Controls proposed for Mariners Mile
prQPertles have prompted some pertinent
remarks from Newport Beach Council-
man Dick Croul.
"A developer buys this valuable prop-
erty under one set of conditions, and
then you come In here with these regula•
tions," he said of the proposal to set a
50 foot height limit and 6(1,{, limit on
area that could be developed. "If ~were
a developer or ow ned this land, I would
not stand for It,"
Councilman Croul has hit upon the
fundamental evil of legislative attack on
property. It Is unfair and certainly un-
constitutional to take away property value
without just compensation.
We faced a similar threat two years
ago when our City Council was about to
enact a drastic parking ordinance for
the long e stablished business areas in
our city. The law, lf enacted, would
have taken away as much as $20,000 to
$30,000 U;o~ U}e . ~ v~ue of each
business :pr operty1 because of severe
' restrictions on remodeling and rebuild-
ing. Only ·at the last moment did an
arous.x l business community get to the
Council chambers to eliminate' the worst
features of the proposed ordinance.
For some time now we have been
facing another attack on property values.
This comes fr om the changes recom-
mended for off-s tre et parking for resi-
dential lots --the proposal for two gar-
age spaces for each residential unit on
a lot. This would in eftect rezone an
undeveloped R-2 lot to R-1, cutting the
potential Income, and thus reducing the
sale value as much as $5,000 to $10,000.
These threats should alert all local
citizens to the danger of financial loss
that they can suffer through local law-
making. If the Importance of private own-
ership of property and the constitutional
protection of that right were understood
by our lawmakers, and also by the voters,
we could be s ecure In our right to own
property. In the long run, that right Is
the basis for the protection of all other
rights, Including freedom itself.
