TITLE: Appointment of Board Member and Alternate Board Member to the
Metro Cities Fire Authority
ABSTRACT:
As a member of the Metro Cities Fire Authority, Joint Powers Authority (JPA), the City of
Newport Beach holds two appointed Board positions. Of the two positions, one position
is that of a voting member and the second serves as an alternate. Upon appointment, by
the Newport Beach City Council, the Board members hold the position continuously and
at the pleasure of the City Council. This action will select the Assistant City Manager and
Fire Chief as the Board member and Alternate Board Member.
RECOMMENDATION:
a) Determine that the action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because it will not result in a physical change to the environment, directly or indirectly;
and
b) Appoint the Assistant City Manager as the voting member and the Fire Chief as the
Alternate. The Metro Cities Fire Authority rotates Fire Chiefs on the Board every two
years. When the Newport Beach Fire Chief is eligible to be on the Board as a voting
member, the Assistant City Manager will be the alternate.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
Metro Cities Fire Authority ("Metro Cities") was created on July 1, 1996 per a Joint Powers
Agreement among the Cities of Anaheim, Fountain Valley, Fullerton, Garden Grove,
Huntington Beach, Newport Beach and Orange. The Metro Cities Member Agencies
provide fire protection, fire prevention, rescue, emergency medical services and related
administrative services within their respective boundaries. The primary purpose of the
JPA is to provide for the operation, upgrade, maintenance and repair of the
Communications Center and communications equipment.

Pursuant to Section 4.2 of the Joint Powers Agreement, the Metro Cities Board consists
of one (1) voting member and one (1) alternate appointed by the governing body of the
Member Agency. Each Board member holds office from the first meeting of the Metro
Cities Board after appointment and serves at the pleasure of the appointing authority.
Previously, the City of Newport Beach was represented by the Assistant to the City
Manager and the Fire Chief serving as its Alternate Board Member. Staff requests
appointment of the Assistant City Manager to be its Board Member and the Fire Chief to
be the Alternate Board Member. Should the Fire Chief become the Board member, the
Assistant City Manager will become the Alternate Board Member. Neither Board member
receives compensation from this appointment.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
