Staff believes the best course of action is to reject all bids, re -scope and re - advertise the project. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act pursuant to Section 15301(c) (maintenance activities with negligible or no expansion) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; b) Reject all bids received for Contract No. 7028-3; and c) Direct staff to change the scope of work and re -advertise for bids. FUNDING REQUIREMENTS: No fiscal impact. 12-1 Newport Heights Alley Replacement, Phase 1 — Reject All Bids — Contract No. 7028-3 (15R18) November 29, 2016 Page 2 DISCUSSION: At 10 a.m. on November 29, 2016, the City Clerk opened and read the following electronic bids for this project: While reviewing the bids, staff discovered a written error in the description of Bid Items No. 13 and 14. The descriptions included the removal and replacement of the "Water Meter and Box" as opposed to "Water Meter Box". Staff's intent was to only include the removal and replacement of the meter boxes, excluding the actual water meters, which is typically done as part of an alley pavement replacement project. This error caused confusion among the bidders and created significant differences in the bid prices and the total bid amount. Staff intends to correct the descriptions, update the bid documents and re -advertise the project. City Council consideration for the award is planned for January with construction work starting in February. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c) (maintenance activities with negligible or no expansion) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment.
