It .. the fireworkHtart-blaze- that-leaves-family-dead/ bomelea story, and we ~ thought that this year we'd fmally been spared the necessity of doing it. . After all, the Fourth of July weekend came and went without conflagration (unless you count the City Council hearings on the Newport Dunes show). No aipificant incidents were reported by the fire department over the three-day holiday weekend. The citywide ban on fireworks seemed to have worked -property damage was zero, injuries were zero, for the first time in a long time. But apparently idiocy is not restricted· to certain holiday periods, because last Sunday somebody, reportedly youngsters, set off an illegal M-80 firecncker in a field of dry grass on a hillside near Superior A venue and Pacific Coast Hip way, starting a fll'C wbicb destroyed one condominium and threatened leVel'al others before beina brought under control. Newport Beach and Huntiqton &e.cb firet:iahten spent nearly an hour in stiffing midday beat contrOlJina the blaze. Luckily, none were injured. They even ~ to aaft tbe family dog from the 1mob-filled cdndo unit (tbe family wa not at home at tbe time). But, the potential for injury or death wa cerWnly there, banging in the air with the acrid smoke, u the blue conaumed the residence and licked tbreateniqly at neighboring units. The real· shame of this is that the fll'C, like moat fuewort-related mishaps, wu apparently 111oci•ted with juveniles. They get their bands on illegal fireworks -perhaps from their parents, perhaps from a friend who got them from bis or her parents -intending to just have some fun, to play, and the next thing they know, they've burned a house down or injured themselves or someone else. It is something that can scar a child emotionally, if not physically. We hope that the younpten who started Sunday's fire are caught -so that the parents can be held financially liable for the damage and we can write about that and hopefully make all parents more careful next year. Certainly, the fireworks shows and aerial displays staged by professional pyrotecbniciana are safe and breathtakingly beautiful and deserve to be continued. But, when will we ever be rid of M-IOa and their destructive cousins that e.ch year came such destruction md, too often, injury or eYeD death? Letters to the Editor No tHanks for Felton Dear Mltor: wrbank you" to Jim Felton? Never! Too many of us who really love Newport Beach con- sider Mr. Felton a symbol of what is wron1 with our city. Goldie Joseph, however, praises him (Newport buign, June 30). She UICI this as an excuse for again attacking those of us who want some sort of good planning to protect a city that is as unique and beautiful as most any in the world. Ma. Joseph, who is an advo- cate of off-shore drilling as well as total growth, says we who want aood planning do so became we want to keep out otben to increue our own home values. This is, without a doubt, the IDOlt ablurd notion in tbe history of those who exploit, carve up and aenerally despoil every square inch-of this city for nothina, I repeat nothinf, but their own profit. Mr. Felton, on tbe other band, attends meetinp of a local group who support all out growth in Newport Beach. Our ex-mayor, Don Mcinnis, also attends tbae meetinp. They spend much of tbae meetinp m•kina fun, in coane remarb, of tbOIC of us who ue tryina to love a city that is speedina towards being another Marina del Rey ud Miami 8eacb tombined. ·: It is also a fact that neither Mr. Felton or Mr. Mcinnis live in Newport Beach. Tbe vision of them on tbe freeway driviq in from their boma to come blict to help all-out arowth is truly incredible. I wonder why they no lon1er live here? Too much traff'1e? Too much air pollution? Or wu that offer on your home too hip to resist? Some of ua are atill livina in Newport tryiq to protect the quality of life for all who live and visit here. He was told that he would have $90,000 taxable income from the sale of his current residence. We checked itoutwithourtaxaccountant, and he pointed out that our client's trust officer had failed to take into consideration the cost of his replacement home. The amount of this sale also reduces the taxable profits from the sale of his first home. As it turned out, our seller had no taxable consequence from selling his home. The musicians fought val- iantly with the leu;tban-ideal outside acoustics. The dilcern- ing direction of conductor/ composer Morton Gould smoothly compensated for the erratic sound system that occasionally amplified the sub- tleties of the string scctiona being overwhelmed by over-amplified brass and percussion settions. The outside setting proved ideal for performances of a rousing "Star Spangled Banner" and "Ives," alternately solemn and invigorating orchestrated variations on "America," which was originally arranged for organ by William Schuman. Gould was particularly ani- mated during the orchestra's fine performance of his .. Declaration Suite," composed for Dwight Eisenhower's presidential inau- guration, eliciting poignant clar- ity of orchestra bells during the Liberty Bell passacaglia. Distant horns and distinct recurring galloping accents gave the Mid- night Ride Scherzo an important urgency. The evening's best recognized offerings, traditional audience pleasers, suffered awkward but not fatal influences from the amphitheatre's amplifications system. During a symphonic medley of Leonard Bernstein's "West Sid Story," the orchestra deftly delivered the familiar finger- snapping jazz syncopations and ~ specific percussions of "Cool" and "America," but the subtle effects of the waltz rhythms of "Somewhere" and "Tonight" were blurred by the electronic amplification to rear seats. Aaron Copland's suite from "Billy the Kid" was delivered with a scme of purpose that accented the strident running gun battle and celebration on Billy's capture, and required more attention to the intricate a.nd subtle string .compositions during less lively sections. George Gershwin's popular "An American in Paris, 0 although thoroughly enjoyable, would have fared better with a livelier tempo to contrast the precise jazz rhythms with the balletic movement$. Brus and wind performen, particularly of clarinets and tubas, offered excellent solos. Jazz pianists featured From two different lands, two of the world's top jazz pianists, Keiko Matsui and David Benoit, will perform at the Orange County Performing Arts Center on Sunday, July 17, at 8 p.m. Both artists have scaled Bi/1- board 's contemporary jazz charts in recent months with their energetic, expressive mus- ical styles. Matsui melds flavon of her native Japan with the foot-tapping tempo of American contemporary jazz; Benoit, of Southern Calif omia, backs the lush melodies that flow from his acoustic piano with hot horns and sassy atrinp. Benoit'• latest releale, •Every Step of the Way," continues in the same eleaant and richly lyrical vein that be captured in such previous bit releases as wrhis Side Up" and .. Freedom At Midnight" (1987). The new album ha been aamerin& praise from critics, and prompted the Wa.shini'lon TimeJ to call him ... he fmat jazz pianist in our country today ... The man is fabulous." Benoit first teated his creative talents as a composer while in high school, writing an original music score for the drama club's presentation of "Tom Jones." It turned out to be the catalyst that launched his musicaJ career. After studying composition and piano at El Camino College, he got bis fmt big break in 1975 whed' be met composer Richard Baskin and was invited to play on the soundtrack to Robert Altman 's film "Nashville." He accompanied singer Gloria Lynn at leading Los Angeles clubs, where Benoit developed a strong reputation in jazz circles and quickly became a fint~ studio musician for such artists as Kenny Rankin, Patty Austin and Barry Manilow. While working as a conductor and arranger for such Las Vegas acts as Lainie Kazan and Connie Stevens, Benoit began devleop. ing his own material and was finally penuaded by friends to record some demonstration tapes. Benoit's audience grew quickly when be releued "This Side Up" in 1985 and the album scaled the jazz charts. "It really surprised me," says Benoit. ..I had just hoped it would get on the Biiiboard charts. I was in Japan when it hit the top five, and I just couldn't believe it. It was a wonderful feeling." Keiko Matsui's following bas also been growing rapidly since the release of her fint solo album, "A Drop Of Water" (1987), which earned a berth in the top 20 on the Billboard contemporary jazz chart. This solo release follows her success as a member of Cosmos, a popular Japanese fusion group that performed over 100 con- certs and recorded four albums, in twoyean. An exceptional talent, Matsui began her musical trainina at the age of four and was soon writing her flnt compositions. At 18, as the top player at the renowned Yamaha Music School in Japan, she wu selected by Yamaha to score the original soundtrack of a major Japanese motion pic- ture. A year later, Matsui made her first trip to the U nitcd States to record a sampler album for Y amaba which features several of her own jazz fusion compo- sitions. 1 Now 26, Matsui has earned accolades from critics who wonder at the remarkable energy and irresistable passion that erupts from the keyboards of this petite. soft-spoken prodigy during her concerts. BY CHERYL STEHU.NG As children, many of us dreamed of having a treehouse, our own private hideaway from the rest of the world. That dream can be realized right in the heart of Newport Beach, where a woodland fantasy awaits a potential buyer. Located at 2209 Cliff Drive, this week's featured home truly makes the most of its cliffside lot, using every bit of space in a unique and creative way. The home has a separate guest house with kitchen, a disco with at- tached grotto leading to the pool and spa, two master bedrooms, one with a fireplace, mirrored walls, beautiful landscapin~ on a large lot, a security system. Rnd the home is ready for me ve-in. The contemporary dec<'r will allow for any kind of furniture as owner desires. "The view is unsurpassed, the size of the home ia great and the price is right," said Kay Polorina with Waterfront Homes, listing agent for the home. "The home bas it all: location, spacious rooms and a one-of-a-kind three-story design." TREMENDOUS TREEHOUSE It might be unlikely that a home of this type could be found anywhere else in Newport Beach. This home would blend in well in the mountains or even Laguna, where homes built on the side of hills express creativity in design. Guests driving up to the front of the home for the first time will sec wood shingles, green awnings and a pebbled driveway leading to the double garage. But once they walk through the double doors with their beveled leaded glass, the magic begins. Beyond the hall and entry to the guest house, they will look onto walkways f aahioned out of rail- road ties, a rolling grwn lawn with a myriad of trees, shrubs and colorful flowers, to the main house. It is an awesome sight as even the sounds and smells bring to mind a forest. But the gucat houae warrants a tour f~t. Guesu walk into the small living room with its berber carpet and a mirrored wall. A slidina glau door opens onto a private balcony, which loob out onto the ..,orat." In one corner of the liviq room ia a little round fireplace. In the back ia a kitchenette, with a four-burner electric ranae top, accessible by lifting up a hinged portion of the counter. There is a single stain- lcsa steel sink and a small ref rig- erator. The room may not be large, but the storage cabinets are ample. Next to the kitchen is the bathroom, which includes the amenity of an oversized glassed- in, tiled tub/ shower. From the living room, a nar- row staircase leads up to a spacious bedroom loft, with sunny windows and an ample closet. SPACIOUS, QUALITY THROUGHOUT Guests proceed down a walk- way toward the main house's door, which has a gorgeous stained glass window. The entry ball has a mirrored wall and ceramic tile floors. To the left of the entry is the guest bath, with a sunken, tiled tub/shower. The toilet and sink are a choc- olate color, which blend with the tile's color and the laminate countertop on the wood pull- man. The sink is accented with brass and porcelain fixtures. Beyond the entry ball is more diversity. Guests walk into a large, open area, surrounded by 1rindows, sliding doors, mirrors and wood beam ceilings. The two rooms are so versatile, either one could be a formal dining room or formal living room. The first room has a mirrored stair- case up to the third level, a slidina glass door to a patio/ balcony, track lighting and a natural wood bar that separates the kitchen. Curving steps lead to the second room. Beyond is an octa.gon window which Joo~ into a solarium room. Both rooms afford a panoramic and sweeping view of the bay and derive the benefit of a stone Oow- through fireplace. The galley-like kitchen is to the rear of the two rooms. It is compact, but practical. Natural varnished wood is used on the cabinets and floor. The counten are topped with cboppi.-1 blocb. Track liabtina is let into the ceiliq and indirect liabtina is\affixed into a aoffit surround· inl tbe perimeter of the room. A ltritina feature is one wall of stone into wbida ii let a peea-· bOUle window, overlootina tbe interior wooded area. Other highlights of the kitchen is the stainless steel sink, NuTone Center and the refrigerator with ice maker. Another staircase is to the side' of the kitchen. THIRD LEVEL The third level contains three bedrooms which abaR a bath. The landing at the top of the stairs bas a skylight. Two of the rooms have a bay view, the third overlooks the interior yard. All have ample closet space. One room has a brick fireplace and wraparound windows. The bathroom has a · comer stall ·shower, and brown tile is used throughout. It is accessible from the two front bedrooms. GROUND FLOOR·GROTTO To tbe right of the main level entry hall is the staircase going down to the ground Boor. A master bedroom and bath and an ultimate room for entertain- ing reside OD this level. An ante-room has a sp.cious under~tair closet and-entry to the bedroom and bath. Half of the bedroom is a solarium room. One wall has deep closets with' slidina mirrored doon. The sun can be screened out by clrawiq the Roman shades. There is a private entry from the outside. The ~ is spectacular. The muter bath ha a cav6r-~ adus brown tile step-do~ shower stall. The pullman ii surrounded by Hollywood va. ity Jiabta and topped with mar· ble. Double doors lead to another room and the disco beyond. Another bath bas the same Hollywood vanity liahti, marble counter and the bonus is a huge walk-in cloeet. The. larae open room is ideal for entertaining. Guests walk over to the liabted wood dance floor, which ii let into a atone grotto, complete with colored lights, and a mir- rored ball casts sparklei all around. Off to one side is a separate sound and equipment booth for a D.J. Another special touch is the waterfall, and guests walk over a bridge of plexiglass and step down through a door to the pool area. 1be spa ia inside and floW. through to the beart- ahaped pool outside. The pool is also accessible through a gate outlide. REALTOR INFORMATION AND FINANCIAL FACTS The home is listed at S79S,OOO and is offered by Kay Polovina of Waterfront Homes, Inc. But when she went into real estate eight years ago, she quickly learned that her poten- tial would lead to greater things. In fact, she was Select's top producer in 1986, 1987 and is heading in that direction for 1988. Parker is modest about her accomplishments. "l got there by working hard,'"' she said. Before she joined the ranks of the realtors, Parker was married and raising her daughters. After a divorce, she decided real estate would be one job that would help to support the family. She started out with Coldwell Banker-Costa Mesa and after six months, joined Select. "It was called .Select Proper- ties then," she said. Getting into real estate when she did, Parker recalled the extremely high interest rates of 20 percent. "My fmt home was a V.A. sale and I sold it at 12 percent," she remembered. "It closed 60 days later at 14 percent. This was back in the days of lcreative financing.• " She explained that in today's market, creative financing would not necessarily work. But in the early 1980s every agent would have to know creative financing or not be considered a good agent, Parker said. Parker believes that honesty and integrity arc two important maxims to work by. For her, it. has paid off in many referral clients. "You have to be honest and truthful, and I wouldn't sell someone a property that I wouldn't live in myself," she said. "I assess location and the client's income." Parker said that in today's market homes sell quickly, because of low inventory. She recalled that a f cw ycan ago, there were many homes for sale and no buyers. Now it is the other way around. "The younger people want to buy because the interest rates arc down and the payments would be the same as a rent payment," she said. "But there just isn't enough out there for sale." when Park.er is not working, chances are she could be seen with the many friends she has made through her job. She said P-•COUl't their idea of a good time ii to go throup open hoUICI. But she also enjoys traveling and is planning a cruise and trip to Mexico in the future. Record amounts spent ·on home improvement Whether it's called "cocoon- ing," "nesting," or simply pro- tecting an important investment, Americans are spending record amounts of money to remodel and improve their homes and properties. According to a recent study sponsored by Better Homes and Gardens Real Estate Service, owners of America's nearly 100 million residential dwelling units spent $11 .2 billion more last year than they did the previous year to make sure their homes were more livable or reflected more of their own personal sense of lif estylc. This nationwide interest in turning a house into a home is reflected in remodeling, improvement, and repair expen- ditures-including major addi- tions-that current figures indi- cate have now topped $91 billion in annual costs and represent the f astcst growing component of housing investment in the Unit- ed States. "Since 1982, the annual remodeling and improvement expenditures in housing have increased by more than $40 billion and now account for an amazing 43 percent of the total housing investment," said Peter Viotta, president of Select/ Better Homes and Gardens in Costa Mesa. According to the study, higher levels of improvement and remodeling arc related to increases in the sales of new and existing homes. Following what the survey offered as a typical scenario, Viotto said, "A buyer moves into a home, determines what improvements might be desired, and otherwise custom- izes the home to suit his or her own tastes and preferences. It's becoming the great American pastime." The survey also off ercd a demographic line of reasoning to explain the record spending, said Viotto. "The aging of the baby boom households into a more family-oriented phase of the life cycle will stimulate increased expenditures on housing-related issues. Some of the baby boom- ers wil expand their housing consumption by moving. Others will ~trade-up-in-place,' that is to expand, alter, or otherwise improve their existing home to meet their changing needs." Added to the money spent by homeowners, owners of rental property have more than doubled their expenditures on ·remodeling and renovation from 1982 to 1986. Buy sturdier gates made of plastic or solid wood frame models that are strung with polyethylene mah to provide a more effective barrier. l'.ledrlt n..... BY GERRY A CHRISTA LONG Recent changes in tax laws have not changed two of the most important advantages available to homeowners who might be planning to sell. I) The Two-Year Rllle Def- erment of gain (Available to home sellers of all ages) Deferment (or rollover) of gain in exchange of residence. A property used by the taxpayer as his principal residence is sold, and a new property is purchased within TWO YEARS. The latter property must also 'JC the prin- cipal place of reside·.ice. The two years is determined by the date of occupancy, not the date of close of escrow. If the purchase price of the new home is as great or greater than the adjusted sales price (sales price minus selling costs) of the old residence, no gain is recognized on the sale; that is, no federal taxes arc due on the profit earned on the sale of the home. , On the other hand, if the new residence costs less than the adjusted sales price of the old residence, gain is recognized to the extent of the difference, and is taxable. The new residence may be purchased two years after the sale, or two years before the sale. By taking advantage of this .,.. "rollover" opportunity on a number of residences, a taxpayer may conceivably defer tax lia- bility on the gain until be reaches age SS, at which time he may qualify for the Sl2S,MI Lifetime Exclusion. Equal Professional Service NEWPORT HARBOR COSTA MESA BOARD OF REALTORS CALIFORNIA ASSOCIATION OF REALTORS 401 No. Newport Blvd. Newport Beech 12113 @r 2) Tiie 1125,IM Lifetime [sd•Oll (SS or older) The Internal Revenue Code provides a oncc-i.n-a-lif etime tax exclusion to seUen who are at least SS years of age and have: I) owned their home for at least five yean, and 2) occupied their property as principal residence for any three of the last five years preceding the sale. Spouses filing joint returns may exclude the entire S12S,OOO. On separate returns each spome is entitled to one half of the Sl2S,OOO or $62,SOO. Taxpayer must be SS yean of age at close of escrow on the sale of his residence. Only one spouse needs to be SS years of age. CHRISTA & GERRY LONG A spouse may not usc the exclusion, then divorce and usc it again in another marriage. In fact, if either spouse remarries, having used the exclusion in a previous marriage, neither spouse of the new marriage would be eligible for the exclu- sion. The retired taxpayer could also make good use of the once- i n-a-lif ct i me deferment to exchange his or her residence for a combination residence/ income-producing duplex or other multiple unit building. Amount of the building consi- dered residence is determined by the amount of square footage occupied by the owner relative to the total square footage. It is important to be in touch with a tax expert before entering into a sale of one's principal residence. 'M'RE FG4TN; Fa? ~LfE Am1l1ca11He:sl.
