A Newport Beach Police officer bas
been cleared of criminal charges in the
Labor Day weekend shooting of a
Liberian immigrant, but the victim •s
attorney says he will press on for a civil
judgement agaimt the city.
The Orange County District Attor-
ney's Office concluded last week that
Officer Derck Duncan did not act in
a criminal manner when he seriously
wounded 26-year-old Sundaga Bryant
in the early morning hours of S~pt. 4,
said Newport Beach Police spokesper-
son Bob Oakley.
Bryant and his wife, Marlene, had
just returned from a stroll along the
beach near the Balboa Pier when
Duncan mistook a black radio Bryant
was holding for a gun and shot him.

' Upon graduation from New-
port Harbor High School in
1969, Kennedy headed for
Hawaii, Mexico and the East
Coast, searching out new subject
matter for his paintings.
"I was enraptured at an early
age with Hawaii and different
cultures," he said. "There is so
much out there, Why sbouldn l
I be able to bring back some of
the beauty I sec?"
But locally, Kennedy is known
for his paintings of area
landmarks, such u the Lido
Tbe~r, the old Balboa Fun
Zdiie,-tbc China House, Balboa
Pavilion, the Cannery, Chuck
Dent Surfb0ard1, the Golden
Bear and the Sakioka bcanfields
with. the Center Tower looming
in the background. He is also
responsible for putting the Crab
Cooker on the map. While
0 playing hooky .. from high
school one day, he discovered
the place and decided it was
interesting enought to paint.
Kennedy is used to drawing
attention while he's painting. He
became a true traffic-stopper
when he set up shop to paint the
Lido Theater on the median strip
in the street.
Even though Kennedy has
many interesting stories to tell,
one of the most memorable
times of his life was the years
be spent in Europe with his wife,
Karen. They went to Denmark
in 1973, originally to spend six
months after finding a sea-
worthy craft• to bring back as a
floating studio. But they wound
up spending 10 years ~ere, while
rebuilding an old 38-f oot Danish
workboat, Svanen, which means
swan. They learned to speak
fluent Danish, be learned
shipbuilding and they earned a
living through bis painting Euro-
pean scenes. Kennedy held many
shows and is still exhibited
throughout Europe today. One
of the paintings Kennedy said he
is proudest of to date is his
rendition of the K wakelbrug
footbridge in Edam.
The Kennedys returned to
Newpor-t Bench in 1982 and
opened up a gallery and Svanen
was shipped back on a freighter.
Kennedy plans to take his fam-
ily, which includes four-year-old
Katheryn Allysa, on more trips.
In the meantime, Kennedy is
busy with many commissions
presented to him. He painted the
past three times for t~ Amer-
ica's Cup Race, is the official
artist for the Newport Offshore
Sailing Association Enscnada
Race, bas painted for the Char-
acter Boat Parade and will be
doing artistic duties for the 1989
Parade of Lights.

summer, she said.

to trial have been hampered by

Keena is concerned with gar-
nering a speedy court date for
this case because the Bryant

Bryant was shot," Oakley said.
"We wish to sincerely express
our hope for a complete recovery
by Mr. Bryant from bis tragic
injuries. All of us, including

incident occurred and wish Mr.
Bryant and bis family well ...
Keena said the apology. while
noted, bas not erased the pain
and anguish of Bryant's injuries
and bis family's "nightmare."
"This situation bas changed
his life and an apology docs not
make him whole or clear up the
disastrous financial difficulty

Healing the. wounds
The decisio n this week by the District Attorney's office
not to file charges in the wounding of Sundaga Bryant
by a Newport Beach police officer Sept. 4 closes out
a chapter, a lengthy chapter, in the story of the shooting,
but the book is still far from fini shed.
The District Attorney decided that Ofer. Derek
.Duncan was not criminally negligent when he fired a
shotgun blast into Bryant's side in the early morning
hours that Sunday, in the mistaken belief that the radio
Bryant was carrying was actually a gun. We believe that
was the proper finding by the district attorney, and hope
that Bryant, his family, and his attorney can accept that
decision, as well. ·
The matter of civil liability still looms large in the
case, however. City officials have maintained that while
they have great sympathy for Bryant and his family,
the matter of what, if any, compensation is to ·be paid
to him is for a judge and/ or jury to decide.
Bryant was maimed for life. His immediate medical
expenses were enormous; his ongoing medical expenses

Healing the wounds
The decision this week by the District Attorney's office
not to file charges in the wounding of Sundaga Bryant
by a Newport Beach police cofficer Sept. 4 closes out
a chapter, a lengthy chapter, in the story of the shooting,
but the book ~is still far from finished .
The District Attorney decided that Of;cr. Derek
Duncan was not criminally negligent when he fired a
shotgun blast into Bryant's side in the early morning
hours t}lat Sunday, in the mistaken belief that the radio
Bryant was carrying was actually a gun. We believe that
was the proper finding by the district attorney, and hope
that Bryant, his family, '#lnd his attorney can accept that
decision, as well.
The matter of civil liability still looms large in. the
case, however. City officials have maintained that while
they have great sympathy for Bryant and his family,
the matter of what, if any, compensation is . to be paid
to him is for a judge and/ or jury to decide.
Bryant was maimed for life. His immediate medical
expenses were enormous; his ongoing medical expenses
are substantial. He has yet to return to work and doctors
do not know when, or even if, he will be able to do
so. Clearly, this man has suffered great harm. Just as
clearly, that harm was not of his doing -he was not
armed; he committed no crime.
On the other hand, Of er. Duncan was acting according
to his training, in the not unreasonable belief that his
life was in danger. He was investigatipg reports of a
man with a gun (a youth with a replica gun was detained
in the area a few minutes after the shooting). Bryant
was OD the beach at an unusual time of day with a
large object slung under his arm. Apparently, when he
was told to "freeze" he did not do so.
We believe that the primary concern of all involved
at this point should be the welfare of Mr. Bryant. We
do not think that goal will be served by his attorney
continuin a crusade againsLthc Newport Beach police
er. Duncan's action may have been ill-advised, in
hindsight, but it was not malicious. Neither will that
goal be served by the city insisting on ta.king the matter
of compensation to trial -that would be a lengthy
and painful process for Bryant and his family.
We urge the representatives of the city and Bryant
to make a good faith effort to arrive at a fair settlement
OD the issue of compensation, so that the book can finally
be closed on this tragic incident and the Bryant family
can begin to heal the severe emotional wounds that

An in-depth segment on care of
impoverished Americans
showed seniors lonely, malnour-
ished and near death in freezing
squalor. The excuse for such
conditions was lack of congres-
sional funding.

scribed fear among electronics
firms that the Japanese will
completely dominate coming
trigh definition TV markets. The
rationale for lagging US invol-
vement was inadequate f und\ng
or research and development.
A final Nightly News item
struck at the heart of the Amer-
ican "holocaust.·· It was the
President's request for a $4. 7-
billion-dollar increase to our
$300 b.illion annual defense
budget. Amctifa's .. holocaust" is
our obse sion with military
weaponry as a mean of attain-
ing national ecurity.

bright and early at the Newport
Beach Country Club for a con-
tinental breakfast before board-
ing buses for the Arcadia track,
where they enjoyed the races and
a buffet at the Club Court before
returning to Newport. Margaret

County Philharmonic Society
were sponsored last week:
U ppcr Bay Committee held a
card tournament at the Balboa
Yacht Club. The affair also
featured luncheon and a fashion
show of Newport Center couture
coordinated by Kitty Leslie.
A few days later, OCP's Con-
tinuance Fund Drive was under-
way. The Irvine Hilton k Tow-
ers was the setting for this
brunch, which also featured
best-selling author and motiva-
tional s peaker Danielle
Kennedy. The Drive continues
for four months, in which all the
committees of OCPS seek dona-
tions from their own memben
and the community to extend
and improve its educational
programs. A few of the ladies
attending were Nancy Posch,
Sara Mullarkey, Christel Schar,
Sheri Lawrence, Jean Tan-
dowsky and OCPS executive
director Erich Vollmer.

Boyce says that increasingly
scarce, and therefore more
costly, developable land further
