The Jaa.t roaniet ia tbl mara-

Hoffmann bout bepn this week
in Superior Court .. and both
contenden amwercd the open-
ing bell-aJong with JOO poll
worken who had been aubpo-
enacd by Hoffmann•• att~
Hoffmann ii challenaina lut
month's recount in the 40th,
Congressional District which
overturned his apparent victory
in the Democratic primary and
resulted in write-in candidate
Sumner being declared the
wmner.
Hoffmann and Bob Levy, his
attorney, are contending that
someone added some I ,SOO
ballots for Sumner between the
time the write-ins were counted
by poll workers on election night
and the time the recount began
16 days later.
Sumner has labeled Hof-
fmann's charges .. ludicrous" and
accused the Lyndon LaRouche-
backed candidate of using "typ-
ical La-Roucbe-type tactics" in
continuing his challenge to the
election results.
Monday, for the second time
since the election, the two men
faced each other in court, backed
by teams of lawyers. The fint
court case was won by Sumner,
when Superior Court Commis-
sioner Ronald Bauer ref used to
halt Sumner's certification by
the county Registrar of Voters
as the winner of the recount. At
that time, Bauer pointed out that
Hoffmann could challenge the
election by filing a different
action in Superior Court.
This Hoffmann did. He and
~go-60ietbU

will ~. to tbe tlCIOUlacy of
their election iiiibt couatiial.
They did aot aet to telti(y
Monday, however. Levy uted
for a delay in the start of the
cue until Wedoaday, to aive
him time to paepere a reply to
~umner motion to diamiN the
cue~·· So. the poll worken-
virtually all tenion and mottly
women-were told to be ready
to return to the court to testify
on two boun notice beginning
Wednesday.
Sumner's attorney, Frank
Barbaro, said that be is aeeking
dismissal on three ground1: that
the House of Representatives
and not the Superior Coun has
jurisdiction in the case of a
disputed Congressional election;
that only Sumner is named in
the action and not the Registrar
and Secretary of State who
certified Sumner's election and
would have to be ordered to
withdraw that certification
should Hoffmann prevail; and
that the number of ballots dis-
puted in affidavits filed by
Hoffmann's side in the case only
specifically question 576 ballots,
which would not affect the result
of the election even if they were
all found to be improper.
Levy said that the state Elec-
tions Code specifically gives the
Superior Court jurisdiction in a
disputed election and sets
parameten for such an action,
including the proviso that only
the candidates arc named in the
action and the judge can order
actions by the Registrar and
~retary of State even though
they are not specifically named.

Although it's bard to improve OD these perfect summer coolen,
we do think you11 enjoy the latest twisu OD thac lemonade drinb.
Now that lemons are abundant and inexpensive at the market,
you may enjoy making homemade lemonade, sweetened with a small
amount of honey. As a step-saver, however, try natural bottled

Newport Beach baa Iona been a jewel of the Southland,
attrtctina tens of th~usand• weekly to share in our aun, ocean
breeze, beaches, harbor, bay and penimulL
Our city's population routinely multiplies during the
summer-a fact most residents don't relish; but it does come
with the territory. And the crowds tend to be rather careless
about picking up after themselves. One look at the beach
around sunset will testify to that.
It isn't a problem unique to Newport. More than two
decades ago, many Californians started trying to do something
about the litter problem-namely, requiring a refundable
deposit on all beer and soft drink containers.
Now the Californians Against Waste, who originally
proposed a 5-ccnts per container refund, have apparently
worked out a compromise with its main adversaries-the
beverage and grocery-chain industries. And a bill in
Sacramento has brought them closer than ever to their
legislative goal.
The new-and-improved version would require a I-cent
refund, beginning in October 1987.
You say your family polishes off a lot of soda pop on
a Saturday afternoon? Don't try taking the empties back to
the market-chances are, they1l tell you to go to your local
collection center, up to a half-mile away. It would take a
trunk load of sticky Pepsi cans to justify spending the money
(much less the time) to travel to the center.
With little financial incentive, the only other motivation :
to return old cans is recycling. And that incentive is already
present.

This award is bestowed on the
designer making the most out-
standing contribution to fashion
of beauty. elegance, and creativ-
ity. to the worldwide recognition
of hautc couture.
Perhaps then there could be
no more fitting way for Mr.
Laroch~ to introduce an even
more extraordinary collection
for the coming season than by
creating a custom couture design
inspired by what could be the
most demanding client of them
all, Lady Liberty. The one-of-a-
kind white silk jersey sheath,
sprinkled with embroidered
silver stars and accented with
cascading drapery at the
shoulder, was as majestic as the
statue herself and most dramat-
ically heralded Laroche .. pret-a-

arriving fro m Paris.
The collectio n , available
exclusively at Guy Laroche
boutiques (20 within the
U.S.A.), joins a decidedly
French sense of style with an
aptly American sense of wear-
ability. It features luxurious
challis and fluid, lightweight
flannels, sophisticated florals
and geometrics, exquisitely fem-
inine silhouettes and dressmaker
details that only a mM'tt cou-
turier of Larocbc's stature would
insist upon.
The designs for Fall and

pure.

Wednesday night testifies to the
fact that lots of people know
about the Pleasant Peasant.
Reservations are a must, even on
week nights.
We began the meal with an
order of escargot and a plate of
smoked salmon. The salmon was
excellent. The escargot were
outstanding, arriving sauced,
joyously, without the usual too
heavy dose of garlic that tends
to linger through any subsequent
course.
I benefited from a reading of
the chalk board brought table
side by our server. C1Jers spe-
cials beR are to be considered
closely. I found half of a fresh
pheasant (at the Pleatant Pea-
sant) which bad been swaddled
in prosciutto and then sauced
with the resultiq pan juices
mellowed with cream and mush-
rooms. A pheasant fan, this was
the best rve enjoyed in quite
some time.

Although this tremendous

past the 85 percent sales mark,
Kavert reports that the devel-
oper plans to go ahead and
complete construction and fur-

in October. ·
"While the Newport Beach
address is a major selling pointk
the Terrace at Bayview will
continue the J .M. Peten Com-

asserted.
The wide selection of 7 floor
