding, pre--council or briefing sessions. The
Brown Act does apply to charter cities. "The right of
the people to HAVE NOTICE OF and to attend all meet-
ings of a local agency .•• Is not dependent upon the fact
that members o f that body do or do not intend to take
action ... We find no statutory authority for excepting in-
formal sessions from the application of the law."
I contend that there •s an oblagation on the part of pub-
lic bod•es to_give advance notice of all meetings that are
not regularly scheduled. Otherwise the intent of the anti-
secret--meetang law tS by-passed.

"Our hentage of freedom was not easily WOfl, and 1t IS
not easy to k.eep," said Charles Thomas, president of the
Irvine Co. and former secretary of the Navy, at the annual
banquet of the Freedom Documents Foundation in Beverly
Hi II s.
It was an excellent speech, pointing out the danger
facang us, and calling for an awakened public to do some-
thing about. Listen to Mr. Thomas:
"Of all the millions who have lived during recorded
history, only about J'\ have known freedom.
