RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; b) Authorize the City Council to accept a $300,000 Selective Traffic Enforcement Program ("STEP") award granted to the Newport Beach Police Department by the OTS per Council Policies F-3 and F-25. To comply with Council Policy F-3, City Council must formally accept the award of $300,000 and create a new appropriation to expend the money; and c) Approve Budget Amendment No. 18BA-004 increasing Police revenue estimates and expenditure appropriations by $300,000. FUNDING REQUIREMENTS: The Budget Amendment records and appropriates $300,000 in additional revenue from the OTS STEP Grant and $300,000 in increased expenditure appropriations. Newport Beach consists of rugged coastline, inland waterways, and has a diverse mix of commerce, tourism and distinct residential communities. Newport Beach routinely competes with other cities for the most Department of Alcoholic Beverage Control licensed establishments in the State of California (per capita). The population of Newport Beach is approximately 87,000 residents; however, during the summer months the City experiences an increase in daily visitors that routinely exceeds 100,000 visitors each day. While this tourist population generates positive tax revenue for the City, it also stresses infrastructure and departments, including the Police Department. In 2007, our first grant was requested and awarded through OTS. Since then, the department has been dedicated to the reduction of DUI related collisions, community education and enforcement. The City and Police Department continue to recognize the need for ongoing DUI enforcement and education. The most recent data (2014) supplied from the California Office of Traffic Safety (OTS) revealed the City of Newport Beach was in the top 14 percent of similar -sized California cities in several collision -related categories, including Nighttime Injury Collisions, Alcohol -Involved Collisions and Bicycle -Involved collisions. Newport Beach was also in the top 13 percent in motorcycle collision injuries per capita. Grant number PT18102 will become effective October 1, 2017 and will expire September 30, 2018. The grant funds will pay for overtime costs for officers specifically assigned to DUI enforcement and awareness programs, including two DUI checkpoint operations, traffic enforcement operations related to distracted driving, motorcycle safety and bicycle/ pedestrian enforcement operations. In-state travel and training expenses are also included in the grant for officers attending the DUI Checkpoint Management Seminar, Standardized Field Sobriety and Advanced Roadside Impaired Driving training courses. The "Know Your Limits" program is a part of the grant again this year. In its third year, the "Know Your Limits" program is a collaborative effort between the Police Department and ABC -licensed establishments to educate patrons about the dangers of drinking and driving. It is designed to have the Police Department provide patrons with breath tests in order to learn their blood alcohol concentration, allowing them to "Know Your Limit" before they consider driving after consuming alcohol. Almost all DUI efforts involve overtime, as they are unique and short-term assignments that do not involve the personnel normally scheduled during DUI enforcement shifts. In other words, we retain the same number of officers on patrol even as we have other officers work a DUI enforcement activity. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). PROBLEM STATEMENT The city of Newport Beach is a unique and dynamic community that is blessed to be located along the scenic coastline of Southern California. The city and surrounding area are deeply rooted in history. At approximately 51 square miles, including areas of water, Newport Beach consists of rugged coastline, inland waterways, and has a diverse mix of commerce, tourism, and distinct residential communities. As charming as our town is, it is also a hot spot for Orange County night life. Newport Beach routinely competes with other cities for the most Department of Alcoholic Beverage Control (ABC) licensed establishments in the State of California (per capita). In Newport Beach, the ratio of ABC licensed establishments to the population of that area varies from 1:38 (Reporting District 15) to 1:194 (Newport Beach as a whole). This is in contrast to Orange County, which enjoys a ratio of 1:505, or statewide (1:381). The population of Newport Beach is approximately 86,000 residents; however, during the summer months the city experiences an increase in daily visitors that routinely exceeds 100,000 visitors each day. While this tourist population generates positive tax revenue for the city, it also stresses city infrastructure and departments, to include the police department. Our first grant was requested and awarded through OTS in 2007. Since then, the department has been dedicated to the reduction of DUI related collisions, community education, and enforcement. The City and Police Department continue to recognize the need for ongoing Traffic and DUI enforcement and education. The most recent data (2014) supplied from the California Office of Traffic Safety (OTS) revealed the City of Newport Beach was in the top 10% of similar -sized California cities in Alcohol and Bicycle Involved collisions. The same data indicates Newport Beach is in the top 20% in the categories of Motorcycle collisions and Bicycle collisions involving persons older than 15. Newport Beach also ranks within the top 20% in collisions related to speed. Newport Beach markets itself, among other things, as a "destination location" and attracts visitors from all over the region, state, and world. Certainly, the daily increase in population, including people who don't live in Newport Beach, but come to our city to work, shop, visit, dine, recreate, go to the beach or enjoy other water -related activities, bicycle through or pass through on their way to another location, and for other reasons, is a component of our current rankings. To provide ongoing enforcement and education to our residents, businesses, and visitors, and to pursue increased roadway safety for all users, we will continue to utilize OTS grant funding to combat DUI, DUI/Drugs, and alcohol -involved driving; distracted driving, primary collision factors, motorcycle -related driving violations, and bicyclist, motorist, and pedestrian -related violations. 2. PERFORMANCE MEASURES A. Goals: 1. Reduce the number of persons killed in traffic collisions. 2. Reduce the number of persons injured in traffic collisions. 3. Reduce the number of pedestrians killed in traffic collisions. 4. Reduce the number of pedestrians injured in traffic collisions. 5. Reduce the number of bicyclists killed in traffic collisions. 6. Reduce the number of bicyclists injured in traffic collisions. 7. Reduce the number of persons killed in alcohol -involved collisions. 8. Issue a press release announcing the kick-off of the grant by November 15. The kick-off 1 press releases and media advisories, alerts, and materials must be emailed to the OTS Public Information Officer at pio@ots.ca.gov, and copied to your OTS Coordinator, for approval 14 days prior to the issuance date of the release. 2. Participate and report data (as required) in the following campaigns, National Walk to 10 School Day, NHTSA Winter & Summer Mobilization, National Bicycle Safety Month, National Click it or Ticket Mobilization, National Teen Driver Safety Week, National Distracted Driving Awareness Month, National Motorcycle Safety Month, National Child Passenger Safety Week, and California's Pedestrian Safety Month. 3. Develop (by December 31) and/or maintain a " HOT Sheet" program to notify patrol and 12 traffic officers to be on the lookout for identified repeat DUI offenders with a suspended or revoked license as a result of DUI convictions. Updated HOT sheets should be distributed to patrol and traffic officers monthly. 4. Send law enforcement personnel to the NHTSA Standardized Field Sobriety Testing 5 (SFST) (minimum 16 hours) POST -certified training. 5. Send law enforcement personnel to the NHTSA Advanced Roadside Impaired Driving 2 Enforcement (ARIDE) 16 hour POST -certified training. 6. Send law enforcement personnel to the Drug Recognition Expert (DRE) training. I 7. Send law enforcement personnel to the DRE Recertification training. I 8. Send law enforcement personnel to SFST Instructor training. 1 9. Conduct DUI/DL Checkpoints. A minimum of 1 checkpoint should be conducted during 2 the NHTSA Winter Mobilization and 1 during the Summer Mobilization. To enhance the overall deterrent effect and promote high visibility, it is recommended the grantee issue an advance press release and conduct social media activity for each checkpoint. For combination DUI/DL checkpoints, departments should issue press releases that mention DL's will be checked at the DUI/DL checkpoint. Signs for DUI/DL checkpoints should read "DUI/Driver's License Checkpoint Ahead." OTS does not fund or support independent DL checkpoints. Only on an exception basis and with OTS pre -approval will OTS fund checkpoints that begin prior to 1800 hours. When possible, DUI/DL Checkpoint screeners should be DRE- or ARIDE-trained. 10. Conduct DUI Saturation Patrol operation(s). 114 11. Conduct Warrant Service operation(s) targeting multiple DUI offenders who fail to appear 1 in court. 12. Conduct Traffic Enforcement operation(s), including but not limited to, primary collision 32 factor violations. 13. Conduct highly publicized Distracted Driving enforcement operation(s) targeting drivers 8 using hand held cell phones and textin . 14. Conduct highly publicized Motorcycle Safety enforcement operation(s) in areas or during 4 events with a high number of motorcycle incidents or collisions resulting from unsafe speed, DUI, following too closely, unsafe lane changes, improper turning, and other primary collision factor violations by motorcyclists and other drivers. 15. Conduct highly publicized pedestrian and/or bicycle enforcement operation(s) in areas or 10 during events with a high number of pedestrian and/or bicycle collisions resulting from violations made by pedestrians, bicyclists, and drivers. 16. Conduct Traffic Safety educational presentations with an effort to reach community 2 members. Note: Presentations may include topics such as distracted driving, DUI, speed, bicycle and pedestrian safety, seat belts and child passenger safety. 17. Conduct Know Your Limit campaigns with an effort to reach members of the community. 10 3. METHOD OF PROCEDURE A. Phase 1— Program Preparation (V Quarter of Grant Year) • The police department will develop operational plans to implement the "best practice" strategies outlined in the objectives section. • All training needed to implement the program should be conducted this quarter. • All grant related purchases needed to implement the program should be made this quarter. 9/5/2017 1:15:15 PM Page 4 of 14 15-7 • In order to develop/maintain the "Hot Sheets," research will be conducted to identify the "worst of the worst" repeat DUI offenders with a suspended or revoked license as a result of DUI convictions. The Hot Sheets may include the driver's name, last known address, DOB, description, current license status, and the number of times suspended or revoked for DUI. Hot Sheets should be updated and distributed to traffic and patrol officers at least monthly. • Implementation of the STEP grant activities will be accomplished by deploying personnel at high collision locations. • Media Requirements • Issue a press release announcing the kick-off of the grant by November 15. The kick-off press releases and media advisories, alerts, and materials must be emailed to the OTS Public Information Officer at pio@ots.ca.gov, and copied to your OTS Coordinator, for approval 14 days prior to the issuance date of the release. B. Phase 2 — Program Operations (Throughout Grant Year) • The police department will work to create media opportunities throughout the grant period to call attention to the innovative program strategies and outcomes. • Media Requirements • Send all grant -related activity press releases, media advisories, alerts and general public materials to the OTS Public Information Officer (PIO) at pio@ots.ca.gov, with a copy to your OTS Coordinator. • If an OTS template -based press release is used, the OTS PIO and Coordinator should be copied when the release is distributed to the press. If an OTS template is not used, or is substantially changed, a draft press release shall be sent to the OTS PIO for approval. Optimum lead time would be 10-20 days prior to the release date to ensure adequate turn -around time. • Press releases reporting the results of grant activities such as enforcement operations are exempt from the recommended advance approval process, but still should be copied to the OTS PIO and Coordinator when the release is distributed to the press. • Activities such as warrant or probation sweeps and court stings that could be compromised by advanced publicity are exempt from pre -publicity, but are encouraged to offer embargoed media coverage and to report the results. • Use the following standard language in all press, media, and printed materials: Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration. • Email the OTS PIO at pio@ots.ca.gov and copy your OTS Coordinator at least 30 days in advance, a short description of any significant grant -related traffic safety event or program so OTS has sufficient notice to arrange for attendance and/or participation in the event. • Submit a draft or rough -cut of all printed or recorded material (brochures, posters, scripts, artwork, trailer graphics, etc.) to the OTS PIO at pio@ots.ca.gov and copy your OTS Coordinator for approval 14 days prior to the production or duplication. • Include the OTS logo, space permitting, on grant -funded print materials; consult your OTS Coordinator for C. METHOD OF EVALUATION Using the data compiled during the grant, the Grant Director will complete the "Final Evaluation" section in the fourth/final Quarterly Performance Report (QPR). The Final Evaluation should provide a brief summary of the grant's accomplishments, challenges and significant activities. This narrative should also include whether goals and objectives were met, exceeded, or an explanation of why objectives were not completed. 5.
