It would be nice if as assessments go up, tax rates would came down, But obviously this is not the format, and even the news papers describe these lneroases as "windfalls'" for thole who have power to in• creon budgeta. Correct me if I om wrong, but John Q. Taxpayer will poy approximately S416 ,000, or, (hold on to your hat), a whopping 21.5" mOre for ser- vices in the City of Newport Beach in 67-68 thon paid in 66-67 . Furthermore, I om , sure Newport Beach will no t be unique, and that other communities will fore no better -if os good! How c on the real property owner get this "monkey off his back"?!! To overcome this restriction, an Act of the 1957 Legislature exprenly allowed the CoUnty to trade portions of its lands for that of adjacent owners provided that the State Lands Commission found ( 1 ) the lands no longer useful for navigation, commerce, and Sshing; (2\ the lands reCeived be at least equal in value to the ands traded; ( 3) the lands received would be u~ qnly in the state-wide interest. (If an exchange eventually takes place it wiU be subject to judicial review.) In 1964 the Orange County Harbor District submitted to the County Board of Supervisors an "Upper Newport Bay Land Exchange Plan," prepared in corlsultaUon with the Irvine Company and the City of Newport Beach. Under the plan the County would receive 450 acres in exchange for 98 acres of tidelands. Of the 450 acres, 273 would be waterways leaving only 1n acres for parks. The Right of Way Department estimated that the County would receive land worth $3.3 million more as a conse· quence of the trade. The Lands Commission StaH rejected this figure but another report prepared by another ap· praiser in 1965 set the balance in favor of the County at $8 million. The Commission Staff disagreed with this also but indicated that the County would receive a signiBcant monetary advantage. The staff of the Lands Commission objected to the plan primarily because it "would diminish the greater public use which could be developed otherwise." Unfortunately this is not a constructive criticism for obviously one alter· native plan which would increase public usc would be to condemn the entire bay and develop it under public own· ership and operation. It is not enough to say that some alternative plan would yield more public benefits without balancing these bene6ts against the implied costs. Perhaps the Commission Staff's objection can be inter- preted to mean that although benefits would accrue to both the public and the Irvine Company under the pro- posed plal'l, the Irvine Company would receive the 1ion"s share. If this is the Commission Sta!'s position, then it should move toward its objective by proposing specific criticisms and alternatives. Surely some development of the Upper Bay would serve the state-wide interest more than the present undeveloped condition. Orange County's taxable boats ( those over S250 in value) had a 1966 assessed value of $11 ,243,200 (with a market value of about S50 miJlion ). An addition of one·flhh as many more boats would add S2 million to the assessed value of County boats (and over S8 million to the market value). Needless to·say, most of these boats would be built or purchased in the area, once again adding substantial eco· nomic benefits to the local picture and almost equal bene- 6ts to the state in sales and income taxes and to the federal jZO~ment in income and other taxes. It is our belief that these public benefits have not been taken into sufficient account by the California Lands Commission StaH. as they have on Dana Point by the federal ji!:Ovemment. The overriding consideration for the Upper Bay Devel- opment is the public need. There is a current shortage of berthin.l{ and launching facilities on the 42 miles of ocean front of Oran.'te Countv. Ownership nf boats has risen from 4,548 in 1950 to 24.500 in 1965. The County estimates there are some 10,000 small boats in the area below S250 in value. too low to be taxed profitably but still enjoyed hy their modest income bracket owners.
