➢Tranchise regulations related to operating near
high -traffic facilities, such as schools and
churches, and vehicle safety of collection trucks
operating in the City
Current Collection System
➢Non-exclusive franchise system
• Scheduled commercial service and
construction/demolition haulers are treated
the same
• Haulers required to divert 55% of collected
material
• Franchises scheduled to end on November 8,
2017
Goals for the New Franchise Agreements
➢Ensure compliance with state law regarding
mandatory commercial recycling (MCR)
and mandatory organics recycling (MORe)
➢Promote an even playing field between
haulers and hold haulers who don't meet
standards accountable

California Green Building Code
➢With City acceptance of the Green Building
Code, the owner/builder of a construction
project is required to divert 65% of
construction waste.
City Responsibilities
➢Local agencies are responsible for implementing a
commercial and organics recycling program and
for documenting that AB 341 and 1826
requirements are being met.
➢The City is required to annually report to
CalRecycle the hauler collecting at each location,
where the material is being disposed/processed,
and whether or not the applicable waste stream is
being diverted.

roll -offs or end -dumps will be required to divert 65%
of the collected material to comply with the Green
Building Code.

Proposed Franchise Timeline
➢June 27 Study Session: Update City Council and
receive feedback
➢July: Meet with haulers and present changes
➢August 8: First reading of Ordinance for franchise
changes
➢September: Approval of Ordinance
➢October: City Council approval of hauler franchises
➢November 9: New franchises become effective
