CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Patrick J. Alford, Zoning Administrator Liz Westmoreland, Assistant Planner Melinda Whelan, Assistant Planner David Lee, Planning Technician B. REQUEST FOR CONTINUANCES The Zoning Administrator reported that staff requested Item Number 4 be continued to January 26, 2017. One member of the public, Jim Mosher, stated he had comments he wanted to make regarding the project. C. MINUTES of December 15, 2016 Action: Approved D. PUBLIC HEARING ITEMS ITEM NO. 1 4401 and 4405 Channel Place Condominiums—Tentative Parcel Map No. NP2016-023 (PA2016-187) Site Location: 4401 and 4405 Channel Place Council District 1 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a tentative parcel map for condominium purposes. Whelan explained that a duplex was demolished and a two- unit dwelling is currently under construction which provides the minimum required parking and meets all of the Code requirements. Whelan added that no waivers of Title 19 are proposed and that she has a minor change to include a new fact in support of Finding K in the Resolution. She recited the added fact for the record and concluded that staff was able to make all of the required findings and recommends approval to the Zoning Administrator. Applicant Buzz Person, on behalf of the Channel House LLC, stated that he had reviewed the draft resolution and agrees with all of the required conditions. He added that he was in agreement with the added fact to Finding K in the Resolution. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved Page 1 of 4 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 01/12/2017 ITEM NO.2 411 Heliotrope Avenue Condominiums — Tentative Parcel Map No. NP2016-024 (PA2016-188) Site Location: 411 Heliotrope Avenue Council District 6 Liz Westmoreland, Assistant Planner, provided a brief project description stating that the project is a Tentative Parcel Map for 411 Heliotrope Avenue. The lot is zoned as two-unit residential. Ms. Westmoreland stated that there is an existing duplex onsite that will be demolished and replaced with a new two unit duplex. The Tentative Parcel Map would merge the portions of underlying parcels into a single legal lot and allow for each unit to be sold individually as condominiums. No waivers of subdivision development standards are proposed with this application and the proposed structure will comply with the City's Zoning Code. Staff recommended approval of Tentative Parcel Map No. NP2016-024 and provided a resolution with findings. Ms. Westmoreland also discussed the public comment she received via email from Mr. Doug Foster, an interested party who owns property near the project site, regarding construction concerns. Ms.Westmoreland clarified that the application for 411 Heliotrope Avenue is for a parcel map specifically, and that the plan check process is not discretionary. She noted that applicable building inspector information was provided so that if any issues arise during construction Mr. Foster will have the necessary contact information. The Applicant's representative, James Buzz Person, stated that the owner had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 3 518 and 518 '/2 Narcissus Avenue—Tentative Parcel Map No. NP2016-025 (PA2016-189) Site Location: 518 and 518 % Narcissus Avenue Council District 6 Liz Westmoreland, Assistant Planner, provided a brief project description stating that the project is a Tentative Parcel Map for 518 Narcissus Avenue. The lot is zoned as two-unit residential. Ms. Westmoreland stated that there are two existing detached dwelling units onsite that will be replaced with a new two unit duplex. The Tentative Parcel Map would allow for each unit to be sold individually as condominiums. No waivers of subdivision development standards are proposed with this application and the proposed structure will comply with the City's Zoning Code. Staff recommended approval of Tentative Parcel Map No. NP2016- 025 and provided a resolution with findings. Action: Approved Page 2 of 4 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 01/12/2017 ITEM NO.4 101 Bayside Drive—Limited Term Permit No. XP2016-009 (PA2016-164) Site Location: 101 Bayside Drive Council District 5 Action: Continued to January 26, 2017. ITEM NO. 5 2352 Redlands Drive—Lot Merger No. LM2016-010 (PA2016-160) Site Location: 2352 Redlands Drive Council District 3 David Lee, Planning Technician, provided a brief project description stating that the project is a lot merger proposed between 2352 Redlands Drive and two unaddressed parcels. The purpose of the merger is to merge three parcels into one for future development. Mr. Lee stated that all three lots are under common ownership, and then discussed the history of the rear lot being granted to the owners of 2352 Redlands. Mr. Lee stated that the existing drainage feature located on the rear lot would remain unchanged, and that the merger would not create an excessively large lot. Since there are no waivers of the subdivision development standards, staff recommended approval of the project. Applicant Paul Nguyen, on behalf Brian Nguyen, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Douglas Foster, Back Bay Surveying & Mapping, asked where the location of the merger was taking place. Mr. Lee answered that the project was on Redlands Drive. There were no other public comments. Action: Approved ITEM NO. 6 2800 and 2804 Newport Boulevard — Lot Merger No. LM2016-011 (PA2016-193) Site Location: 2800 and 2804 Newport Boulevard Council District 1 David Lee, Planning Technician, provided a brief project description stating that the project is a lot merger for 2800 and 2804 Newport Boulevard, two lots under common ownership. Mr. Lee stated that the lot at 2800 is currently developed with the EI Ranchito restaurant, while the lot at 2804 is currently developed as a parking lot and outdoor dining area in support of the restaurant. Mr. Lee stated that the purpose of the merger was for the future construction of a patio cover over the existing outdoor dining area to be built over the existing interior property line. Mr. Lee stated that the merger would not create an excessively large lot and will not change the overall appearance of the current development. Since there are no waivers of the subdivision development standards, staff recommended approval of the project. PUBLIC COMMENTS ON NON-AGENDA ITEMS One member of the public, Jim Mosher, spoke and questioned if Item No. 4 Newport Dunes Limited Term Permit will require a Coastal Development Permit. In reference to the Implementation Plan, he questioned why the section that mirrors the Zoning Code's Limited Term Permit requirements was crossed off by Coastal Commission; what does the omission of this section mean; and what standards would the Zoning Administrator use to make a decision. The Zoning Administrator explained that Limited Term Permits were taken out of the Local Coastal Program Implementation Plan at the request of the Coastal Commission; currently the City does not have authority to issue Coastal permits. If a Coastal Permit is required, then it would be reviewed concurrently with the City's Limited Term Permit once the Implementation Plan becomes effective. F.
