The recommended changes include: Balboa Boulevard (East) • The south (ocean side) of Balboa Boulevard from A Street to G Street will be swept on Tuesdays between 8:30 a.m. and 12:30 p.m., while the remainder of the south (ocean side) of Balboa Boulevard from G Street to Channel Road will continue to be swept on Mondays between 8:30 a.m. and 12:30 p.m.; Avocado Avenue • Both sides of Avocado Avenue from East Coast Highway to Pacific Drive, including center medians, will swap sweeping days (resulting in sweeping on Wednesday for the east side of Avocado and Tuesday for the west side of Avocado) with both occurring between 9:30 a.m. and 12:30 p.m.; RECOMMENDATION: a) Determine the action is exempt from California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2017-66, A Resolution of the City Council of the City of Newport Beach, California, Designating the Streets or Portions Thereof on which the Parking or Standing of Vehicles is Prohibited and the Specific Days and Hours of Such Prohibition to Improve Street Sweeping Effectiveness, and Rescinding Resolution No. 2017-14. 5-1 Resolution to Revise Street Sweeping Parking Restrictions October 10, 2017 Page 2 FUNDING REQUIREMENTS: There is no fiscal impact to the General Fund as the current budget for Street Maintenance can absorb the costs to modify the no parking signs and modified schedule. DISCUSSION: Prior to Fiscal Year 2014/2015, refuse containers on Balboa Boulevard were taken to the curb by the residents and placed either on the sidewalk or on the landscape adjacent to the curb. City staff would then pick up each container by hand and empty them into waste collection vehicles. As the trashcans were not in the street, the street sweeper contractor (Athens) could sweep the streets on Balboa Boulevard on the same day as refuse was collected by City personnel. In 2014, the City entered into a contract with CR&R to collect the refuse from all residential property in Newport Beach. As CR&R utilizes automated refuse collection vehicles, every resident in Newport Beach was given larger trashcans that could be wheeled to the street. These containers must be placed on the street for trash collection due to the design of the waste collection vehicles. This has resulted in trashcans being placed in the street on street sweeping day. As such, Athens has to sweep around the trashcans resulting in litter being left in the gutter. City staff has reviewed what actions could be taken so that debris can be routinely removed from the street gutters. Staff recommends that switching the days of the week for sections of Balboa Boulevard (East) and Avocado Avenue would best solve conflict between refuse collection and street sweeping. Staff has also reached out to the community associations of each area to discuss and notify residents regarding the changes. Current Street Sweeping Schedule for Balboa Boulevard (East) The south side of Balboa Boulevard from A Street to G Street are being swept on Mondays from 8:30 a.m. to 12:30 p.m. (Attachment A). Proposed Change to Street Sweeping Schedule for Balboa Boulevard (East) The south side of Balboa Boulevard from A Street to G Street would be swept on Tuesdays from 8:30 a.m. to 12:30 p.m. (Attachment A). Current Street Sweeping Schedule for Avocado Avenue (South Bound) The west side of Avocado Avenue from East Coast Highway to Pacific Drive are being swept on Wednesday from 9:30 a.m. to 12:30 p.m. (Attachment B). Proposed Change to Street Sweeping Schedule for Avocado Avenue (South Bound) The west side of Avocado Avenue from East Coast Highway to Pacific Drive would be swept on Tuesdays from 9:30 a.m. to 12:30 p.m. (Attachment B). Current Street Sweeping Schedule for Avocado Avenue (North Bound) The east side of Avocado Avenue from East Coast Highway to Pacific Drive are being swept on Tuesdays from 9:30 a.m. to 12:30 p.m. (Attachment B). 5-2 Resolution to Revise Street Sweeping Parking Restrictions October 10, 2017 Page 3 Proposed Change to Street Sweeping Schedule for Avocado Avenue (North Bound) The east side of Avocado Avenue from East Coast Highway to Pacific Drive would be swept on Wednesday from 9:30 a.m. to 12:30 p.m. (Attachment B). The proposed Resolution includes an administrative clean up regarding parking restrictions on Via Lido Nord and Via Lido Soud. After the City Council adopted Resolution No. 2015-73 on September 8, 2015, Lido Isle HOA and its residents voiced their concerns about the change to the proposed parking restrictions and street sweeping schedule. After further thought, the residents felt the change may reduce available parking and elected to move their cans from the roadway to allow street sweeping on the same day. As a test, the residents requested the City not make the change and over the last two years, it has worked well. The proposed Resolution No. 2017-66 formally undoes the change. Why a new Resolution? Due to the numerous parking restrictions related to street sweeping, it becomes difficult to track changes if each change was done individually by resolution. Staff recommends rescinding the previous street sweeping parking restriction resolution and adopting a new resolution. This makes it easier for the public and staff to clearly see all of the street sweeping parking restrictions in one place. As required by California Vehicle Code section 22507.6, the City will post notices of the parking prohibitions in a conspicuous place at each entrance to the street or portion thereof with a notice not less than 17 inches by 22 inches in size, with lettering not less than one inch in height, setting forth the day or days and hours parking is prohibited for street sweeping purposes. In addition, parking enforcement staff, in its interactions with the public, will notify the public of the changes. Should a parking restriction change occur the parking enforcement staff would post notices instead of violations for the first two weeks after the change. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, DESIGNATING THE STREETS OR PORTIONS THEREOF ON WHICH THE PARKING OR STANDING OF VEHICLES IS PROHIBITED AND THE SPECIFIC DAYS AND HOURS OF SUCH PROHIBITION TO IMPROVE STREET SWEEPING EFFECTIVENESS AND RESCINDING RESOLUTION NO. 2017-14 WHEREAS, Newport Beach Municipal Code ("NBMC") Subsection 12.44.150(A) provides that the City Council shall by resolution designate streets or portions of streets on which the parking or standing of vehicles is to be prohibited; WHEREAS, NBMC Subsection 12.44.150(A) also requires the City Council to designate in the resolution the days of the week and the exact hours during which such parking prohibition shall be in effect; WHEREAS, California Vehicle Code section 22507.6 ("Section 22507.6") provides that the City of Newport Beach ("City") may, by resolution, prohibit the parking or standing of vehicles on designated streets, or portions thereof, for the purpose of street sweeping. Section 22507.6 states that such prohibition shall not be effective with respect to any commercial vehicle in a residential district making pickups or deliveries of goods, wares, or merchandise from or to any building or structure located on the restricted street, or for the purpose of delivering materials to be used in the repair, alteration, remodeling, or reconstruction of any building or structure for which a building permit has previously been obtained. Further, Section 22507.6 provides that such prohibition shall not be effective until the City causes to be posted in a conspicuous place at each entrance to the street a notice not less than 17 inches by 22 inches in size, with lettering not less than one inch in height, setting forth the day or days and hours parking is prohibited; WHEREAS, the City has determined that it is reasonable and in the public interest to prohibit parking of vehicles at certain days and in certain areas of the City to effectively operate the City's street sweeping program; WHEREAS, on February 28, 2017, to address and improve street sweeping effectiveness in the area, the City Council for the City of Newport Beach ("City Council") adopted Resolution No. 2017-14, which established a comprehensive list, in alphabetical order, of all of the designated streets or portions of streets in the City on which the parking or standing of vehicles is prohibited and the days of the week and the exact hours during which such parking prohibition is in effect; and WHEREAS, to further address and improve street sweeping effectiveness, the City Council desires to rescind Resolution No. 2017-14 and adopt this resolution, which updates the comprehensive list, in alphabetical order, of all of the streets or portions of streets in the City on which the parking or standing of vehicles is prohibited and the days of the week and the exact hours during which such parking prohibition is in effect. This resolution reflects the following changes to the list that had been set forth in Resolution No. 2017-14, which are reflected in the "Designated Streets, Days, and Hours when 5-28 Resolution No. 2017 - Page 2 of 23 Parking or Standing of Vehicles is Prohibited" attached hereto as Exhibit A and incorporated herein by this reference: • South side of Balboa Boulevard from A Street to G Street will be swept on Tuesdays between 8:30 a.m. and 12:30 p.m. and the remainder of the south side of Balboa Boulevard from G Street to Channel Road will continue to be swept on Mondays between 8:30 a.m. and 12:30 p.m.; • Both sides of Avocado Avenue from East Coast Highway to Pacific Drive, including center medians, will swap sweeping days (resulting in sweeping on Wednesday for the east side of Avocado and Tuesday for the west side of Avocado) with both occurring between 9:30 a.m. and 12:30 p.m.; • North side of Via Lido Nord and the south side of Via Lido Soud will be swept on Tuesdays between 8:30 a.m. and 12:30 p.m.; and • South side of Via Lido Nord and the north side of Via Lido Soud shall be swept on Fridays between 8:30 a.m. and 12:30 p.m. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: To further address and improve street sweeping effectiveness, the parking or standing of vehicles is prohibited on the streets or portions thereof and on the days and hours set forth in Exhibit A. The prohibition on the parking or standing of vehicles shall not apply to any commercial vehicle in a residential zoning district making pickups or deliveries of goods, wares, or merchandise from or to any building or structure located on the restricted street, or for the purpose of delivering materials to be used in the repair, alteration, remodeling, or reconstruction of any building or structure for which a building permit has previously been obtained. Section 2: Resolution No. 2017-14 is hereby rescinded. Section 3: The City Traffic Engineer or designee is authorized and directed to cause signs to be posted in a conspicuous place at each entrance to the street or portion thereof with a notice not less than 17 inches by 22 inches in size, with lettering not less than one inch in height, setting forth the day or days and hours parking is prohibited in all of the "no parking" areas of the City for street sweeping purposes consistent with those in Exhibit A. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, 5-29 Resolution No. 2017 - Page 3 of 23 sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
