The City Arts Commission special meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that
the special meeting City Arts Commission agenda be posted at least seventy-two (72) hours in advance of the meeting and that the
public be allowed to comment on agenda items before the Commission and items not on the agenda but are within the subject
matter jurisdiction of the City Arts Commission. The Chair may limit public comments to a reasonable amount of time, generally
three (3) minutes per person.
The City of Newport Beach’s goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a
participant at this meeting, you will need special assistance beyond what is normally provided, we will attempt to accommodate

completion of the card is not required in order to address the City Arts Commission. If the

The City Arts Commission of Newport Beach welcomes and encourages community
participation. Public comments are generally limited to three (3) minutes per person to allow
everyone to speak. Written comments are encouraged as well. The City Arts Commission has

enacted by one motion in the form listed below. City Arts Commissioners have received
detailed staff reports on each of the items recommending an action. There will be no separate
discussion of these items prior to the time the City Arts Commission votes on the motion
unless members of the City Arts Commission request specific items to be discussed and/or
removed from the Consent Calendar for separate action. Members of the public who wish to
discuss a Consent Calendar item should come forward to the lectern upon invitation by the
Chair.

Michael Magrutsche suggested the City Arts Commission identify sites within the sculpture
garden for pieces of sculpture and then ask artists to suggest or create sculpture for each
site.
[Commissioner Van Bergh arrived.]
Chair Selich requested Library Services Director Hetherton consider compiling
specifications for sculpture sites.
Virginia Hayter suggested adult and children coloring books of artwork in the sculpture
garden be developed and sold in the Library and in gift shops.
Susan Kramer suggested the islands and dates of origination be included in McFadden
Square.
Chair Selich suggested a list of events proposed for inclusion in McFadden Square be
placed on the website for public input.

A. Approval of Minutes of the January 12, 2017 City Arts Commission Meeting
1. Draft of 01/12/2017 Minutes
Motion made by Commissioner Greer, seconded by Commissioner Logan, and carried (6-
0-0-1), to approve the draft Minutes for the meeting of January 12, 2017 as presented.

B. Consent Calendar Items
2. Financial Report - Review of financial information.
Library Services Director Hetherton reported sufficient funds were available for the juried
art show and professional services. Additional funds could be available through
reimbursement of the school district's 2015-16 Cultural Arts Grant.

3. Cultural Arts Activities - Monthly review of cultural arts activities from the
Library Administrative Office for upcoming Library and City arts events and
services.
Library Services Director Hetherton reported he met with representatives of the Festival
Ballet and Backhausdance to plan performances in March and May. Scott Amling's
photography exhibit would open on February 13. Five hundred people had responded to
the Performing Arts Community Survey.
Chair Selich stated she had mentioned the survey in her column for Stu News. In addition,
Stu News had been running a link to the survey.
In response to Chair Selich's questions, Library Services Director Hetherton indicated he
would present a report on the survey in March, and the City Arts Commission could decide
whether to continue or terminate the survey. He could generate a statistical report from
Constant Contact to include in the presentation to the City Council.

0-0-0), to approve the Consent Calendar.

VI. CURRENT BUSINESS
A. Items for Review and Possible Action
4. McFadden Square Timeline Update – Staff requests that the City Arts
Commission review the McFadden Square Timeline, add notable City
events to the chronology and recommend the timeline to City Council for
approval.
Vice Chair Kerr noted many local athletes had been inducted into Halls of Fame for various
sports and suggested a comprehensive list be created.
Chair Selich felt a list of athletes could be utilized to obtain corporate sponsorships.
5. Central Library Gallery Exhibits – The Art in Public Places Ad Hoc
Subcommittee recommends that the City Arts Commission approve
exhibitions by Jane Kelley, Diana Blaisure, Diana Ghoukassian, and
Gianne de Genevraye in the gallery space in the Central Library lobby.
Commissioner Greer reported the Art in Public Places Subcommittee reviewed and
recommended works by Jane Kelley, Diana Blaisure, Diana Ghoukassian, and Gianne de
Genevraye for exhibition in the Library.
Chair Selich noted Ms. Ghoukassian had an art gallery in Irvine. Commissioner Logan
added that she was one of the winners of the Newport Beach Art Exhibition.
Motion made by Commissioner Greer, seconded by Commissioner Logan, and carried (7-
0-0-0) to approve the subcommittee's recommendation of exhibitions by Jane Kelley,
Diana Blaisure, Diana Ghoukassian, and Gianne de Genevraye in the Central Library.

6. Concerts on the Green 2017 – The Performing Arts Ad Hoc
Subcommittee recommends that the City Arts Commission approve the
selection of performers for the 2017 summer concert series.
Commissioner Bendetti reported the Performing Arts Subcommittee received 25-30
submissions in addition to the groups of which the subcommittee was aware. They
selected The Tijuana Dogs, Flashback Heart Attack, and the Citrus College band, Night
Shift. The Tijuana Dogs and Flashback Heart Attack were available should the City Arts
Commission approve the subcommittee's recommendation. The subcommittee was
awaiting word from Night Shift. The subcommittee also had a list of alternate groups
should they be needed. These bands would expand the demographics of concert
attendees.
In response to Chair Selich's and Vice Chair Kerr's inquiries, Library Services Director
Hetherton advised that Pacific Symphony was not ready to confirm a date. Pacific

Symphony needed to confirm summer dates and venues. Vice Chair Kerr stated Pacific
Symphony had published their summer dates. Library Services Director Hetherton would
contact them again.
Motion made by Commissioner Bendetti, seconded by Commissioner Greer and carried
(7-0-0-0) to approve the acts recommended by the Performing Arts Subcommittee.

Chair Selich assumed a variety of food trucks would be available at concerts.
7. Request to Move Reimbursed Cultural Arts Grant Funds to
Programming Budget – Staff requests that the $2,400 Cultural Arts Grant
reimbursed to the Cultural Arts Division from the Newport Mesa Unified
School District be deposited in the Programming budget and be used for
the 2017 Newport Beach Art Exhibition.
Library Services Director Hetherton advised that the Newport Mesa Unified School District
had not submitted a completion report for the grant. When he contacted them, they
indicated they had not used the grant for the project and volunteered to return the funds.
He believed it would be appropriate to use the funds for City Arts Commission
programming.
Motion made by Commissioner Greer, seconded by Commissioner Logan, and carried (7-
0-0-0) to approve staff's recommendation to deposit the funds into the programming
budget.

B. Monthly Reports
8. Art in Public Places Ad Hoc Subcommittee – Commissioner Arlene
Greer, Commissioner Caroline Logan, Commissioner Jennifer Van Bergh
Commissioner Greer advised that the Sculpture Garden subcommittee was awaiting word
from City staff regarding a consultant and regarding the possibility of releasing Phase 3
and Phase 4 calls for artists simultaneously. The subcommittee would meet soon to
discuss the Newport Beach Art Exhibition; temporary artworks to fill the gap between de-
installation of Phase 3 and installation of Phase 4 of the Sculpture Garden; and developing
and/or clarifying a policy for loaning and maintaining all City art and guidelines for art on
loan from artists and artwork considered for permanent acquisition by the City. Mark
Leysen offered to donate a painting to the City of Newport Beach. The subcommittee
selected Mr. Leysen's painting Shifting Currents. The subcommittee would provide a
recommendation to the City Arts Commission in March.

In response to Vice Chair Kerr's inquiry, Commissioner Greer stated the subcommittee
would discuss artists touring the Sculpture Garden and determining appropriate locations
for their work as part of responding to the call for artists. The subcommittee had discussed
holding a "call for artists" open house to orient artists.
Chair Selich suggested an open house could be used to make artists aware of the
materials they should use if they wanted their artwork considered for permanent display.
Commissioner Greer felt many topics could be presented in an orientation.
9. Performing Arts Ad Hoc Subcommittee – Commissioner Michelle
Bendetti, Commissioner Arlene Greer, Commissioner Judy Chang
Commissioner Bendetti advised that planning concerts needed to begin sooner in the
fiscal year. The subcommittee wanted to conduct outreach to national acts and
performers.
10. Marketing & Communications Ad Hoc Subcommittee - Commissioner
Michelle Bendetti, Commissioner Lynn Selich
Chair Selich reported the subcommittee held a conference call with the Camp Ronald
McDonald Executive Director and the curator of the Cows4Camp exhibit regarding
activities to underwrite and sell cows. The subcommittee would begin promoting the
concert series.
11. Government Relations Ad Hoc Subcommittee - Commissioner Lynn
Selich, Commissioner Michael Kerr, Commissioner Jennifer Van Bergh
Vice Chair Kerr announced the subcommittee requested the City Arts Commission be
included in the City Council's Study Session on March 28. The City Arts Commission
should discuss topics, goals, and information to present to the City Council. This would
be an opportunity to learn the Council's view on issues relevant to the City Arts
Commission.
Chair Selich suggested assigning Commissioners to liaise with Council Members. Library
Services Director Hetherton advised that that would be appropriate. Commissioner Greer
added that Commissioners needed to be aware of City Arts Commission issues in order
to discuss them with Council Members.

Vice Chair Kerr had nothing to report.

Commissioner Greer requested items regarding approval of Chip Fesko as an exhibiting
artist and Mark Leysen's donation of Shifting Currents.
Library Services Director Hetherton reported the Arts Foundation wished to make a
presentation to the City Arts Commission in March.
Commissioner Greer noted the Arts Foundation was searching for a chairman for Art in
the Park.
VIII. PUBLIC COMMENTS ON NON-AGENDA ITEMS
Vice Chair Kerr noted the Backhausdance performance the prior week sold out and
received rave reviews. Everyone would enjoy the performance in Newport Beach in May.
In response to a question from a member of the public, Chair Selich did not believe the
police would allow tailgating on the roof of the parking structure during concert series
events.

TITLE: Cultural Arts Activities for February 2017
Scott Amling: An exhibition by photographer Scott Amling, "Moments Between Oceans," is on display in
the Central Library lobby gallery from February 13 through March 24. The exhibit showcases a collection
of original photography of seashell still life along with shots from nearby Balboa Peninsula to settings
farther away like Kauai, Hawaii and Hokkaido, Japan.
Scott Amling lectured about his work at the Newport Beach Central Library on February 22, discussing his
day in Hokkaido, Japan and showcasing his landscape photography.
Festival Ballet: There will be a special performance of Don Quixote for children by the Festival Ballet on
Saturday, March 25 at 12 p.m. Don Quixote is based on episodes taken from the famous novel Don
Quixote de la Mancha by Miguel de Cervantes. Festival Ballet Theatre, a 2016/17 Cultural Arts grantee,
is Orange County’s premiere, and most accomplished professional ballet company. This program is
made possible by a Newport Beach Cultural Arts Grant.

Backhausdance: Backhausdance, Orange County’s critically acclaimed contemporary dance company
and 2017 City of Newport Beach Grant recipient, presents an engaging, athletic and entertaining site‐
specific outdoor performance on Saturday, May 20 at 2 p.m. In addition to two repertory works, this
community event features a new dance specifically created for the City Hall campus by Artistic Director
Jennifer Backhaus. A family day of dance suitable for audiences of all ages, dance lovers from around
Orange County are invited to dress comfortably and walk with us as the dance works travel along the
lush lawns of the Civic Green. This program is made possible by a Newport Beach Cultural Arts Grant.
Wing Lam: The Balboa Island Museum & Historical Society
present celebrated entrepreneur, speaker and professor Wing
Lam, founder of Wahoo’s Fish Taco, at the Central Library on
May 23 at 7 p.m. Mr. Lam will discuss his family’s story and their
roots in Orange County. This program is made possible by a
Newport Beach Cultural Arts Grant.

TITLE: Approve Donation of Mark Leysen’s Shifting Currents to City Arts Inventory
RECOMMENDATION:
The Art in Public Places Ad Hoc Subcommittee recommends that the City Arts Commission accept the donation of
Mark Leysen’s Shifting Currents into the City Art inventory.
FUNDING REQUIREMENTS:
No funding requirement.
DISCUSSION:
Mark Leysen is an acclaimed local artist. According to his artist’s statement, “His art has been exhibited throughout
California and Mexico in various group and one‐person exhibitions, including; the UCLA Hammer Museum, the San
Bernardino Museum, the Laguna Art Museum, Orange County Museum of Art, the Irvine Fine Arts Center, Chapman
University, Museo de Arte in Queretaro, Mexico, California State University at Fullerton, the Los Angeles County
Museum ARS Gallery, and Grand Central Art Center in Santa Ana. Leysen’s non‐representative paintings allude to
physical space, its experience and emotional imprint left on memory. A strong sense of color and rhythm shapes the
compositions, while the more formal aspects of geometric forms give balance and harmony. Art writer Dr. Roberta
Carasso states, “Leysen’s interaction of space, movement in a variety of directions, enhances the surface quality and
creates the illusion of multiple planes. The already large image seems even more immense because our eyes
continue moving upward and outward, following each shape beyond the space of the canvas.”
Mr. Leysen’s work was recently exhibited in the Newport Beach Central Library. Upon de‐installation, Mr. Leysen
graciously offered to donate a painting to the City and encouraged the committee to select a painting from the
recent exhibition. The Art in Public Places Ad Hoc Subcommittee selected the painting Shifting Currents (see
ATTACHMENT A).
Mr. Leysen agrees to all the conditions listed in Council Policy I‐11, Donation of Art to the City of Newport Beach.
(see ATTACHMENT B). Shifting Currents conforms to the criteria listed in Council Policy I‐9, Art in Public Places (See
ATTACHMENT C).
Pending City Art Commission approval, the painting will be recommended to the City Council for acceptance into the
City art inventory.
NOTICING:
This agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the
City Arts Commission considers the item).

ACQUISITION OF ART BY THE CITY OF NEWPORT BEACH
A. The City of Newport Beach (“City”) believes that paintings, sculptures, drawings
and other art (collectively, “Art”) placed on City property and in City buildings
increases the aesthetic appeal and beauty of such property and buildings, and of
the City in general.
B. All proposals to donate, exhibit, loan, sell or commission Art to the City
(collectively, “Convey(s),” “Conveyed,” “Conveying” or “Conveyance”) shall be
reviewed by the Arts Commission for recommendation to the City Council.
C. The Arts Commission shall be responsible to:
1.Confer with persons who have offered to Convey Art to the City,
informing them of this policy, including criteria for approving Art and the
policies, criteria and approval process.
2.Advise the City Council of the artistic merit and value of Art offered to the
City.
3.Advise the City Council regarding appropriate City property or City
buildings for display of Art, in conjunction with the City commission,
committee, board and/or department which has responsibility for
planning or maintaining the proposed location.
D. The Arts Commission shall consider the following criteria in making a
recommendation for accepting an offer to Convey Art to the City:
1.The Art should be an original creation or a limited edition by the original
artist, and be of the highest quality and level of artistic excellence.
2.The Art should add to the balanced inventory of the City’s collection,
representing a variety of style, design and media.
3.The person(s) seeking to Convey Art to the City shall complete all
required forms, as provided by the Library Services Department.
4.The Art should be of satisfactory physical condition, be sufficiently
durable as to not be easily damaged or destroyed, should not require
restoration or extensive long term conservation, and should be of a
physical size and weight that the Art can be managed in storage, transport
and public display without difficulty. Art requiring restoration may only

be considered with full disclosure of the restoration costs provided by a
licensed art appraiser.
5. The Art should be consistent with and relevant to the civic interests and
broad variety of tastes within the Newport Beach community.
E. Art may only be recommended by the Arts Commission to the City Council for
acceptance upon the majority vote of the Arts Commission.
F. Art accepted into the City collection by the City Council is accepted with the
understanding that the City Council reserves the right to place the Art on public
display on either a permanent or temporary basis, and to store the Art when not
on display. Acceptance of Art by the City Council does not guarantee that the
Art will be displayed in perpetuity. The City Council may sell, donate or
otherwise remove any Art in the City collection. Any proceeds received by the
City from the transfer of Art shall be expended to acquire, restore or display Art.
G. Art considered for inclusion in the City’s collection must conform to City Council
Policy I-9 (Art in Public Places).
H. The City does not provide valuations or appraisals of Art Conveyed to the City.
The value of Art should be presented by the person(s) Conveying Art to the City
at the time of Conveyance. It is the responsibility of the person(s) Conveying Art
to the City to furnish a valuation to the appropriate government tax agency.
I. The person(s) Conveying Art to the City shall obtain all intellectual and
photographic property rights to the Art and transfer such rights to the City. The
City reserves the right to photograph Art for any and all purposes, including, but
not limited to, publicity and informational literature.
J. Any person(s) that Conveys Art to the City shall represent and warrant in writing
that it owns the Art and that the Art shall be Conveyed to the City free and clear of
all liens, restrictions, security interests or agreements by which the City would be
bound, but subject to all laws generally applicable to the transfer of title of any
work of Art.
K. Subject to compliance with California Civil Code Section 987, the City shall assume
no liability in the event of loss or damage to any Art accepted into the City’s
collection.

ART IN PUBLIC PLACES
The City of Newport Beach recognizes the importance and desirability of
enhancing and beautifying the public places within the City, by acquiring and
displaying publicly accessible works of art for the cultural benefit of the City, its
citizens and its visitors.
The City seeks to involve professional artists in City planning and design
projects; to integrate artworks in City capital improvement projects; and to
commission and/or purchase new artworks for public places.
Public art can include but is not limited to permanent and temporary sculpture,
murals, as well as artist-designed fountains, mosaics and tile work, banners, park
benches and other street furniture, water features, bus shelters, streetlights and
lanterns, kiosks, retaining walls, and/or hardscape treatments.
The responsibility of the Arts Commission is to:
1.Identify and assess potential Art in Public Places projects and sites;
Confer with other Boards and Commissions that may be impacted by the
recommended list of art projects;
3.Make appropriate recommendations to City Council;
4.Participate in the selection of artists for Art in Public Places projects;
5.Plan and oversee the artistic design process;
6 Work with appropriate City Departments to ensure correct installation at
the site and long term maintenance and conservation of the art work.
The Arts Commission shall consider the following criteria in making
recommendation for an Art in Public Places project:
The aesthetic concept, quality, scale, and form of the work of art, and its
appropriateness for the site;
2.A site that is easily visible and/or accessible to the general public;

3.The experience, skill and ability of the artist to produce the work of art;
The proper medium for the work of art, considering durability against
vandalism, theft and weather, and the safety of the viewer;
5.The cost for the City to acquire, Lnstall and maintain the work of art;
No art objects will be considered that are mass-produced from a standard
design, are reproductions of original art work, and/or are decorative or
functional elements that are designed by an architect as opposed to the
project artist.
Temporary art may be acquired and placed through the same procedures
as permanent works.
From time to time, the Arts Commission may submit to the City Manager’s
Office a list of projects with estimated costs. Said list is to be considered in the
preparation of the next fiscal year budget. Funding for this program shall be
determined by the City Council, and may be derived from the City Art in Public
Places Reserve Fund, Arts Commission events, the Newport Beach Arts
Foundation, private individual, corporate and foundation donations;
government grants, other City funds, and/or voluntary participation by private
developers.
In addition, to maintain the artistic integrity of designated Art in Public Places
sites/works, the Arts Commission shall review any future modifications,
relocation, repairs, and/or replacement of parts or works at these sites. The Arts
Commission shall consult with the original artist if possible or a recognized
expert in the field, and shall then make the appropriate recommendation for
modification to the City Council.

DISCUSSION
As the City Arts Commission becomes increasingly interested in cultivating funding sources from the
private sector, the relationship with the Newport Beach Arts Foundation is critical towards achieving
those goals.
The purpose of the Arts Foundation is to further the objectives of the arts programs of the City of
Newport Beach through fundraising.
The Newport Beach Arts Foundation is organized exclusively for charitable purposes within the meaning
of Section 501(c) (3) of the Internal Revenue Code of 1986. The charitable purposes for which this
