Killelea was killed last Thursday evening when she was struck by a car driven by an alleged drunk driver and flew SO feet. She died in surgery hours later. However, her two sons, who were walking with her near their home on East Ocean Boulevard, were not injured. Killelea was part of the SOO-member Balboa Peninsula Point Homeowners Association who has been lobbying the city to install devices to slow down speeding motorists. Dayna Pettit, who beads the group, said she plans to fight harder to have stop signs and speed bumps instaHed especially in the wake of Killelea 's death. BY MELINDA KELLER An Orange resident remained in critical condition Tuesday after being shot by a Newport Beach police officer Saturday night in what appears to be a case of mistaken ~dentity. Sundaga Bryant, 26, was shot at 2:50 a.m. near the Balboa Pier after police mistook him for a suspect wielding a gun, said Newport Beach police spo- kesperson Bob Oakley. Oakley said the incident began earlier when the unidentified officers received reports of a Hispanic man in his 20s carrying a sawed-off shotgun on the ~each. When the officers-spotted Bryant~ who is black, and his wife near the water, they approached the couple and ordered Bryant, who was standing up, to .. freeze and drop it. .. Flames shot through the roof at 2900 Newport Boulevard at 12:39 a.m. as 17 firefighters battled the fire for five minutes before it was contained, said Newport Beach Fire Department spo- kesperson Bonnie Hanson. · .. Arson investigators are still looking into the matter and a cause for the fire bas not yet been determined," Hanson said. Sometime today the gingerbread man from each classroom will "run, run, run just as fast as he can" and hide in a very special place until he is "discovered" at the end of the week. All week the teaching of small and large motor skills will center around finding him. Stories will be read and songs will be sung about him. The whole facility will ring with glee tomorrow when he is "found," and special memories will be created for mom and their little ones. Chris Keena, speaking on behalf of his clicnfs wife, Marlene, gave a somewhat different account of the shooting. .. Mrs. Bryant said that the officers never identified them- selves as police although she bad seen three men coming towards them with flashlights and assumed they were police. "When the officer told her husband to freeze, he had been standing up getting something from the cooler, and spun around out of surprise. said, 'What?'. and was shot," Keena said. When Bryanfs wife attempted to lift her husband's bead out of the. sand, she was handcuffed and told by the officer to "stay away from him. he bas a gun." according to Keena. When the officer turned Bry- ant over, using his foot, and discQvercd the weapon was in fact a radio, he allegedly kept the wounded man's wife in handcuffs anyway. .. About that time, Marlene said she heard over the officer's radio that the suspect with the gun had been apprehended but they still would not take the cuffs off, .. Keena said. The .. suspect" turned out to be a 14-year-old boy carrying a pellet paint gun, often used in simulated war games. The boy was questioned and released to the custody of his parents, Oakley said. But not before Bryant allegedly beard an officer rebuke the youth after he asked about the wounded man's condition. .. She beard the officer say to the boy. 'Haven't you caused enough trouble? Look whal you made me do'." Keena said. Bryant was tann to Fountain Valley Regional Hospital Trauma Center where he under- went surgery for the wounds he sustained to bis arms, colon and intestines, Keena said. The prognosis for Bryant's lcf t arm is reportedly not good. Bryant has also lost part of his colon and intestines~ Keena said. "'He is in critical condition and is conscious right now. He is · depressed and is slowly reafu.ing. what has happened to him," Keena said. The El Toro attorney plans on pursuing court action to get compenbtion for Bryant and is heading up bis own investigation into the accident. Keena, who also serves on the Missio11 Viejo City Council. said he is aware of the responsibility and limitations of municipalities to victims, but believes Bryant should definitely be compen- sated. At the request of the Newport Beach Police Department~ an ongoing investigation by the Orange County District Attor- ney's office is underway, Oakley said. First and foremost, a word of caution to all drivers: There are a lot of kids out there now. Please, please, please drive extra carefully in the morning and afternoon hours when the students are going to and fro·m school. Second, a word of caution to all students: Watch out; not every driver is going to heed our first point. Be sure and look every which way before crossing the street, even if there's a marked crosswalk. · Third, we are reminded what a great and remarkable country we are living in, where every child has access · to a free education that is also a good education. Unfortunately, that observation is probably lost on the vast majority of students, who too often see school as either something of a prison or as a something of a social event without the music. Either way, we're afraid many students are letting~ golden opportunity pass them by. School is what you make of it. If you sec it as a prison, you1l be gone at age 16. And 10 years later, if you have any ambition at all, you it be back -taking night courses to get a GED, having wasted some potentially productive years. That's not a threat, that's just the way it is. If you can't get past the social scene, you 're also wasting a lot of time and will probably have a lot of ground to make up when you go on to college -again assuming you have some ambition beyond dishing out burgers and/ or making babies. It is of course true that school has some prison-like aspects: there's a lot of regimentation, you 're required to be certain places at certain times, procedures sometimes are treated as more important than results. And the social ·scene is a predominant feature of the environment and an integral part of the school expenence. However, there is treasure buried beneath these superficial trappings. That treasure is knowledge and it's there for the taking. Not every teacher, not every subject, not every assignment is exciting or interesting or even worthwhile. But, that shouldn't lead you to the point of view that none of them are. Don't box yourself into an attitude· that precludes the excitement and wonder of learning new and interesting things. · They are there. You don' have to look very hard. We guessed there might be a couple of dozen or. so, but when we arrived at the Red Lion Inn on Bristol Street, we bcCarne part of a crowd of nearly 1,000 people who enjoy travel, and most of them had their check- books in their hands. The gathering was sponsored by Grand Circle Travel, the world's largest travel packager, devoted.exclusively to people SO years or older. You can' imagine the mountains of Danish pas- tries and the many pots of coffee that greeted all us mature trav- elers. When the appointed hour arrived, the ballroom was full, which must have delighted Arthur Pollack, vice president of Grand Circle, headquartered in Boston. He was in charge of the get-together, and he gave the impression that he wu enjoying every minute of it. When you listen to Art Pol· lack, you become convinced that Grand Circle knows the travel business like· nobody else, but more important, they know their customers-us old fogies who want to see more of the world than the Orange County fOUth coast. But even with that advantage it was not an easy road, because we came from a time and an area with no classical music life in the community. The Sea Kings will be defend- ing their 1987 CIF champion- ship without the talents of goalie Jim Wagner (Most Valuable Player of the CIF in 1987) and Chip Blanken horn (named to I st team all-Cl F in 1987), and Derek Dundas, as they gradu- ated last spring. Cd M Coach John Vargas doesn't like to make predictions about the chances of his 1988 squad repeating as Cl F cham- pions. This season, the Sea Kings have only two starters from last year's team, Chris Oeding (wRI was named to I st team all-Cl F in 1987), and Hagen Grantham (named to 2nd team all-CIF last season). In total, Cd M lost five key starters from last year's title team and two players off the bench to graduation. Inexperience characterizes this year's squad as Vargas has brought up players off the junior varsity and frosh/ soph teams to fill the spots. Many of the players lack varsity experience. .. These guys need to .play together more and then we11 sec if they mesh as a team,,. Vargas added. "Ocding and Grantham arc terrific players but they are only as good as the rest of the team. It doesn't matter how well they play if there is not six or seven players to help out." Vargas continued. Still, CdM has several young promising players on this sea- son 's varsity squad which includes goalie Craig Rhodes and Gunnar Gustafson. "Craig is a very good goalie. He's getting better each time be plays." Other potential starters on the team include sepior Scott Houston, senior Josh Speyers, PIOTO IY DOIY COTA junior Brandon Howalb, senior Colin Young, junior Conrad Maceado, junior Robert Gray, and senior David Marsh. .. One good thing about this year is that I'm going to have a great bench. This team should have a lot of depth,., Vargas stressed. The Sea Kings' team is solid defensively according to Vargas. "We're fine in our defensive positions. We work. on it a lot in practice." Oeding and. Grantham should be Cd M's primary scorers on l 988's team. But Vargas also plans to spread out CdM's offensive attack this year. "Usually, I rely on a few guys to score. But on this team I have four or five players who· can score a lot of goals. That makes it tougher for teams to stop us, .. Vargas continued. Grantham commented about this year's team," It's true we don' have as much talent as last year but I believe we i1 develop as a team." "We haven't been playing together for that long as a team. Last year's team played together for three years. There is going to much more dependency on us (Grantham and Ocding) this season. We need to set an exam- ple for the younger players on the team," Grantham added. Oeding agreed. ··w e have no real standouts on our team, so we11 need to help each other out. These guys have the talent, though,., Oeding said. Vargas expects Harbor High, University and Tustin to give CdM tough matches in this year's Sea View League action. "I have~ 't seen Estancia. Harbor to start season without , Barnett BY GEORGE PAPPAS When Newport Harbor High's water polo squad starts their season in two weeks, they will be missing their head coach Bill Barnett. Barnett will be on the other side of th world coaching the U.S. Olympic Wate~ Polo squad in Seoul, Korea. Barnett will miss Harbor's prescason but should be back for the Sailors' opening league game against Saddleback on Oct. 5. Barnett's absence has Har- bor's assistant coach Dean Crow with an opportunity to tempor- arily step into the Sailors' head co~h position. Harbor's wat~r polo program is not new to Crow, who has played under Barnett for four years ( 1980-84) and has served as Harbor's assistant varsity coach for three years. .. I've been "t>asically running Barnett's program since July. Everything I really know about water polo I learned from Bar- nett. My entire game sense and philosophy stems from my play- ing under him for four years," Crow added. Harbor·is aiming to repeat as Sea View League champions. But the Sailors will have do it without the help of last year's , standouts, Todd St.Sure, and Robert Gifford. BOSIUN Gov. Michael S. Dukakis of Muaacbusetts, the Democratic presidential nominee, stated bis vision of an America f rce of any problems, with "everything aff ordabte for all," but he has refused to say bow he would raise the hundreds of billions of dollaF&-DCCCssary to pay for it. He is "avoiding the Mondale mistake" by refusing to mention the Wf"' word-that he will have to raise taxes substantially to support these programs. Dukak.is' themes are "good jobs at good wages" and .. fiscal responsibility." But actions speak louder than words, even unspoken ones. His Massachu- setts record on jobs, taxes and debt is horrendous-closer to a mess than a miracle, Dukakis first became gover- nor of Massachusetts in 1975. In 1974-75, the national recession following the Arab oil embargo of 1973-74 brought Massa chusetts unemployment to its highest level since the Great Depression. I am not blaming Dukakis for this unemployment. The economic performance of any state is primarily determined by national and international economic conditions, not by events indigenous to that state. (Nobody blames the governors of the Oil Patch states for the depressed oil market and their concomitant economic prob- lems.) Although Dukakis bad pledged during bis campaign not to raise taxes, when he became governor in 1975, his first sig- nificant move was to break that promise. He raised virtually every form of tax imposed by Massachusetts. The sales tax was increased to S% from 3%, a 7.5% surtax was applied to personal income and a 10% surtax placed on corpo- rate income taxes, the gasoline and cigarette taxes were increased substantially, and taxes were raised on beer, wine and other alcoholic beverages. The adverse business climate in Massachusetts, which existed before Dukalcis became gover- nor, combined with the national economic downturn and the widespread tax increases he instituted in his first term, became the nails in the state economy's coffin. Notwith standing a well-educated popu- lace and other natural advan- tages, Massachusetts became known as "Taxachusetts . ., lts taxes rose from 29% more than the average state to 44% more.· Dukakis was unseated in the Democratic gubernatorial pri- mary in 1978 by Edward J . King, who ran on a platform of low- ering taxes and restoring a favorable business climate in Massachusetts. This was virtu- ally unprecedented for Massa- chusetts, given its long tradition of support for liberal Demo- cratic politicians and initiatives. Thi Democratic state govern- ment uneter Gov. While King deserves most of the credit for the turnaround in the state's economy, he had the misfortune of facing re-election in 1982, when the national economy was in a serious reces- sion. The recession was a result of the Federal Reserve's disin- flation policy, a by product of the acceleration of inflation during President Jimmy Carter's years in the White House. Dulcakis defeated Kin in the Democratic primary of 1982 and went on to beat the Republican nominee. Then, as now, he carefully avoided any discussion of taxes and promised to be more attentive to the needs of the business community. He returned to office in 1983 at a time the national economic recovery-his opposition to the Reagan-Bush AdministratiOn But What about tbe jobl there. especially good jobs and good wages? From June, 1984, to Ja-.uary, 1988, Massachusetts lost 91,400 manufacturing jobs-a 13.4% loss. With only 3.% of the national job base. In other words. more than 90% of the improvement relative to the national average occurred in the four years that Dukakis was out of office, while less than 10% occurred in the nine years that he has been governor. Further, this low unemployment is brought about partly by the exceedingly low r.atc of popula- tion growth, reflecting low birth ra~es and emigration from the state. With the state's labor force growing so slowly. it is much easier to have low unemploy- ment than it is in a state like California with a high popula- tion growth rate and inunigra- tion swelling the labor force. What about the rate of job creation? I have already alluc,1ed to ·the loss of manufacturing jobs. In total employment growth. Massachusetts ranks 40th among the SO states. If the man who wants to do for the nation what he did for Massachusetts had been doing o for the past five years. there would be 2 million ft'wt'r work- ina Americans! But Dukakis did not stop there. He also borrowed like mad outside the operating budget. doubling the Massachu- setts debt. adding more debt than all Massachusetts gover- nors combined since John \V in- throp in 1630. Dukakis's personal frugality i well known. but he does not seem to pursue the same frugality with the taxpayer's money. To run as a fiscally responsible candidate on this record is a bit like the late Egyptian President Nasser losing the 1956 "ar with Israel and then crossing back across the Suez Canal to hold a victory parade in Cairo. With growth, inevitably, come growing pains. Many residents who remember Newport Beach as a sleepy little fishing village are deeply disap- pointed to see bumper-to- bumper traffic on Coast High- way, and to see highrise business centers where they remember peaceful pastures with cattle grazing. But time goes on. Many peo- ple are "discovering .. Newport Beach now just as longtime residents did 20 or 30 years ago. Do we have a right to "keep them out"? Should we encourage growth? Does it make our homes more valuable? Should we dis- courage development? Should This code cnab~ra ounty and cities ·Ac te> c develop- ment fees (roml>uilders and developers as a condition of granting subdivision map appro- vals and building permits. S uch fees were earmarked for the construction of major thorough- fares and bridge programs. Orange County began collect- ing such fees in November of 1984, and in 198S the city of Irvine diid likewise. A citizen group called the "Committee of Seven Thousand" or COST was formed in mid-1984. The com- mittee attempted to prohibit the city of Irvine from implementing such development fees for the financing of three new highways. Instead the committee sought to approve such highway construc- tion only by passage of a ballot measure by Irvine voters. !". • we control it? What is acceptable Some Irvine voters, in July J98S, sought a writ of mandate to prohibit COST from placing such an initiative o n the city ballot. They maintained that such an anti-growth initiative was in conflict with Govt. Code #6684.3. The Superior Court granted the writ. The initiative was not placed on the ballot. The Court of Appeals confirmed. COST appealed to the Califor- nia Supreme Court. control? Acceptable to whom? Throughout the past few years, local citizens have asked themselves these questions. An interesting court case settled some aspects of growth. It also addressed the ability 01· local citizens to control growth, par- ticularly where the construction of new highways is concerned. Four years ago. Orange County voters voted down a 1 percent sales tax increase which was to pay for new highways in San Joaquin Hills, Eastern and Foothill corridors. At that same time, Government Code #66484.3 was enacted by the CHRISTA& GERRY LONG By an overwhelming majority (6-1), the California Supreme Court affirmed the decision of the lower court. The court ruled the COST initiative invalid because of its conflict with the Govt. Code. In its explanation. the Supreme Court said that this was a statewide rather than a local issue and that the State statue must prevail over city initative.
