Re: Council Reconsideration of declining SB -1 Gas Tax funds
Dear Mayor Muldoon & City Council Members:
At the meeting of the Newport Beach Chamber of Commerce Board of Directors on August 28,
the Board discussed the City Council's action to decline acceptance of approximately $481,309
in funding from the state as the City's allocation of the anticipated gas tax proceeds due to the
City of Newport Beach as a result of the passage by the State Legislature of SB -1. By a
unanimous vote, the Board instructed me to write a letter to you requesting that you consider
rescinding your action taken on August 8, 2017 and that further discussion should occur either at
a future City Council meeting or by referring the matter back to the City's Finance Committee
for guidance.
Although the sentiment of the Board was that they are opposed to the increase in the gas tax as
approved by SB -1, the Board members felt that our residents shouldn't be penalized for the sake
of making a statement that the City of Newport Beach opposes the tax. Currently, we are a
donor City when it comes to all forms of taxes collected by the County and the State. Declining
our share of the gas tax increment would only put us further in the hole.
The Board's position is that a more effective way of fighting the increase in the gas tax and
expressing our opposition would be to accept the funds and use off -setting General Fund money
to aid in the effort to repeal SB -1 altogether.
We are encouraged that a Special Meeting of the City Council has been called for later today to
discuss rescinding Council's previous action and instead, making an application for the road
improvement funding.

street repairs. I am discouraged that you continuallysupport decisions that are not in the best interest of our

I know for a fact that every email I send you I speak for a hundred people in Newport Beach. We want the

Please feel free to send whatever message you, as individuals, wish to send to Governor Brown. But not on behalf
of all Newport Beach voters.
Until such time as the voters have a say at the ballot box as to whether or not the Gas Tax should be repealed,
please vote to accept the funds that Newport Beach voters have paid and use them as intended for Newport
Beach roadwork projects.
And calling an Emergency Meeting on this, or any matter, within 24 hours (as is your right) and so close to a
holiday weekend, precludes a full and robust public hearing on this matter, which is contradicts your campaign
pledges of open and transparent governance in Newport Beach.
I hope that the majority of you will reconsider your vote taken on August 8.
