Judges reject HOffmann's appeal to overturn

Three 4th District Court of Appeal
judges ruled last Friday that the House
of Representatives is indeed the only
governing body able to bear Art
Hoffmann •s election fraud case.
The court upheld last Aupst's ruling
by Superior Court Judae James C.
W ooUey that election disputes can only
be handled by Congress and not the
state courts.
Hoffmann contended that a 16 day
recount, which ultimately overturned
his apparent victory in the June Demo-
cratic Primary, was inaccurate since
ballot boxes were 06stuffed" with addi-
tional votes for his opponent Bruce
Sumner between the time of the election
and the recount.
The recount yielded an additional
1,228 votes for Sumner. the former
chairman of the Orange County Demo-
cratic Party, which made him the
w10ncr.
Hoffmann took the matter to court
claiming that if be could prove the
existence of ballot tampering the court
could declare him the winner, or even
order another election.
But not one piece of evidence was
ever presented as the court immediately
ruled that it did not have the jurisdiction
to bear the case. The appellate court
agreed, dcfering Hoffmann·s case to the
House.
"I donl know what they're going to
do now." said Bruce Sumner, •they
could petition Congress, or they could
even petition the State Supreme Court
to hear the case, but I f ecl it's over."
Neither Hoffmann nor his attorney
Robert Levey were available for com--
ment re&arcling their next lepJ move.

Sometimes rt seems like yesterday
that we started our business in
the Newport Harbor area. Then
again there are times when 1t
seems as though we've been
here forever!
During those 28 years we have
seen a lot of changes. The pace
has quickened. the population
has doubled many times, the
business community has grown
like a mushroom and Newport
Beach is a completely different
place than it was 28 years ago.
Sometimes I long for the days
I had time for the Chamber of
Qmmerce, M)tt(irw on the Beau-
tifteation Committee and helping
to charter the Women's Division
(now called the Dolphins). In
those days I was also active in
Friends of the Library, Sorop-
timists. and National Charity
league. Where did I ever find
the time? Now each night I go
home with a brief case full of
paper work related to the
jewelry industry and don't seem
to have time for much else. Life
for me, personally, is a lot more
demanding and stressful.

City Council pits incumbent Don Strauss . against
challenger Planning Commissioner James "Buzz ..
Person. Strauss, a slow-growth proponent who
freqoendy finds himself in the minority on council votes,
is running on his record of 18 years of public service.
Peno, an attorney and member of numerous commun-
ity organizations, is also running on Strauss's record.
With that in mind, we thought it important to examine
the record.
Strauss bas served Newport long and well-ten years
on the Newport-Mesa Unified Board of Education, and
eight on the City Council. Some of the credit for what
makes Newport such an outstanding town-from the
mix of commerce and community to our highly regarded
city staff-goes to Strauss. In his tenure he has
accumulated numerous supporters, as well as a healthy
bevy of detractors, as Jim Felton "s column on this page
attests.

A management-oriented businessman, Strauss' goals
include stepping up both the search for a second airport
and, as chairman of the Harbor Quality Committee,
the bay cleanup.
Person has done a commendable job on the planning
commission, and, if elected, would quickly fit right into

be a boat-rocker or a dissenting vote, as Strauss has
sometimes been.

Person frequently points out Strauss' occasional
abstentions on council votes as evidence of lack of
leadership or preparation. But Strauss bas defended
himself, saying that when a vote comes up on a
procedural or non-critical matter and he knows the other
six support a position be docs not, he will sometimes
abstain, conceding to the will of the majority while not
necessarily endorsing it. This strikes us as the mark of
a dissenter who is also a team player, not a nose-th umber,
and this ability to provide a balancing force without
being divisive makes Strauss arguably the most
important member of the council.

His dissentions have been important to the city's well-
being. For example, Strauss opposed the recent airport
agreement on the grounds the larger terminal it will
create will make the county leaders too complacent
toward finding a second site.
We don' always agree with Strauss; we don't always
support his positions. But we do always respect him
for his intelligence, compassion and sense of fair play.
Many may see him as the devil's advocate, but on
a council in need of a little balance, Don Strauss has
done the job. The Newport &sign supports his re-
election.

date, But Can I Help It If They
Love Me?" By "'they" he means
the memben of SPON, LEAF,
the Committee of 4,000, the
Cominittce of 2,000, the Friends
of the Upper Bay, or whatever
name the community dissidents
happen to use at any given
moment. While be historically
votes their biddin1, Don Strauu
wants to stand aloof from the
birds of a feather he flocks
together with. Some people call
it hypocrisy; Don Strausrtalls
it independence.
And there are some prominent
tennis-playing citizens who have
supported Strauss because, they
say, they know where he stands.

Bible Study retreat sponsored by
Our Lady Queen of Angels
Roman Catholic Church in
Corona del Mar. It was a time
of fellowship and talks by three
speakers: Father Bil~ Father
Des, and Jim Schmiesing. The
theme this year was --eow We
Walk in Peter's Footsteps."
Participants were asked to
reflect on Jaow they will answer
when they are called. Or will they

to decide if we will go our way

Father Bill spoke about the
difficulty of prayer and how
people expect prieata to know
how to pray well. He shared an
important experience he had
over 17 yean ago. He went to
a priest's retreat on prayer in
Alhambra when suddenly
another priest got up in a
moment of exasperation and
anger, lashed out at the aroup
and shouted, "You are afraid to
pray or you wouldn"t-be spend-
ing so mucb time taJlriq about
it." He said that it wu important
to him becau.te it WU a tumina
point in hiJ personal approach
to prayer. Between talking about
prayer and doina it is an enor-
moua abyss. He spoke of the
importance of the Mau to him
and bis resolution to truly expe-
rience the Euclwiat, the break-

actor.
Thia new picture, not due for

a story of a dedicated man. His
name is Frank La.Logia and it
is be who wrote the screen play,
based partly on bis own child-
hood experiences, and wbo
directed. He was also the direc-
tor of bis first fa.Im of a few yean
qo, .. Fear No Evil."
I had worked in the fint film
which wu shot on location in
upstate New Y ort, and it wu
t>.ck to Newark and Lyons, New
York for me to do the role of
Father Brennan. Once apin it
wu to play a pries~ which seems
to be the kind of part banded
to me rather often.
To beain with, the New Sky
production took over, for all
intents and purposes, the small
town ·of Lyons. Townspeople
were used u extru, especially
in tbe church scenes. But tbe
actors came from Hollywood
and were established per-
formen. But the main interest
in the fa.lm is Frank La.Logia.
He is above all a feeling,
compassionate, and exactina
di.rector. He ia still quite young,
in hia late 20\, and in hia dual
role • writer and director be is
responaible for tbe film. His
kindne11 toward the perf ormen,
toward tbe CRW, his ability to
aet e.xacdy what be wants from
the actor are aotable. And be
had problems with the weather

names. In fact, the role of
Frankie, playal by nine-year-old

notable and certainly tbe one
