HomeMy WebLinkAbout12 - Filming Planning Commission Meetings; Amendment to Council Policy A-13 - Amended ResoJanuary 24, 2017 Agenda Item No. 12 RESOLUTION NO. 2017- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, AMENDING CITY COUNCIL POLICY A-13 RELATING TO DECORUM AND ORDER FOR CITY COMMISSIONS, COMMITTEES AND BOARDS WHEREAS, the City Council of the City of Newport Beach (City) values and appreciates the appointed commissions, committees, and boards that assist the City Council in serving our residents, businesses, and guests; WHEREAS, the City Council adopted City Council Policy A-13 in 1996 to ensure the City's commissions, committees, and boards conduct their public deliberations and actions in an atmosphere free from personal animosity and hostility; WHEREAS, some residents have requested, in the interest of greater transparency, to record Planning Commission meetings for later viewing on the City's website and/or NBTV; WHEREAS, the City Council is interested in expanding transparency and increasing opportunities for residents to be more involved in City government; and WHEREAS, the City desires to amend City Council Policy A-13 to provide guidance to commissions, committees, and boards that are now, or may be in the future, subject to video recording. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council adds Subsection M to the "Policy" section of City Council Policy A-13 to read as follows: Especially in regards to filmed meetings, and where an agenda item may later be appealed to another body or involve an appeal of another decision, be cognizant of the need to serve in an adjudicatory role and to be direct and concise in one's comments, without grandstanding or operating in a manner which may prejudice the rights of the parties. Section 2: The recitals provided above are true and correct and incorporated into the operative part of this resolution. Section 3: The City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Resolution No. 2017 - Page 2 of 2 Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
