PROJECT SUMMARY
An annual review of Development Agreement No. 7 for Pacific View Memorial Park,
pursuant to Section 15.45.080 of the Newport Beach Municipal Code and Section
65865.1 of the California Government Code.
RECOMMENDATION
1) Conduct a public hearing;
2) Find the annual review is exempt from the California Environmental Quality Act
("CEQA") pursuant to Section 15321, Class 21 (Enforcement Actions by Regulatory
Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter
3;
3) Receive and file the Annual Report of the Development Agreement for Pacific View
Memorial Park (Attachment No. ZA 2); and
4) Find that the applicant has demonstrated good faith compliance with the terms of
Development Agreement No. 7.

BACKGROUND
On July 10, 1995, the City Council adopted Ordinance No. 95-26 approving a
Development Agreement (DA) between the City and Pacific View Memorial Park (Pacific
View) establishing maximum development allocations for the memorial park. The DA also
provides a set of comprehensive development provisions including development phasing,
construction scheduling, the height and design of structures, landscaping, and the
maintenance of buffer landscape areas.
On September 25, 2007, the City Council approved an amendment to the DA modifying
development allocations within specific building sites. The term of the Development
Agreement was also extended to 2025 and the amendment provided a 7-year automatic
extension to 2032 should Pacific View not complete all of the development authorized
before 2025. The original and amended DA are available online at:

At the last annual review on May 12, 2016, the Zoning Administrator found that Pacific
View demonstrated good faith compliance with the terms of the Development Agreement.
DISCUSSION
Section 15.45.080 of the Municipal Code requires the City to periodically review
development agreements to determine if the applicant has complied with the terms of the
agreement. This review should be conducted at least once every 12 months.
The applicant is required to demonstrate good faith compliance with the terms of the
agreement, and should the Zoning Administrator find that the applicant has not remained
in good faith with the terms of the agreement; the Zoning Administrator should refer the
matter to the City Council.
Terms and Conditions of the Agreement
The obligations under the Development Agreement include maintaining the landscape
buffer and requirements for new construction, which are reviewed and enforced at the
time of plan check and permit issuance. The requirements include phasing, restricted
construction hours, and development standards. Pacific View must comply with the terms
and conditions specified in the Development Agreement.
The Development Agreement provides for a maximum of 30,000 square feet of
administrative offices and support facilities, 114,480 square feet of community
mausoleum, and 12,000 square feet of family mausoleum.

Annual Review
The annual review covers the period of May 2016 to April 2017. There was no new
construction for the allotted family and community mausoleum or expansion of the
existing administration complex within the last year.
Table 1 below shows the total entitlement allowed by the Development Agreement,
structure types and their square footage built to-date and the remaining entitled square
footage.

Within the past several months, staff has received complaints related to the operation and
maintenance of Pacific View from a resident who resides to the north of the cemetery.
These complaints are mostly noise-related issues from leaf blowing, lawn mowing and
edging, and loud engraving. Upon investigation, staff determined that Pacific View was
exceeding the noise ordinance with their use of leaf blowers and occasionally with their
operating equipment. Pacific View addressed these noise issues by purchasing more
appropriate equipment and noise monitoring devices to resolve these violations. Odor
from burning incense was also a concern. The DA does not provide any restrictions on
burning incense as it is part of many religious observances. Pacific View, however, does
implement a policy prohibiting unattended incense burning.
The complaints also include construction on unpermitted days and after hours.
Additionally, noise and glare from large trucks/heavy machinery and lack of dust
mitigation were noted. These nuisances were attributed to the pre-installation of lawn
crypts that was recently completed. According to Pacific View, the pre-installation and
marking of lawn crypts are now a common practice with many cemeteries throughout the
country. It involves burial of a large quantity of cement vaults at one time in advance of
their use. When a plot is used, the practice speeds up individual grave preparation and
minimizes the disruption time for each burial preparation. The pre-installation of these
vaults also allows more efficient and precise burial locations and minimizes potential
miss-interments and plot settlement over time. Once the vaults are installed, they are
surveyed and markers are placed. When a burial is performed, the plot is located and
individual caskets are placed within the vaults with limited disturbance of the lawn area.
No building or grading permit is required for the earthwork or installation of the vaults.

holidays. Although Pacific View is aware of these restrictions, they have re-doubled their
commitment to operate the memorial park consistent with the construction and property
maintenance requirements of the Municipal Code. Pacific View also has offered to
purchase a limited number of trees to be planted within the common area adjacent to the
concerned resident's home to enhance screening of activities within the park. The trees
would be maintained by the resident's Home Owner Association (HOA). The resident is
agreeable to the offering and is in the process of getting approval from the HOA.
After reviewing the attached annual report, applicable documents, and the commitments
offered to address nuisance issues, staff believes that Pacific View has operated the
facility in good faith compliance with the terms and conditions of the Development
Agreement.
ENVIRONMENTAL REVIEW
This annual review is exempt from the California Environmental Quality Act ("CEQA")
pursuant to Section 15321, Class 21 (Enforcement Actions by Regulatory Agencies) of
the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has
no potential to have a significant effect on the environment. This section exempts actions
by regulatory agencies to enforce or revoke a lease, permit, license, certificate, or other
entitlement for use issued, adopted, or prescribed by the regulatory agency or
enforcement of a law, general rule, standard, or objective, administered or adopted by the
regulatory agency.
PUBLIC NOTICE
Notice of this review was published in the Daily Pilot, mailed to all owners of property
within 300 feet of the boundaries of the site (excluding intervening rights-of-way and
waterways), including the applicant, and posted on the subject property at least 10 days
before the scheduled hearing, consistent with the provisions of the Municipal Code.
Additionally, the item appeared on the agenda for this meeting, which was posted at City
Hall and on the City website.

14 days following the date of action. For additional information on filing an appeal, contact

We have the following response to the status update request by the city. The last major project was
undertaken in 2014. This was the community mausoleum project in Building Site `G'. The building
was completed in the fall of 2014.
Pacific View has received complaints in the past year from one homeowner, Ms. Leslie Feibleman, who
lives on the north side of the cemetery, about noise from occasional burial operations and garden
installation and maintenance. The City staff determined that we were exceeding the noise limit ordinance
of 70 dBa with leaf blowers and occasionally with other equipment. We have worked with City staff and
our third party maintenance company to purchase appropriate equipment and monitoring devices to
resolve this violation. Recently, the complaints from Ms. Feibleman have increased. Our monitoring
equipment has indicated that we are below the required maximum decibel level of 70 dBa for the
maintenance equipment being operated such as trimmers, edging devices and mowers. We are also
working in this area to maintain existing landscaping. There have been no new garden installation
projects within 300 feet of the Feibleman residence. It is important to note that we have not received
complaints from any of the other 4 to 5 residents directly adjacent to our northerly boundary.
Another homeowner, a Mr. Leonard Fish, who lives behind out southeastern boundary, has occasionally
complained about the landscape areas behind his house. Mr. Fish cannot see the cemetery grounds due to
an existing buffering hedge installed at his request per the 1996 Development Agreement. Pacif c View
responds to Mr. Fish's concerns as necessary. Most recently, we needed to replant some ground cover in
a small bare patch on the slope behind his residence. .
Pacific View will continue to be responsive to the adjacent residents and address issues as necessary.
A. Development Agreement No. 7
3.1 Negative Declaration Mitigation Measure
3.1.1 All buffer area landscaping previously installed continues to be maintained by the
cemetery.

Pacific View has continued to maintain the undeveloped areas on a twice-yearly basis.
Occasionally calls are received from adjacent residents on specific issues. The concerns
are immediately addressed by Pacific View.
3.1.10 Drilling and Engraving
To our knowledge no complaints have been received by Pacific View on the drilling and
engraving of crypt markers due to Pacific View's compliance with the Development
Agreement.
3.2 Use Permit No.3518—Conditions of Approval
3,2.1 Family Mausolea
No new family mausoleums have been constructed since 2015.
3.2.2 Administrative Offices
No administrative office construction has been undertaken since 2011.

4.0 Public Benefit Conditions
4.4 All required landscaping and screening of Sunset Court was completed in 1995 and has
continued to be maintained.
4.5 Minimum of 30 months between phases and 9 months maximum to complete community
mausolea projects.
4.6 Twenty-six (26) 15-gallon trees were required to be planted in Area 8 per the
Development Agreement. This was completed in 1996 when thirty-one (31) trees were
planted. As of January 1, 2007 twenty-six (26) trees have survived. This meets the
required number of trees.

Buffer Zone Grading and Landscaping
a. All buffer zone grading, landscape and irrigation was completed in 1996.
4.7 Offsite Landscaping
a. All off site landscaping requirements were completed in 1996.
4.9 430 Foot Covenant
Pacific View has continued to maintain this area. Existing plant material placed by
homeowners in past years is pruned upon request of the affected homeowners as a
courtesy since they planted these shrubs.
4.10 Ground Burial
a. Building Site `B' — Building Site `E' remains undeveloped. There are no plans for
development in 2017 at this time.
b. Other Building Sites —Pacific View is in compliance with the provisions of
this section. Building site `G' had an expansion to the existing community
mausoleums of 3,591 s.f. which was completed in fall of 2014. A small
burial garden estate project has recently been completed consistent with the
Development Agreement.
c. Ground Burial Outside of Building Sites:
1) Developed Areas 1 to 11 Pacific View is in full compliance with this
section. The remainder of Area 10 was developed into lawn area in early
1997. The remainder of Area 11 was developed in 2006. Area 8 remains
undeveloped and is not anticipated for cemetery development in 2017.
B. First Amendment to Development Agreement No. 1 (See Related Item No. in Amendment)
12. The buffer zone has been planted consistent with these requirements.
14. The slopes behind the family mausolea in Building Site `H' have been graded and
landscaped in conformance with Exhibit `F' and the City has inspected and provided final
approval.
15, 16, 19. The community mausoleum completed in December 2008 complies with these
requirements.
20.f The two family mausoleums in Lot 3 and Lot 6 of Building Site `H' comply with this
requirement and have been completed.
20.g The recently completed estate gardens comply within this requirement.

and recorded.

The issue is with frequency, high decibel level, duration, loud revving, excessive use of mechanical equipment,
piercing noises and vibrations.
When the noise disturbances are taking place,we can no longer work, rest, eat, talk on phone,have guests over, have
windows open, etc... I am forced to leave my home for several hours each week. The noise causes major stress,
inconvenience, headaches.

The noise scares away the birds and all sounds of nature,which we enjoy.
Air Pollution/Noxious Fumes/Dust
Created by leaf blowers,mowers (gas fumes, debris,pesticides, dust)
Grass fumes are especially strong(forces us to go inside, close all windows).
Burning incenses utilized by PVMP guests (perfumed, toxic,nauseating)forces us to close our windows
Mass installation of fertilizer(try eating dinner with a cow poop stench in your home/yard)
SMOKING!!! The high density crypts layout is bringing out smokers who are polluting our air and causing a
nuisance.
Our property is upwind so we are forced to smell and inhale the bi products of PVMP and their guests. It is gross!!!
Pesticides
Commercial fertilizers were used by PVMP near our home on windy days with truck and large sprayer. This is a
huge health hazard. This can result in pesticide drift and pesticide trespassing which is dangerous. We are growing
an organic edible garden in our yard and do not want toxic chemicals blown into our yard or transferred here.
Privacy
The crypts were installed way too close to our properly (3'-5') and too high in relation to our property, creating a
HUGE privacy problem. They did not allocate enough space adjacent to our property to plant an adequate buffer
zone. We fought this back in 1994/2007 and requested a 30'buffer, but our requests to create a proper setback/buffer
were ignored by PVMP and the City. Refer to plans or come over and see it in person.
Glare
The parked cars along the road and vertical headstones/plaques are creating blinding glare nuisances.
Construction Practices
All projects need inspections,mitigation of dust measure, monitoring of hours, timely notifications needed to warn
residents. The projects last for weeks at a time and create nuisance.
Sundays

We have had to call the City and PVMP on several occasions for loud noise on Sundays.
Aesthetics
Large photos of the deceased mounted on plaques (creepy), large font signage of names and tacky decorations
(helium balloons, etc...) are visible from our home.
Other issues that should be addressed:
Sustainability (not consistent with the rest of the City)
OVERVIEW
On the PVMP site adjacent to our property, an excessive and intolerable amount of leaf blowing, mowing, edging,
engraving, construction activities are creating high decibel, ear piercing noise, air pollution, noxious gases. The
average weekly noise disturbance time is 25 hours, and often occurs 6 hours at a time, on weekends and in the early
evening (5:00pm- 6:30pm) after the PVMP staff is gone. The noise often exceeds the allowable exterior and interior
decibel limits set by the CNB. On a daily basis, we are forced to close all of our windows and doors and stop normal
activities. Our 17-year old son's room is closest to the site. With school in session, he now lacks a quiet place in our
home to do his homework. About 3-4 times per week, I have to leave our home after getting major headaches and
experiencing (unprecedented) anxiety from the noise. Noise this loud and piercing is a form of torture and is a risk to
one's health and safety. With the natural afternoon wind direction blowing from south to north, the toxic gas fumes,
dust pesticides and fertilizer residues,as well as the overwhelming grass and incense smells blow into our yard(where
we are growing organic food) and into our home where we eat, live and sleep. With the windows closed the noise is
still very loud and intolerable. I can hear it over my Spotify headphone music and over the TV. It interrupts our work,
conversations, our peace, our meals, our lives. There is no way to escape it or mitigate from our end. On hot days with
the windows closed, we cannot enjoy the natural breezes, but have to run the AC, which is expensive. Our lives have
been completely disrupted. The maximum wall height that we can build on the perimeter of our property is 3'. PVMP
was given the freedom by the CNB to build the crypts too close to our home,without proper monitoring of the negative
impacts of privacy, noise and pollution issues generated by the landscape maintenance. The lack of proper setback,
landscape buffer and the building up of natural grade elevation levels(to maximize PVMP "ocean view"sites)during
the plan review process in the area next to Seaview has resulted in a detrimental impact to our family and our property
value. We are not protected from the damaging effects. PVMP is `over' manicuring their garden crypt sites in order to
achieve to a ridiculous level of perfection. The use of loud machinery to achieve this goal is creating excessive noise
and fumes. The excessive use of water,pesticides and fertilizers is also a concern. Our past requests for improvements
of the situation have been challenged, ridiculed, dismissed and overlooked. Bottom line: The proximity, frequency,
decibel level, disrespect,negative health impacts are completely unacceptable. This is an urgent issue.
CEQA Exemption should be reevaluated, as this project has created numerous environmental hazards.

TYPICAL NOISE ATTENUATION METHODS: Noise impacts can typically

CHAPTER 1 . FINDINGS, DECLARATIONS, AND INTENT
46000. The Legislature hereby finds and declares that:

(b) Exposure to certain levels of noise can result in physiological,
psychological, and economic damage.

NOTES
The Development Agreement fails "to provide assurance to adjoining property
owners that restrictions and conditions designed to mitigate the impact of
development ......will remain in force" (1 .6)
DA needs to reevaluated, updated, modified to properly address current,
adverse, unanticipated effects on adjoining residences that are missing from the
document. Ambiguous language in the document needs to be removed. (Area G
setbacks, buffer zone)
Per the suggestion of Dave Kiff, we request that PVMP creates Good Neighbor
policy that addresses the aforementioned concerns. We are open to meet with
PVMP and work together on solutions.
We request PVMP to explore and implement sustainable, quiet maintenance
options for the areas adjacent to our properties.
