A. CALL TO ORDER—The meeting was called to order at 3:30 p.m.

D. PUBLIC HEARING ITEMS
ITEM NO. 1 Nekter Juice Bar Minor Use Permit No. UP2017-012(PA2017-089)
Site Location: 1620 San Miguel Drive Council District 6
Makana Nova,Associate Planner, provided a brief project description of the request to convert an existing retail
tenant space to a take-out service,limited eating and drinking establishment. Ms.Nova summarized the project,
stating the tenant space includes 1,080 square feet of gross floor area,422 square feet of net public area, and
a maximum of six seats. The proposed hours of operation are from 7 a.m. to 7 p.m. although staff
recommended a Condition of Approval allowing a closing hour of 9 p.m.for flexibility.She concluded with staffs
recommendation to approve the request noting that the business is compatible with the neighborhood
commercial zoning designation for the property.
Applicant, Steve Schulze, of Nekter Juice Bar, provided a brief overview of their business concept and noted
that they had reviewed the draft Conditions of Approval.
The Zoning Administrator inquired aboutthe parking requirementfor the establishment and Ms. Nova explained
that the proposed use is parked at the retail parking rate and does not require any additional waiver of parking
for the shopping center. The Zoning Administrator then asked the applicant if he was comfortable with the six
seat limitation for the establishment. Mr. LaClair responded that this is consistent with regular business
operation at various locations throughout Southern California.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.

ITEM NO.2 226 Orange Street Coastal Development Permit No. CD2017-026(PA2017-060)
Site Location: 226 Orange Street Council District 2
Liz Westmoreland, Assistant Planner, provided a brief project description stating that the request is for a
Coastal Development Permit to allow the construction of a 476 square foot addition and second story deck.
The project complies with all applicable development standards including height,setbacks,and floor area limits.
The project is consistent with the existing neighborhood pattern of development and expected future
development.The project is not located within 200 feet of coastal waters, nor is it located between the nearest
public road and the sea or shoreline and re-development will not affect public recreation, access, or views.
Applicant Bart Valdez of Bart Valdez&Associates, on behalf of the Owner, stated that he had reviewed the
draft resolution and agrees with all of the required conditions.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.
Action: Approved
ITEM NO. 3 Newport Beach Wellness Massage Services Minor Use Permit No. UP2017-002
(PA2017-008)
Site Location: 1501 Westcliff Drive Council District 4
Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a minor
use permit to maintain existing accessory massage services at a chiropractic office. Ms. Whelan continued
explaining that the massage service is provided as part of the chiropractic treatment.The chiropractic office is
permitted by right and the accessory massage now requires the approval of a minor use permit. The
chiropractic office has been in operation since 2013 within the existing multi-tenant office building with two
doctors, an office manager, and the ability to accommodate a maximum of two massage therapists at a time
based on need. There are no late hours of operation and Police Department has reviewed the proposal with
no objections. The applicant is in the process of obtaining a License from the Police Department. Ms.Whelan
concluded that she was able to make all of the required findings for approval.
Applicant Dr. Dadivas stated that she had reviewed the draft resolution and agrees with all of the required
conditions.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.
Action: Approved
ITEM NO.4 1706 East Ocean Front Coastal Development Permit No. CD2017-013(PA2017-030)
Site Location: 1706 E. Ocean Front Council District 1
Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a Coastal
Development Permit for demolition and re-construction of a single-family-dwelling with attached garage. Ms.
Whelan continued explaining that the development includes hardscape, drainage,and landscaping and meets
all applicable development standards.The existing developed site is on the oceanfront and the required coastal
hazards report was provided. The Report concluded that due to the substantial beach width between the water
and subject property impacts are not anticipated from wave run-up,high tide,storm waves and rise of sea level.
The applicant has completed the required Construction Pollution Prevention Plan and Water Quality and
Hydrology Plan, both reviewed and approved by City's Engineer Geologist. Ms. Whelan concluded that she
was able to make all of the required findings of Title 21.

The Zoning Administrator clarified for the record that any existing landscape improvements encroaching onto
the public beach are not included in, or authorized by,this application.
Applicant Carol McDermott, on behalf of the property owner, Mr. Burcher, stated that she had reviewed the
draft resolution and agrees with all of the required conditions.
The Zoning Administrator and Ms.Whelan clarified the appeal period.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.
Action: Approved
E. PUBLIC COMMENTS ON NON-AGENDA ITEMS

F. ADJOURNMENT
The hearing was adjourned at 3:46 p.m.
The agenda for the Zoning Administrator Hearing was posted on May 19, 2017, at 3:00 p.m. in the
Chambers binder and on the digital display board located inside the vestibule of the Council
