and Thomas Kot.ebuk, 3Z, of
Carsoo, CaUl., were shot to

of the money out of the car
windows along the route of thelr
pursuit. Several shOts were
flred at the fleeing suspects

"Either blind to the facts or delib-
erately distorting the facts," said Mayor
Don Mcinnis of Newport Beach.
"Big Sister watching over us," said
Councilman Dick Croul.
These caustic remarks were aimed
at Judy Rosener, Lido Isle resident,
anti-private property activist, and voci-
ferous member of the anti-property
majority on the South Coast Reglona1
Conservation Commission.
In published statements, Mrs. Rosener
has treated with scorn both the consti-
tutiona1 guarantees of private ownership
of property --the keystone of all persona!
freedom --and also the profit motive,
~which Is the automatic generator for
upgrading the living standards of all
people In our free enterprise republic.
This Is Ironic, coming from one who
lives on Lido Isle, In an expensive house
that Is certainly the reward of the profit
motive that has made our nation the
economic wonder of the world.
Mrs. Rosener seeks to down-zone
property here In Newport Beach --not
,_on the exclusive island w.llere she makes
•iter borne, but In the ·.:ueas tbat were
developed by the pioneer residents of
our coastline commuirlty, long before
there were hordes of visitors or coast
commissioners clamoring to take away
our property rights.
The specific Issue that brought forth
the wrath of City Council members was
the over-ruling of local zoning laws by
the Coast Commission In the case of
Dana Smith, who had properly obtained
building permits, In compliance with the
city code, to construct 3 duplexes on R-2
property In West Newport. Judy Rosener
was one of the majority of the unelected
Coast Commission voting to overturn
laws of long standing, which had been
duly adopted by the elected represen-
tatives of the citizens of Newport Beach.
I do not believe that the people or
California, In approving Proposition 2 0,
gave their consent to the overthrow of
their own locally enacted laws. Prop-
osition 20, which is the basis for the
current onslaught on our right ofproperty
ownership, would never have been
approved If It had contained the explana-
tion that local laws can be set aside by
directive of an unelected commission.
There will be more decisions like
this one unless prompt action Is taken
to reverse this attack on property, which
Is an attack on our own freedom under
the law.
U we who stand for freedom lose
this fight by default, we do not deserve
our freedom. There Is one course left
for us while we still are a nation under
law, so that we can continue to protect
our rights, and your rights, and Judy
Rosener's rights. That Is by a legal
eballenge In a court of law against Prop-

CRISIS
FOR LOCAL RULE
Our May or showed the other night that he has some real
backbone. When the Coast Commission over-ruled our own
city permit system and told a local property owner that he
couldn't build on his property --even after the city okayed
it --the Mayor showed he's ready to fight them.
This points up a real problem in our government. Too
much power is given to· committees and commissions. These
guys aren't elected --they're appointed. They don't have
to run for re-election. They're harder to fire than civil
service workers. Yet, they have almost unlimited power.
I say, let's pull their teeth. Let's depend on our local
elected officials tp look out for us. They answer to us and
they have better sense than some committeewoman.
Now, the city should tell this fellow to go ahead and build
those 3 duplexes. It's his property, he got the proper legal
permission from the city, and he has already gone to con-
siderable expense. U this ridiculous Coast Commission wants
to fight us on it, the City Attorney and City Council should
be ready t o go to court t o defend our local laws. U our
l ocal officials don't have time to do this, they should FIND
time.
By the way, do you think it's proper for Joe Rosener to
serve as the City's Planning Commissioner while Mrs. Rosen-
e r is Oil the Coast Commission? They both rule on many of
the same projects. And, of course, they're both appointed --
not elected,
Come on, Newport, let's fight for our town and its laws.
Down at the store, we have local-ordinance "No Parking"
signs and plenty of tools that will help you clean up your
lawn and sidewalk after the dogs have visited. See you at the
end of a shovel.
