Fashion Island Casa Discrimination
Lawyer to Fila Federal Lawsuit
An attorney for two black men
charging racial discrimination against
the Newport Beach Police Department
has withdrawn an offer to settle the
allegations out of court for SI0,000
apiece a nd expects to file a federal law-
suit for more than S4 million next week.
Tom Barham, the attorney represen-
ting Long Beach residents William
Powers and Carl White, said informa-
tion he received Tuesday Feb. 4 con-
vi nccd him the police had greater in-
volvement in the Fashion Island shop-
ping center incident last Nov. 21 than
he previously had believed.
Powers and White contend they were
detained at gunpoint a total of four
hours without provocation by a
plainclothes Newport Beach police of-
ficer and a security auard for the
Fashion bland jewelry store Wyndham
Lee.
Barham had earlier informed the city
a lawsuit in the case would not be filed if
the settlement of Sl0,000 apiece for the
men were agreed upon.
But a letter received from attorney
Richard C. Duncan Jr .. representing the
jewelry store, caused Barham to rethink
the settlement offer, he said.
According to Duncan's letter. the
Wyndham Leigh security guard. iden-
tified as Herbert W. Ma pies, noticed
the two men looking through a window
of the jewelry store, then watched as
they disappeared into a nearby men's
clothing shop, Barham related.
Minutes later, a man known to
Maples as a plainclothes police officer
· told the security guard he was. looking
for two black men who were acting
suspiciously at a second jewelry store.
Maples aupp_osedly told the plainclothes
officer they were in the clothing store.
When they came out of the store,
they were immediately confronted by
Maples and the Newport Beach officer
and held for three hours, Barham said.
"They had a report of two suspicious
black men." said the attorney. "That's
fine , but that doesn't excuse them from
using common sense and good judg-
ment. If they were acting suspiciously,
why didn't they watch them to see what
they were doing?"
Duncan, in his letter, says that
Ma pies, who is also employed by the
Los Angeles Police Department, left the
detention scene after 30 minutes, but
Barham contends he was there the en-
tire three hours the alleged victims were
hcJd. The men claim they were not only
held at gunpoint, but were subjected to
racial slurs. They also were photograph-
ed and searched.
Finally rcJcased, they were pulled
over a short time later by a city police
unit, they charge. and held for nearly an
hour bcf ore allegedly being told, "Get
out of Newport Beach and don't come
back!'
.. Two detectives held them for four
hours," Barham complained ... How can
they justify that?'' He said it was impor-
tant to take the case to court to teach
the police a lesson.
•• 1 ·m not anti-police and I hope that
comes through in all of this. Police arc
important to an orderly society ... the at-
torney added ... But who polices the
police? If the pohce don't do it. who
will?"
Barham said the latest information
he has recei ved will be incorporated into
his suit in time for filing Tuesday, Feb.

ActualJy, it wasn't Lincoln, but an
imposter named Charles Brame, a
former teacher who turned actor when
his resemblance to our sixteenth presi-
dent became all too apparent.
After a brisk and lively speech to the
youngsters, Lincoln, ne Brame, opened
the noor for questions and answers .
.. Who murdered you," querried one
student.
"Why, I have not been murdered,"
countered Lincoln/Brame, in character. •• u I were, bow could I be here to talk
to you?"

Board of Trustees has agreed to pursue
plans at its Newport Center site. though
it was not prepared to release details at
press time Tuesday afternoon.
A new 50,000-squarc foot structure
for the art museum. as well as an ex-
panded library, arc part of Irvine Co.·s
build-out plan, which is expected to
begin a series of public hearingi before
the Newport Beach City Council soon.

person committee which will
condud interviews and recom-
mend the city's third police chief
in three decades, succeeding
Charles Gross.
Gates and Glavas were a~
pointed this week by the city's
civil service board. Civil service
board chairman Norman ~ts
and board member Bert Carson
have aJready been appointed. An
at-large representative is to be
selected by City Manager
Robert L. Wynn prior to the
start of the interview process. ex-
pected in mid-to-late March.
Some 14 candidates or an

after a series of written tests -
designed to assess management
ability. philosophy and style -

results of the written exams are
known.
A ranked list of the top can-
didates is expected to be ready

Munson said.

Wayne Ttiiebaud Exhibit is Held
Over at ·Newport Art Museum
The Newport Harbor Art
Museum's exhibition of a
retrospective of paintings and
drawings by California rcaJist.
Wayne Thiebaud. will be held
over two weeks to accommodate
the record-breaking number of
pcopte visiting the show.
Originally scheduled to close
Feb. 16, the exhibition will re-
main on view through March 2,
it was recently announced by
Museum Director Kevin E.
Consey.
In little over a month, more
than J 5.000 people had come to
the museum to see the showing
of Thiebaud's popular worts.
The museum reports an averaae
daily attendance of nearly SOO
since the exhibition opened on
Dec. J J. This number is just over
twice the normal attendance for
this time of year.

will proceed on a national tour
following its presentation at
NHAM. According to Consey

Charlie Brame makes his living in a peculiar way. The
former Missouri schoolteacher bas, for some time, worn
an extremely unfashionable bear~ a very long t~t,
and a ·beat-up top bat. He speaks in an eloquent
manner, _passi!?J. himself off as Abraham Lincoln.
He gives an unprC1Stve show, one that fascinates both
children and adults.
But why is Lincoln, a man who died over 120 years
ago, held in such admiration by so many? Perhaps it is
the awe we hold for him; the tall, wise articulate
statesman with a sense of humor who led our nation dur-
ing its most troubled time.
But interestingly, according to Brame, although Lin-
coln is remembered on (or around) bis birthday, many
Americans know surprisingly little about him. -
What they know most about, according to Brame, is
that "Lincoln was shot, he freed the slaves, he saved the
union, he lived in a log cabin, and that he was tall and
ugly." Strong words from a man who makes his living
looking like him.
What was the least known fact about Honest Abe? Ac-
cording to Brame, that be was plagued by chronic con-
stipation. And bunions.
But one thing that is frequently auociated with Mr.
Lincoln is his sense of humor. Paul Boller Jr.'• book,
.. Presidential Anecdotes," documents it well.
Like the time bis ono-time rival, Senator Stephen
Douglas, called him a .. two-faced man." Lincoln
responded: "I leave it to my audience. If I had another
face, do you think I would wear this one?"
At another time, a foreign diplomat came upon Lin-
coln while be was polishing his shoes. "Mr. President,"
he said, ~)'ou black your own bootsT' uy es," replied Lin-
coln, 66Whose do you black?"
Charlie Brame, a man more handsome and a wee bit
shorter than Lincoln, gives a stirring performance; when
he appeared at a Corona del Mar elementary school last
week, he had some of his audience actually believing be
was Lincoln.
Brame says he can't imagine a better way of making a
li vi ng. Neither can we.

teacher on the canvas painted by
my friend, Bob Schaar.

watched every apace shuttle
blastoff, but this is the one I'll
remember the rest of my life."
Bob Schaar is known to so
many in our area. He it un-
questionably ooe or the finest
painters in Orange County. and
he soon will have a o~man

Bob Schaar's portraits are

been painted by Bob. One year.
he received an enormous com-
mission from Chapman College
to do the portra its of all the
members of its board of trustees.

William Lyons. and others. He

years ago when I wu on the Girl
Scout Board of Directon. I had
known Bob's wife. public
relations specialist Jackie
Schaar, and she persuaded Bob
to do the annuaJ Girl Scout
calendar. It was the nicest one
they have ever bad, with fine pen
and ink or wash illustrations of
Girl ScoutJ and their activities . . -
Some time later, when 1 was
directing the promotional efforts
for the Orange County Philhar-
monic Society, Sc haar il-
lustrated an elegant silver
brochur~ .. A Sound Investment
in Oruge County.•• for the
Society, and for years it bu been
the basic piece for the society's
fund-raising.
One niaht, at an OCPS board
meeting, I had the pleasant tut
of introducing Bob and showing
bis portfolio. In it were eumpla
of 20 ycan paintina for the Air
force, for commercial films, for
the sports world. His portrait of
Babe Ruth is memorable. His
action paintings of the Air Force
were stark and real.
Commercial companies in our
a rea wh o have retai ned Schaar
include Avco Financial Services
and the Koll Company. For the
Orangcwood Home, Bob recent-
ly did his second portrait of
Developer William Lyons, this
time s howing Bill Lyons with a
aroup of children who bad been
helped. Lyons donated a million
dollars to the home.
One year, Schur was selected
as one of 11 commercial artists
in the U.S. to visit Saudi Arabia
and produce paintinp for tk

the threat of condemnation the

co uple does not have a heated
discussion periodically, they are
not communicating. Someone is
suppressi ng something. Nothing
can run that smoothly for such
an extended period of time
without some objection or dis-
agreement .
This past yea r, I realized that
I was suppressing some of my
tech ng )I . I love to play the mar-
l~ r. When event ~ occur that are
n0t totally to my liking, J tend to
downplay them . Suddenly. I am
unhappy.
Thi s time 1t was difficult to
put my li nger on the problem so
l made a list of what I would ex -
pect from a mate in a n ideal
relationship. I highli ghted the
points where I felt my husband I
needed so me work.
The next step was confronting
my husband with this newfound
information. In the past, I was
reluctant to take up our limited
time together to disc uss any
minor issues that were bothering
me. So by now, J had a few
points, not just one, needing dis-
cussion.
One evening. we sat down to
talk . I was careful to be calm,
pleasant a nd approached him in
a non-threatening ma nner. I was
sure to avoid placi ng all the
blame with him as I knew that I
was not without fault . He later
confirmed th at notion.
We both enjoy our active
weekl y sch edul es. I didn 't think
it necessary that we st op doing
anything. But, I felt we needed

cond Stage has a gem of a play
in Patrick Smith's .. Driving
Around the House." It is his
first work and it augurs well for
his future.
A most unusual play, it deals
entirely with how a five-year-old
boy secs the adult world. A
.. Grown Up Paddy" serv~ as
narrator and introduces each
s cene . What transpires is
autobiographical, as Smith
relives his own childhood in the
play.
The scope covered by the play
as large. We sec such scenes as
young Paddy's being taught to
tic his shoelaces, of the father's
determination to tell his children
that Santa Claus is a fake, of the
devotion between the children
and their grandfather, the young
boy's confusion as he sees his
parents heading for a divorce
because of the father's drinking
and infidelity.
The scenes pile up, the tran-
sitions between each arc abrupt,
emotions reach a peak of intensi-
ty and arc suddenly cut off to
move into a different scene.
Through it all runs the thread of
memory when figures and events
long ago locked ~ithin a child's
mind arc brought into a reveal-
ing reality.
Smith's play has been given
loving and careful treatment

and intuitive direction. Few
directors have his sensitivity. It's
not an easy job to keep a play
moving with such fluidity, but he
has done so with finesse.
The cast is superior. As the
narrator and older Paddy,
Timothy Donaghue is excellent,
giving the play a sturdy basis
with his incisive narration. Joe
Dahman , although no
youngster, is an utter joy as the
young Paddy, conveying with
deep conviction the attitude and
feelings of a five-year-old .
Gabrielle Sinclair also manages
to hide her own age and
transports herself into the feeling
of a four-year-old sister.
M ichacl Canavan is a stan-
dout as the father, a man who
precisely conveys the many con-
flicting moods of the man, his
anger, his impatience, his Jove
for bis children, his drunkcnneas.
It is a compJex role that ii hi1hly
demanding and he creates a
memorable portrayal. Jane
Atkins vividly delineates the
mother with her tenderness. ber
hurt, her despair -au without
melodramatic histrionics. Tom
Rosqui is a standout as Oram~
and Richard Doyle as the Uncle
who wants to give up the
priesthood is, as always,
bursting with energy and
radiance.
John lvo Giles' set design
neatly overcomes the multitude
of design hurdles. All other
technical aspects are done with
precision.

that ruins a solid potential for
escapist fun. Cluttered with
pointless talk and extraneous
drama, the thrills and excitc-
men t arc too few and far
between to make for satisfying
entertainment.
The simple story of a teenager
(Jason Gedrick) who enlists the
aid of a military officer (Louis
Gossett, Jr.) to rescue bis father
from certain death in the Middle
East, is inflated into two hours
of dead weight. The gimmick of
using kids and jct planes in the
dangerous mission is not ex-
ploited very convincingly or
creatively. especially iri the unex-
citing photography and sound.
The hokey. inane dialog
makes it harder for the acton to
be interesting or believable, even
though Gossett acquits himself
as commendably and sincerely
as he can. The characters
become laughably trite and cor-
ny, including the cartoon foreign
villains who seem to have drifted
in from some cheap l 940's war
movie.
Sidney Furic's slack. imper-
sonal direction makes the action
even more preposterous than it
already seems. He even handles
the flat-waving, right-wing
patriotism with ludicrous super-
ficiality. thereby removing the
essential heroic element. With
the addition of rock music dur-
ing the flight scenes~ this empty
comic-book junk becomes even
less tolerable.
More hardware i1 wasted in
.. Black Moon Rising." a fllm
that piles on noise and motion
without any sense or structure.
This dog of a 0 8" exploitation
movie is about a supenonic jet
car that every cardboard
character wants to get their dirty
hands on.
The so-called hero is a
professional thief. played with
one dead expression by Tommy
Lee Joancs, who's hired by the
government to steal the high-
tech machine from a mean old
corporate bad-guy (Robert
Vaughn, wasted again).
Everyone looks and talks
tough, including poor Linda
Hamilton as the obligatory love
interest, but no one believes it
for a moment, thanks to the
idiotic mishmash called the
screenplay. The cold inefficiency
of the direction by Harley
Cokliss further removes any
humanity. suspense, and excite-
ment.
This callow trash gives action
movies a bad n~ bvt the bat
thing to say for it is that it's easi-
ly forgettable, like most dis-
posable movies and television.

Bodenhamer is firmly against
letting a child learn from failure
and the logical consequences of
bad experiences. He advocates
strong parental guidance along
with plenty of love and affection.

and re-establish community
standards -no drugs, no

Upper B•r Toure
Scheduled
On Feb. 8 the Friends of New-
port Bay will host guided nature
walks in the Upper Newport Bay
Ecological Reserve. Small
groups will be guided through an
introduction to the nora and
fauna of this wildlife habitat.
Specialists will be on hand to
explain how this marsh provides
a home to many varieties of
wildlife. Tour groups will start
every 15 minutes or so from 9
a.m. until I 0:30 a .m. -begin-
ning at the corner of East Bluff
Drive and Bay Bay Road. The
tours move at an easy pace and
last about an hour and a half.

The Sustainers of the Junior
League of Newport Harbor did
just that recently in a house that
is currently on the market.
Louise Ewing, program director
for the event said, "events like
this arc a good excuse to see dear
old friends." The group is made
up of women who arc no longer
active in the Junior League, but
still enjoy getting together for
special programs.
Seated in an all·white at-
mosphere, the ladies were
treated to a sack lunch of wild
rice, croissant sandwiches, and
divine truffles all from brightly
colored bags. The Junior League
Fizzes 'the recipe is in their
cookbook) were flowing as the
women settled down-for a show
of Spring fashions presented by
Kitty Leslie, community and
fashion director of Fashion
Island. Standing in the entry hall
with microphone in hand, Leslie
described fashions from Ouy
Laroche, Mondi, Jean Ryan,
Nelly's Tahari, Tripos, Antonio
Buttaro, Selvaggio, Ellesse,
Splash N ' Flash, and Apropos.
The show began with the
jacket story. showing examples
in bright prints and aJI finely
tailored. Sweatering for Spring
was next. They were layered
with turtlenecks or worn under
