RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2017-13, A Resolution of the City Council of the City of Newport Beach, California, Supporting the Submission of a Grant Proposal for Funding Under the Orange County Transportation Authority Environmental Cleanup Tier 1 Grant Program and Authorizing the City Manager or Designee to Submit the Proposal. Measure M2 is a half -cent sales tax for transportation improvements approved by Orange County voters in 2006. For the Tier 1 grant program, a total of $19.5 million is projected to be available over a seven-year period that began in FY11/12. Approximately $2.8 million is available for this fiscal year's Call for Projects. Staff plans to submit one or more applications for trash/debris capture projects such as continuous deflection structures (CDS), trash/debris booms, and/or water wheel collection systems. These types of projects have been reviewed and encouraged by the City's Water Quality/Coastal Tidelands Committee. As required by the grant application, an adopted resolution must be submitted stating that the 1) City Council has reviewed and supports the application(s), 2) City is capable of providing the required match funding and/or in-kind contributions, and 3) City agrees to work with OCTA to meet established deadlines. If awarded a grant, the City Council will be asked to accept the grant funds at a future meeting date. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
