I request that the following comments be entered into the record
for this meeting.
On October 21 st Lido residents were invited to an open house at
533 Via Lido Soud, to learn about a drug recovery facility that
Morningside Recovery LLP was setting up at that address.
Over one hundred Lido Isle residents showed up, for an improptu
meeting with City Manager David Kiff and Morningside Chief
Executive Officer Candace Bruce.
In conversations which followed David Kiff said that Morningside
was operating under a zoning agreement which was signed by
the City on September 28th.
But the zoning agreement states that it does not go into effect
until 91 days later, on December 28th. So, there is no such
agreement in affect until December 28th.
Asked why Morningside was being allowed to take possession
before that date, Mr. Kiff said something to the effect that he
allowed it to do so as a matter of convenience.
When asked if the presence of a drug recovery facility in Lido's
closely spaced residential community could impact the values of
nearby properties, he agreed that it very likely could do so.
In the meantime it has come to light that Morningside is taking
occupancy of the property on a lease which appears to be
improperly executed, and may prove to be invalid.
With all these things in mind we very strongly request the City to
require that Morningside cease all operation and quit the property,
at least until December 28th, but also until the validity of its lease
with the property owner is legally established.
