AYES: NOES: ABSENT: ABSTAIN PUBLIC HEARING ITEMS: Dunlap, Koetting, Kramer and Weigand None Hillgren, Lawler Zak ITEM NO. 2 DAVIS MODIFICATION PERMIT (PA2016-180) Site Location: 2912 Broad Street SUMMARY: A modification permit to allow an addition of approximately 68 percent to an existing nonconforming single -unit residence, where the Zoning Code limits additions to 50 percent of the existing gross floor area. The easterly side of the existing residence encroaches 1 -foot -2 -inches into the required 4 -foot side yard setback. The applicant is proposing to demolish the existing nonconforming storage garage and replace it with a conforming two -car garage, as well as construct a new master bedroom suite and kitchen on the first floor. The Planning Commission voted to approve the project as recommended by staff. AYES: Dunlap, Koetting, Kramer, Weigand and Zak NOES: None ABSENT: Hillgren, Lawler ABSTAIN: None ITEM NO. 3 JAN'S HEALTH BAR CONDITIONAL USE PERMIT (PA2016-141) Site Location: 3021 E. Coast Highway #A SUMMARY: A conditional use permit to establish a 1,243 -square -foot restaurant, Jan's Health Bar, with 410 square feet of net public area in a vacant space within a shopping center. Proposed hours of operation are 8:00 a.m. to 6:00 p.m., Monday through Planning Commission Action Report December 13, 2016 Page 2 Saturday, and 8:00 a.m. to 5:00 p.m. on Sunday. There will be no alcohol, live enterainment, or dancing. Also included is a request to waive four parking spaces. The Planning Commission voted to approve the project as recommended by staff. AYES: Dunlap, Koetting, Kramer, Weigand and Zak NOES: None ABSENT: Hillgren, Lawler ABSTAIN: None ITEM NO. 4 THE VILLAS AT FASHION ISLAND CONDITIONAL USE PERMIT (PA2016-179) Site Location: 4200 and 7120 San Joaquin Plaza SUMMARY: A conditional use permit for a cafe with a Type 41 (On Sale Beer and Wine) and a poolside lounge with a Type 57 (Special On Sale General) Alcoholic Beverage Control (ABC) license at the Villas Fashion Island, a residential apartment complex. The cafe is located near the center of the residential development and is open to the public with proposed hours of operation of 6:00 a.m. to 10:00 p.m., daily. The poolside lounge is open to members and their guests only and has proposed hours of operation of 7:00 a.m. to 11:00 p.m., daily, with alcohol service 10:00 a.m. to 9:00 p.m. There will be no live entertainment or dancing. The Planning Commission tabled the item at the request of the applicant. The item will be renoticed for a future meeting. The Planning Commissioner provided comments that will be summarized by staff and submitted to the Council for consideration. No formal action was required. Review and discuss the Sustainability Plan; and 2. Direct staff to report any comments and/or recommendations to the City Council. IX.
