TITLE: Central Avenue Plaza Revitalization — Award of Contract No. 8197-
2 (17H12)
ABSTRACT:
Staff has now received construction bids for Central Avenue Public Plaza Revitalization Project
(adjacent to the new Central Avenue Public Dock) and is requesting City Council approval to
award the contract to GMC Engineering, Inc.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to
Section 15302(c) (Replacement or Reconstruction), on the basis that the project consists
of the replacement or reconstruction of existing public facilities, involving no expansion of
capacity, of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential to have a significant effect on the environment;
b) Approve the project drawings and specifications;
c) Award Contract No. 8197-2 to GMC Engineering, Inc. (GMC) for the total bid price of
$380,000.00, and authorize the Mayor and City Clerk to execute the contract; and
d) Establish $40,000.00, approximately 10 percent, contingency amount to cover the cost of
unforeseen work not included in the original contract.
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for this project. The following funds will
be expensed:

On October 26, 2016, the City Council accepted a $350,000.00 donation from Newport Harbor
Yacht Club (NHYC) as a mitigation condition of its Coastal Development Permit to provide
public access elsewhere in the harbor. This mitigation funding was ear -marked for the
construction of the new Central Avenue Public Dock and adjacent landside entry plaza. The
Central Avenue dock has just been completed and the remaining funding from the NHYC
donation is available to augment the funding needed for this Central Avenue Plaza
Revitalization project.
DISCUSSION:
At the recommendation of both the Harbor Commission and City Council, staff recently
completed the installation of the new Central Avenue Public Dock providing a water/land
connection to the recently revitalized Lido Marina Village/Lido Hotel area. As a supplemental
enhancement to this new public dock, the current approved CIP includes a project to
rehabilitate the current Central Avenue Street End and Plaza, connecting the new dock with
Lido Village.
At 10 a.m. on September 26, 2017, the City Clerk opened and read the following electronic
bids for the Central Avenue Plaza Revitalization Project.
BIDDER TOTAL BID AMOUNT
Low GMC Engineering, Inc. $ 380,000.00
2nd C.S. Legacy Construction, Inc. $ 410,525.00
The City received two bids for this project and the low bid amount is 33 percent above the
Engineer's Estimate of $285,000.00. In reviewing the bid results, the higher bid cost appear to
be attributed to some of the added enhanced features such as matching the Lido Village
streetlights and requiring larger size trees, a higher than expected escalation in material prices,
as well as a short construction schedule (to have plaza and dock open prior to this year's
Christmas Boat Parade) that were not fully reflected in the Consultants Cost Estimate. The low
bidder, GMC, Inc. possesses a California State Contractors License Classification "A" as
required by the project specifications. A check of the contractor's references indicates
satisfactory completion of similar projects for the City of Newport Beach and other public
agencies. In addition, GMC, Inc. has a track record of completing quality projects for the City
within a shortened work schedule such as the Eastbluff Drive/Ford Road Bike Lane
Improvement Project.

This proposed project consists of constructing the contract -specified plaza improvements
including new concrete, specialty paving, new landscaping, bike rack, benches, trash cans,
street trees and street light lighting. Pursuant to the contract documents, the Contractor will
have 46 consecutive working days to complete the work. Liquidated damages are set to
$1,500.00 per working day in case of tardy completion.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this Project exempt from the California Environmental
