ABSTRACT:
Construction bids have now been received for the annual Slurry Seal Program FY 2016-
2017. Staff requests City Council's approval to award the contract to American Asphalt
South, Inc. The Slurry Seal Program is an essential part of the City's pavement
preventative maintenance plan which corrects minor deficiencies, prevents deterioration
and prolongs the life of the pavement in residential areas. This year's project covers the
Mariner's, Dover Shores and Bay Knolls communities and follows the concrete repair
work being done in this area.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15302(c) (reconstruction of existing facility involving negligible or
no expansion of capacity) of the CEQA Guidelines, because it has no potential to
have a significant effect on the environment;
b) Approve the project specifications;
c) Award Contract No. 8273-1 to American Asphalt South, Inc. for the total bid price of
$558,494.00, and authorize the Mayor and City Clerk to execute the contract; and
d) Establish a contingency of $56,000.00 (approximately 10 percent) to cover the cost
of unforeseen work not included in the original contract.

The Slurry Seal Program is an essential part of the City's pavement preventative
maintenance plan which corrects minor deficiencies, prevents deterioration and
prolongs the life of the pavement in residential areas. This annual program is designed
to cover the entire city in seven years. This year's program covers the Mariner's, Dover
Shores and Bay Knolls communities.
At 10 a.m. on February 28, 2017, the City Clerk opened and read the following bids for
this project:
The City received multiple bids for this project and the low bid amount is 20 percent
below the engineer's estimate of $700,000.00. The lower than estimated bid price could
be related to the current relatively lower price of crude oil. The low bidder, American
Asphalt South, Inc., possesses a California State Contractors License Classification "A"
as required by the project specifications. A check of the contractor's references
indicates satisfactory completion of similar projects for the City of Newport Beach and
other public agencies.

The work necessary consists of distributing construction notices to affected businesses
and residents, clearing existing pavement surfaces of debris, soils, and other loose
materials, removing existing traffic striping, pavement markings, and raised pavement
markers, crack sealing, placing emulsion aggregate slurry seal, placing seal coat,
installing new traffic striping, pavement markings, and raised pavement markers, and
other incidental items of work necessary to complete the work within the Mariner's,
Dover Shores and Bay Knolls communities. Pursuant to the Contract Specifications,
the Contractor will have eighty (80) consecutive working days to complete the work.
Public notices and construction work is expected to begin in mid-May, following the
concrete work and in warmer weather.

Staff recommends the City finds this project exempt from the California Environmental
Quality Act (CEQA) pursuant to Section 15302(c) (reconstruction of existing facility
involving negligible or no expansion of capacity) of the CEQA Guidelines, because it
has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
