Allegations of misconduct against
Harbor M unicipal Court J udge Calvin
P. Schmidt are being investigated by
the California Commission on Judicial
Performance.

Frankel said last week that Newport
Beach reside nt Schmidt is the subject ·,
of commission proceedings but declined
to elaborate on any specific investiga-
tion.
"'Commission proceedings are confi-
dential by law but a sh o rt
announcement when the subject matter
is generally known to the public is
permitted ... Frankel said .
Ouring the past few months. it has
been wide!~ reported in the media that
Schmidt. who recently celebrated hi.
59th birthday. and colleague. Harbor
Municipal Court Judge Brian R .
Carter, are being investigated fo r
allegedly favoring fnends in the cour-
troom and trading favors for sex.
Schmidt denied all the reported
a llegations last week and said he
welcomed the investigation.

shapes and sizes. Even the kids
at Marion Parsons Special Edu-
cation Center. a Newport-Mesa
district school for the physically
and developmentally handi-
capped. are unabashed when the
jolly fat man swings precario usly
down a ro pe ladder from a
helicopter. M ost of these young
people will ne\er full~ under-
stand the special gift last Wed-
nesda~ ~s .. Santa" brought. But
most will use it frequently and
trul ~ appreciate 1t as it trans-
ports them to sho pping. bowling
and local par~s for picnics at
leau one~ each week. OOrcr
excursions they will take will
include the Special Olympics
Parade and an annual visit to
exchange friendships with young
people at Canyon Hills Special

veterans with holiday acts and
distribute gifts that their class-
mates have donated.

This year 40 students per-
formed in a variety of 15 acts,
and 35 more students hitched a
ride on Santa's sleigh. NMUSD
bus, to chat with the vets and
distribute gifts and the goodwill
that comes so easily with youth.
According to Jim Roberts, par-
ent and frequent chairman of the
event and 10-year volunteer
musical accompanist. "This is a
really meaningful event..,
No one is sure who gets more
joy from this exchange, the
veterans or the students. Stu-
dents come back transformed,
seeing the infirmed, the elderly,
the incapacitated in a whole
different perspective than the
picture book one they are famil-
iar with. Sitting with an ampu-
tee, chatting and exchanging
jokes, can make a life-long
impression on a privileged,
healthy 12-year-old.
Last Wednesday, at 8:45 a.m.
in the Cd M parking lot, PT A
chairman of the event Janet Ray,
a committee of moms and a
whole bunch of kids packed up
van-loads of gifts, pre-wrapped
by another committee, to take
to Long Beach. The caravan set
off following the big yellow bus
at 9 a.m. and by 10 a .m. the stage
was set.
This year the acts included:
magician David Rafalovich;
comedians Brian Hafer, Adam
Greenfield and Schafi Siddiqoi;
soloist Shannon Joyce; jazz
dancers Erika Westberg and
Erica Y ankovits; comediennes
Amy Patterson and Evie King;
a comedy musical entourage by
Kellie King, Pooneh Bassirpou,
Jenny Real, Lisa Stuckes, Amy
Marino, Stephanie Yamaguchi,
Shannon W&ters and Nicole
Greeno; pianist Christine Win-
ton; orator, Brandon Lee; and
that crazy group of girls, my
daughter and her friends, a
singing and dancing quartet,
Dana Engstrom, Kristen Lof-
strom, Jessica Michalik and
Sloane Richardson.
All performed beautifully and
all were warmly received by the
40 men and women who were
their delighted audience.
Bonnie Engstrom is a member
of the Corona de/ Mar High
School PTA, the Harbor Coun-
cil PT A and serves as a chairman
on Fourth District PTA .

ment. Renley was chosen from
a sea of 81 applicants, whose
inquiries came from as far away
as Florida, New York and the
New England states.
The board made two other key
appointments in further action
last week.
Dr. Donald E. Price of
Oxnard, manager of the infor-
mation systems of the Ventura
Community College District,
was selected to be executive
director of information services
for the distnct. He will assume
duties on Jan. 17, administering
the district data services and
telecommunications units.

Man shot by intruder
A Newport Beach flight
instructor was shot with his own
gun Monday night when be
struggled with an armed intruder
at his 16th Street apartment.
David AJlan Kazeck, 36, was
transported to UCI Medical
Center where he underwent
surgery for a single gunshot to
his abdomen, and is in critical
but stable condition, said New-
port Beach Police spokesperson
Bob Oakley.
Kazeck was confronted by the
unidentified suspect at 8:50 p.m .
just outside his Oakwood apart-
ment and forced inside at knife-
poi nt. When the suspect
demanded money, Kazeck
attempted to arm himself with
a handgun and a struggle
ensued, Oakley said .
Kazeck was shot while he and
the suspect wrestled with the
gun. The sus~ct was gone when
police arrived at the scene. It is
not yet known if the victim knew
the suspect, Oakley said.
Karen Ann Klammer of La-
guna Beach, director of college
development at Golden West
College and executive director of
the foundation, was selected to
fill the position of director of
community and economic devel-
opment. She will take her posi-
t ion on Jan. 5 and will be
responsible for developing
working relationships among
businesses and public agencies
and the college distric t.

sion of land utilization options
at Orange Coast College. It was
recommended by Fernandez
that the district reject any bids
outstanding on the project.

Earlier this year, the district
had taken proposals from five
developers to build high-density
residential and commercial
buildings on 14.5 acres of college
land, Fryer said. She added that
the district wants to continue to
review its options and that
Fernandez believed no action

Animals as gifts
Christmas is a traditional time of giving, and while
many of the gifts under the tree will come from the
heart, others will come as a last minute whim. The nice
thing about nearly all of them, though, is if they aren't
right, they can, at least, be exchanged.
There is, however, one exception, one type of gift
that can't be simply taken back to the store without
sometimes devastating and always heart-rending
consequences.
Having an adorable little puppy or kitten unaer the
Christmas tree may create a special moment on
Christmas morning, and it might even look good on
videotape for the rest of the year. But dogs and cats
aren't toys that can be played with for a while then
placed on a shelf and forgotten.
Beyond the thrill of first seeing that sweet little animal
on Christmas morning is a lifetime of responsibility. As
hard a fact as it is , this is 'a responsibility often times
beyond the ability or desire of recipients to fulfill.
A sad reality of the holiday season is that many of
the kittens and puppies wearing bright red and green
bows under the tree in late December will find themselves
alone, forgotten, unloved and abandoned in a cage at
a shelter by February.
This is a problem that is easy to avoid. According
to the Los Angeles County Department of Animal Care,
people tend to return pets because the animal was too
big or too small, has the wrong disposition, was a cat
instead of a dog or vice versa, soon became ignored,
stressed, or wasn't obedience trained . Since these facts
exist, agencies suggest letting the recipient of a pet pick
it out themselves to avoid confusion, after first
determining that the people who are to receive and care
for the pet, particularly young children, understand the
responsibilites they are letting themselves in for.
Once the decision has been made to adopt a pet,
whether as a Christmas present or not, we suggest
checking out the various shelters rather than one-stop-
shopping at a pet store. The animals at the shelters,
many of which are strays, abandoned animals, or animals
returned by former owners, are in desperate need of
new , loving homes. And, according to shelter personnel,
mature animals will adjust quickly to a new hpme, will
be more receptive to training, will understand they've
been rescued and respond with a unique kind of love
and loyalty.
We applaud the action of the shelters and clinics, and
we urge people seeking new pets at Christmas to first
realize their responsibility toward them and then adopt
one from a shelter ..
A small and innocent life could weigh in the balance.

A tale of two centers
If you want to avoid the
crowds, do all your Christmas
shopping at Fashion Island in
Newport Center. Thcre~s hardly
anyone up there, except for the
shopkeepers and construction
workers, and you hear many
explanations for the stark empti-
ness in what used to be a bustling
happy place at Christmas.
Some blame it on the contin-
u ing reconstruction, the so-
called '"Renaissance" of Fashion
Island. Thia bas been going on
such a long--time. In fact, one
wag said that if the original
Renaissance in Italy had luted
this long, Savarnarola would
have died from old age, not from
hanging and burning.
Othen blame it on the dra-
matic up-scaling of all stores,
shops and merchandise, ever
since the J.C. Penney Company
wu kicked out of the Island and
its garage converted into Amen
Wardy'1 for the ultra-rich.

hours in South Coast Plaza, and
the comparison is friabteni.Da if

chant. There are great crowds,

It was so depressing.
The great courtyard in
Fashion Island is gone now, and
you sec the· promise of new
bastions of bautc couture shops
slicing at a rakish angle across
what used to be the court. So
a new place had to be found for
the Christmas tree-a 110-foot
giant from the Mt. Shasta arc~
a silver fir standing between The
Broadway and Al Douglas's
Garage. Herc, again, the
Fashion Island people were
we planned the annual Christ-
mas party for Avco employees
and their families, and we
bought more than SOO toys from
Karrs, who wrapped each one
and indicated whether they were
for a boy or a girl, and in what
age group. Then we took them
all to The Ncwportcr where
President Wally Merryman per-
sonally gave the toys out as
children's names were called.
Back in those days there were
crowds in Fuhion Island, and

terribly defensive, in a long red
poster that stated the tree was
destined for lumber before they
aavecl it for Fubion bland, and
after all, it made aood ccoloaical

Tithe to deregulate the ho~sing industry
The ''affordable" house in
Southern California is quickly
becoming a thing of the put, and
the future holds little hope of a
resurrection. While attempts
may be madl\o produce afford-
able homes by reducing amen-
ities or square footage, the
efforts are ultimately futile due
to a number of factors.
Tbe death knell for affordable
housing rans quietly about I 0
yean ago with the passaae of the
fmt growth~ntrol measures.
Instead of allowing supply and
demand to work, these measures
artificially control the granting
of building permits, thereby
restricting the supply of homes.
The result: fewer available
homes without a corresponding
reduction of those wishing to
buy, thus increased prices.
Many of the growth control
measures in effect today arc the
result of local governments and
citizens stepping in when the
state cut back its involvement in
the housing industry due, in
large part, to Proposition 13.
The result has been ovcrregula-
t ion in the form of tighter
controls and more restrictions.
The involvement of local
governments has been a reaction
to the problems population
growth creates in the area of
public facilities. such as water,
sewer, emergency response,
roads and schools.
To ensure that these ·services
arc maintained, governments
now assess numerous building
fees paid for by the developer
that increase home costs as much
as SI 5,000 per unit. Add to that
the soaring cost of land, which
in some areas has doubled in the
past two years. plus the costs of

CdM girls start slowly, lose four games

T om Duttine knew what he
was in for when he took as head
coa ch of Corona del Mar High's
basketball team recently.
F o r the past two seasons, <he
girls' team at Corona del Mar
hasn't won a league game.
Jn 1983, Coronadel Mar High
girls basketball team won the
C I F 4A championship.
But it is distant memory no w.
"We've had t wo poor sea-
sons," rem arked Duttine, who
has never coached girls bas ket-
ball at the prep level. Previously,
he coached girl s basketball at
Lincoln Junior High and sopho-
more football for a couple years
at CdM .
.. Whe n you come off a 0-10
season it's ha rd to keep enthu-
s iasm up. But we're hanging in
there . Things are going as good
a~ expected ~o far this season."
In ~ix games th is season,
Cd M \ record is 2-4 with one of
wim due to a forfeit.
However. intereM in the pro-
g ram is on the increase. D uttine
said 53 gi rls came o ut for bas-
ketball t ryouts before the start
of the season which contrasts
with 17 from last year.
.. I was s urprised we had that
many come o ut. I talked to a
lot of kid~ a bout the program
and d id a lot of recruiting. But
we have to compete with club
voll eyball and track a nd o ther
sports whi ch are more popul ar
at this school," Duttine com-
mented.
Obviously, 1988 will be a /
rebuilding year for CdM's pro-
gram.
"Our team has no depth or
height. We're young but we do
have some potential coming up, ..
Duttine admitted.
Cd M's team has back three
players from last year which
includes seniors guard Kellee
C ohen (5-9), guard Bonnie
Hagan (5-6), and forward Nicole
Basmaciyan (5-7).
"Cohen is our leading player
as point guard. She doesn't score
a lo t but she runs our offense,"
Duttine said. "She show a lot
poise and control on the court."
Other potential stando uts
among the younger players on
the team include sophomores
forward Denise Maho ney (5-10),
gua rd /fo rward Naok o
Yoshizawa (5-8), and forward
Ka thy D e mille (5-9), center
Connie La Pointe (5-7), and
junior guard Rory G reenfield (S-

But CdM's team lacks expe-
rie nced players coming off the
bench and their outside shooting
has also been woefully inade-
quate, Duttinc said .

Heck resigns, no replacement named

Wayne Heck, who coac hed

Harbor for the last six years,
resigned fro m h is position this
week.
Heck, who was a walk-on
coac h, sa id he resigned to spend
more time with his family and
business. He owns a Haagen-
Dazs ice cream sto re in Newport
Beach and has a I 5-month o ld
daughter a nd wife.
.. Having a 15-month o ld
daughtet changed my life," Heck
remarked . ... knew it would
before o ur daughter was born
and I was thinking of resigning
then but I was reluctant to. At
the same time, my busi ness has
expanded and it requires more
of my time."

Both teams are hungry for a
win followina dismal perf or-
mances in The Irvine World
News Tournament.
The edge in the showdown
would have to go to the Sea
Kinp. Cd M has a considerable
height advantage over the Mus-
tangs, who don't have anyone in
their starting line up over 6-0.
In addition, Cd M has a more
balanced offensive attack and
plays more consistent defense
than the Mustangs.
Cd M ( 4-2) needs a win after
their lackluster performance in
the Irvi ne tourney. For the
econd straight year, the Sea
Kings couldn't make it out of the
early rounds of the to urney.
Last year's team reached the
quarterfinals before they were
beaten, but I 988-89's squad
didn't even get that far.
Cd M was upset in their tour-
ney opener. They went on to win
the following consolation game
before failing to Long Beach
Wilson 67-52.
Two weeks ago, CdM bad
swept through their competilion
in the Laguna Beach Tourna-
ment, but it didn't prepare the
Sea Kings for the competition
they (aced in the Irvine tourney.
Cd M Coach Paul Orris attrib-
utes his team's recent struggles
to a overall lack of team play.
"'We're not playing very well
and we're not playing as a team,"
Orris expl~ined.
"We weren't patient on
offense and we didn't play good

the same organization that we
support and that supports us,
most of the year-almost put an
end to the Christmas Boat
Parade.
The investigation unit of the
U nitcd States Coast Guard
headquarters in Long Beach
used a broad based interpreta-
tion of a federal law which
basically made boating illegal.
Bizarre you say? Yes it is. Herc
is a condensed version of what
happened:
First and foremost, we all
want and demand safe boating.
To ensure safety, there arc
federal regulations overseeing
commercial vessels as well as
pleuure vessels. The problem
arose when the Coast Guard
defined all passengers as a
passenger for hire. If you own
or charter a boat and take your
f amity and friends out on the bay
during the Christmas Boat
Parade, that's ok-as long as
they:
I . Don't bring refreshments
(Could be a payoff!)
2. Arc not employees (Could
be payment for future work!)
3. Are not potential clients
(Might be payment for future
business!)
Unfortunately, that does not
leave much except taking the
dog for that bay cruise! Of
course, we all want safe boating.
However, when a law is carried
to unreuonable extremes, we,
the people, need to intervene.

happen? There's a national bat-
tle aoing OD between the Cout
Guard Certified V euel Associ-
ation and the bare boat charters.'
The bia companies run certified
vessels like the Hornblower, the
bare boats arc the pleasure
yachts like Mojo and B.P. John.
Which arc safer? Which would
we prefer in the parade? That's
up to you to decide. What we
do know is that here is a problem
that must be decided at the
federal level before next year's
parade or the Grinch will surf ace
once again.
On a more positive note: The
1988 Christmas Boat Parade is
a great success and as beautiful
as ever. Cbriltmu in Newport
just wouldn' be Christmu with-
out the parade. If you haven'
seen the parade, there arc only
two nights left. Don't min boats
like Bobby Cornelius' Christmas
of the Future. The magnif1cent
vessel bas Santa perched on a
huge 60-foot rocket ready for
take off complete with aftcr-
bumcn and flames that shoot
out of the end of the rocket (you
don' want to follow too close).
Other boats were decorated with
inflated bears, Santas, and even
the Grinch.
OCC to host Michigan this week
Coach Bo Schembechler and
the U nivc rsity of Michigan
Wo lverines will rent Orange
Coast College faci lities to pre-
pare for its Jan. 2, 1989 Rose
Bowl showdown with the Uni-
versity of Southern California.
The Wolverines (8-2-1) arrive
in Southern California on Dec.
26 and are expected to practice
at OCC's LeBard Stadium Dec.
27-31 and perhaps Jan. I as well,
according to J im Goodine, occ·s ~thletic facility coordina-
tor. The Michigan players and
staff are staying at The Ncwpor-
ter Resort in Newport Beach.
Many of the workouts, which
will be held in the mornings, will
be open to the public, Goodine
said.
The Wolverines will use the
LeBard Stadium field house,
practice field and weight room,
and the OCC athletic depart-
ment men's locker room.
In the past few years, the
University of Illinois and Ariz-
ona State University have used
OCC facilities to prepare for the
Rose Bowl. Last year, the Sun
Devils returned to OCC to get
ready for their win in the Free-
dom Bowl over Air Force.

Wolfe has signed a letter of
intent with Utah State and
offensive tackle Daryl Pcss ler
has made a written commitment
to the University of California
at Berkeley, becoming the first
two members of the 1988 Pirates
t o make a decision on where they
will continue their educations.
Wolfe, a first-team All-
Mission Conf crence player and
OCC's Defensive Back of the
Year, and Pessler, OCC's Offen-
sive Lineman of the Year, were
two-year starters.
Wolfe (6-0, 185), who prepped
at Edison High, led the Bucs in
interceptions in 1988 with 5,
including one return for a touch-
down in the season-opening
game against Rio Hondo. The
sophomore also considered
Nevada-Reno, Long Beac h
State and Nevada-Las V.egas.
Pessler (6-4, 275), one of the
Pirates pictured on the cover of
the 1988 OCC grid guide, played
at Newport Harbor High. At
Cal, he joins his former OCC
teammate, wide receiver Junior
Tagaloa, who is looking forward
to his senior season with the
Bears.

OCC place kicker Kevin
McKclvic, the Pirates' all-time
leader in field goals, has been
named to the J.C. Grid-Wire/
Jostcn's Scholar/ Athlete All-
Amcrican Team.
McKelvic, a business major
from Capistrano Valley High,
carries a 3.5 grade point average.
He was one of 27 athletes
across the nation to be named
to the team.
McKelvie set an OCC career
record by kicking 18 field goals
for the Pirates in 1987-88 in 24
attempts, breaking the old
record set by Woody Tressler in
1974-75.
In 1988, McKelv.ic connected
on 8-of-11 three ttoinHrics and
20-of-2 l touchdown conversions
to lead the Bucs in scoring with
44 points.

Christmas Tree aan always a hot tickiet
Strolling carolers sang tradi-
tional music for arriving
members and their guests in the
handsomely decorated lobby of
the Balboa Bay Club to be
greeted by the Club's governors
and their wives.
The Christmas Tree Ball has
always been a .. sell-out" affair,
the moment the tickets go on the
block in October. The festive
holiday event begins with a
social hour in the Lounge.
Following is a delicious dinner
served in the brightly decorated
ballroom, with entertainment
from the All American Boys
Choir, which brings tears to
one's eyes and, of course, danc-
ing.

for the 40th annual Candy Cane
Ball. Sponsored by the Junior
Auxiliary, the dinner, dance and

The Rex Restaurant once
again did a terrific job on their
luncheon, which benefited the
American Red Cross. So pop-
ular has this affair become that
the hours were extended by the

Had a terrific time at the 80th
annual Christmas Boat Parade
6f Lights. The theme this year
was .. 100 Y cars of Nautical
Cheer." Richard Luehrs hosted
a party the first night at the
Balboa Bay Club on behalf of
the Newport Harbor Arca
Chamber of Commerce. Just

classes
offered
A course in coastal navigation
will be presented this spring by
Orange Coast College's Marine
Activities Department.
Spring semester classes begin
on Monday, Jan. 9.
Listed as Marine Activities
J 20 in the OCC schedule, the
course meets Monday evenings
from 7 p.m. to JO p.m. at the
college's Sailing and Rowing
Base in Newport Beach.
The class focuses on charts,
navigational publications, plot-
ting and advancing positions,
compass correction, taking and
plotting bearings, electronic
aids, determining tides, and
current sailing.
Spring registration is under-
way, and rgistration appoint-
ments are available in OCC's
Admissions Office. The office is
open Monday through Thurs-
day from 8 a.m. to 7 p.m., and
Fridays from 8 a.m. to S p.m.

The United States Coast
Guard Auxiliary. Flotilla 27,
will offer a I 0-week course on
"Boating Skills and Seaman-
ship," beginnign Wednesday,
Jan. 11, at 7:30 p.m. Classes will
be held at the Newport Harbor-
master's classroom, 190 I Bay-
side Drive, Newport Beach.
It is suggested that students
arrive early the first night to
obtain class materials. Cost for
the materials and textbook is
$16. The classes arc free.
The skills learned in these
clatea are valuable aids in the
enjoyment of boating. Subjects
include safe boating operations,
"Ca••Mbip, aids to navigation,
radio communication, charts
a.d compass, and many more

Newport Beach has been named
a trustee of Fuller Theological
Seminary in Pasadena, Calif.,
one of the largest Protestant
seminaries in the world. Huff-
man, wife of St. Andrews Presb-
yterian Church pastor John
Huffman, was appointed last
moo.th to the bo~rd 911 the
evangelical, multidenomina-
tional seminary.
A graduate of UCLA and
Fuller Theological Seminary,
Huffman is a marriage and
family counseling intern at
CORE Counseling in Newport
Beach, and a staff therapist at
Bio la Counseling Center.
Fuller President David Allan
Hubbard said he was delighted
with Huffman's appointment.
"Anne will uphold the tradi-
tion of outstanding service that
Fuller trustees have offered to
the seminary over its 41 years
of service to the Church," he

Fuller Theological Seminary

recipe, I realized I should have
buttered the baking pan. Oh
well-too late.
Then I read a little more and
turned off the oven. This was a
steamed pudding. To steam it,
the baking pan had to be placed
inside a big kettle, with water up
to the top of the pudding. It was
a stovetop affair.
I borrowed a big kettle from
a neighbor, but it had no top.
I pulJed out some foil for an
ersatz lid and set the pudding ,

Hugh. "The company allows us
as individual agents to work
independently within strict
guidelines."
The Swanson •s believe their
many years living in Newport arc
a bonus. Their children grew up
on Lido Isle, so they arc very
familiar with the schools. And,
they have watched the area grow
tremendously and real estate
prices appreciate. Hugh recalled
a recent bayfront transaction in
which the sellers were the origi-
nal owners. They bought the
home in the mid-'50s for just
around $55,000. They were able
to sell the property for the l 988
Hugh said he was apprehen-
sive about Joining Merril Lynch
in the beginning because it is a
large, Eastern company.
