TITLE: Annual Concrete Replacement Program: FY17 — Notice of
Completion for Contract No. 7009-1 (17R06)
ABSTRACT:
On December 13, 2016, City Council awarded Contract No. 7009-1, for the Annual
Concrete Replacement Program project, to S&H Civilworks. The work is now complete
and staff requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project. On December 13, 2016, the City Council found this project exempt
from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section
15302(c);
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one (1) year after acceptance by the City Council.

The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final contract cost was $69,698.63 (9.4 percent) more than the original bid amount.
This cost increase was primarily due to directed changes in the quantity for additional
concrete cross gutter replacements and the addition of four curb access ramps in the
Mariner's, Dover Shores and Bay Knolls communities, as well as approved contract
change orders.
This project included two change orders for a total amount of $37,913.63, which was
approximately 5.1 percent of the original bid amount. The change orders were issued to
include construction of an Urban Runoff Capture System at the Newport Aquatic Center,
which was at the request of the Water Quality/Coastal Tidelands Council Sub -Committee,
removal of eight additional trees that were causing significant damage to adjacent
sidewalks and replacement of some curb and gutter on Balboa Island.

ENVIRONMENTAL REVIEW:
On December 13, 2016, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302(c) (reconstruction
of existing facility involving negligible or no expansion of capacity) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
