Independent contractors working for the Recreation & Senior Services Department to provide diverse educational, recreational and cultural programs to the community while minimizing costs to the City Sole Proprietors to Corporations Constitute 90% of the classes /camps in the Newport Navigator Design and implement course curriculum, content, and the entire learning process as it relates to their class Independent Contractors in Newport Beach Contract with the City, signing an Independent Contractor Agreement annually 120 Total Instructors 100 additional representatives /employees work for the Independent Contractors Receive a pre- negotiated percentage of revenue collected upon completion of the class /camp. Based upon instructor overhead costs, including staff, participant ratios, supplies, marketing materials, insurance costs, market prices of program Instructors percentage 60 -75% City percentage 25 -40% Instructors must obtain a Newport Beach business license to conduct business in Newport Beach Benefits of Independent Contractors Safe, quality, diverse, and affordable programs offered to the community with no start up costs to the City L Specialized skill set or training o Continuity and retention exists o Creates community by bringing people together o Instructors must obtain a general liability insurance policy of $1 million with additional insured end. Registration fees will be based on an amount sufficient to acquire independent contractors, class materials and the administrative overhead and a facility use fee. Occasionally, it may be necessary to conduct a specific class in which revenues are not sufficient to be self- supporting. However, each total recreation program, such as tennis, sailing, surfing, etc., will be at least self- supporting. The Recreation and Senior Services Director or designee is authorized to enter into agreements for securing independent contractors for approved instructional recreation activities. A. Except as otherwise provided in this section, no person shall use any public street, sidewalk, alley or parkway or other public property for the purpose of storing or displaying any equipment, materials or merchandise, or any other commercial purpose. It is the policy of the City of Newport Beach to allow maximum public use of the City's public park facilities subject to rules and regulations necessary for administration and maintenance of parks and facilities. All persons using the City's public park facilities shall comply with the provisions of this chapter. The Director of Recreation and Senior Services shall be the City official primarily responsible for administering the use of the City's public park facilities and shall be authorized to establish and enforce all applicable codes, policies rules and regulations regarding the use and administration of public park facilities within the City of Newport Beach. (Ord. 2004 -26 § 3 (part), 2004) Contracting Procedures Potential candidate submits an Instructor Application form to the City Recreation & Senior Services Office Applications are reviewed in the order received Potential Instructors are brought in for an oral interview Determined by the demand for classes & facility availability Staff conducts a reference check Professional & Internet search Staff conducts an instructor orientation & Develops a Contract Review policies & procedures Coordinate & determine class specifications /logistics (location, fees, age, class size, dates, days, time) Undergo background investigation through the Newport Beach Police Department & Department of Justice Attend annual instructor meeting/training Staff conducts periodic audits Selection Criteria of Instructors • Oral Interview of candidate • Demand for program - participation o Quality of instructor Experience & education in related field Demonstration of understanding of specific programs Demonstration of City values and dedication to customer service Commitment to ensure a successful program & safety exists Certifications & professional affiliations Schedule c Other departments feedback on program Lifeguards, General Services Number of years in operation c References �i Questions?
