Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Eric Loke, Senior Civil Engineer, eloke(o)_newportbeachca.gov PHONE: 949-644-3336 TITLE: Adopt a Resolution Supporting an Application by the City of Irvine for the OCTA Measure M2 Regional Traffic Signal Synchronization Program for the Culver Drive - Bonita Canyon Drive Project ABSTRACT: The City of Irvine requests the City of Newport Beach support their application for the Orange County Transportation Authority (OCTA) Measure M2 Regional Traffic Signal Synchronization Program (RTSSP) for the Culver Drive - Bonita Canyon Drive Project. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2017-67, A Resolution of the City Council of the City of Newport Beach, California, Supporting an Application by the City of Irvine for the Orange County Transportation Authority's Measure M2 Traffic Signal Synchronization Program Funding for the Culver Drive - Bonita Canyon Drive Corridor Synchronization Project. FUNDING REQUIREMENTS: Funding is not required, at this time, for adoption of the Resolution to support the Irvine project application to the Regional Traffic Signal Synchronization Program grant program. Should the project application be successful and awarded Measure M2 grant funds, the City will enter into a cooperative agreement with the City of Irvine to include the required funding for the City of Newport Beach's share of the project. The conceptual cost estimate, including work within Irvine, State of California (Caltrans) and Newport Beach right of way, is approximately $1,593,000. The required cash match for work within the City of Newport Beach is estimated at $166,000 (20%). Funding for the project will be included in the FY 2018-2019 Capital Improvement Program for Council consideration. 4-1 Adopt a Resolution Supporting an Application by the City of Irvine for the OCTA Measure M2 Regional Traffic Signal Synchronization Program for the Culver Drive - Bonita Canyon Drive Project October 24, 2017 Page 2 DISCUSSION: As part of the Measure M2 Comprehensive Transportation Funding Program (CTFP), the Regional Traffic Signal Synchronization Program was created to enhance traffic signal coordination and reduce travel time delay by funding synchronization projects for multi - jurisdictional traffic signal corridors. Project eligibility requires a City Council Resolution supporting the application and implementation of the project. OCTA is currently administering the 2018 Call for Projects for the Regional Traffic Signal Synchronization Program. Project applications received by OCTA will be evaluated and scored as part of the competitive program. If successful, the City will be required to provide the necessary local matching funds of at least 20 percent of the total project cost. The proposed project will synchronize traffic signals along the Culver Drive - Bonita Canyon Drive corridor through traffic signal equipment and communication infrastructure upgrades. This project includes 39 signalized intersections, of which six intersections are within the City of Newport Beach. As part of the project, the six Newport Beach intersections will receive new traffic signal control equipment and closed circuit television cameras. In addition, the intersections will receive revised traffic signal timing with monitored coordination along the project corridor once the project is complete. Lastly, installation of a new Fiber Optic communication cable will connect MacArthur Boulevard towards the city limits at Bonita Canyon Drive and Chambord. REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: Attachment A — Resolution Attachment B — Location Map 4-2 Attachment A RESOLUTION NO. 2017 - 67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA SUPPORTING AN APPLICATION BY THE CITY OF IRVINE FOR THE ORANGE COUNTY TRANSPORTATION AUTHORITY'S MEASURE M2 TRAFFIC SIGNAL SYNCHRONIZATION PROGRAM FUNDING FOR THE CULVER DRIVE - BONITA CANYON DRIVE CORRIDOR SYNCHRONIZATION PROJECT WHEREAS, the Orange County Transportation Authority's ("OCTA") Measure M2 Regional Traffic Signal Synchronization Program ("Program") targets over two thousand (2000) signalized intersections across Orange County to maintain traffic signal synchronization, improve traffic flow, and reduce congestion across jurisdictions; WHEREAS, the City of Newport Beach ("City") has been declared by OCTA to meet the eligibility requirements to receive revenues as part of the Program; WHEREAS, City must include all projects funded by the net revenues in the City's seven-year Capital Improvement Program as part of OCTA's Renewed Measure M Local Transportation Authority Ordinance eligibility requirements; WHEREAS, City has a currently adopted a Local Signal Synchronization Plan consistent with the countywide Regional Traffic Signal Synchronization Master Plan as a key component of the City's efforts to synchronize traffic signals across its boundaries; WHEREAS, City desires to support the funding application of the City of Irvine to implement a multi -jurisdictional traffic signal synchronization project for the Culver Drive - Bonita Canyon Drive corridor, under the Program, which will synchronize thirty-nine (39) signalized intersections, of which six (6) are within the City ("Project"); WHEREAS, by this resolution, the City Council for the City intends to authorize a formal amendment to its seven-year Capital Improvement Program to add the Project for funding upon approval from OCTA's Board of Directors to fund the Project as part of the Program; WHEREAS, by this resolution, the City Council for the City intends to agree to provide matching funds for the primary implementation and ongoing maintenance and monitoring of Project, as required by the Guidelines Manual for OCTA's Comprehensive Transportation Funding Programs; and WHEREAS, City will not use renewed Program funds to supplant developer fees or other commitments. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby support the funding application of the City of Irvine to implement the Project. 4-3 Resolution No. 2017 - Page 2 of 2 Section 2: The City Council does hereby authorize a formal amendment to its seven-year Capital Improvement Program to add the Project for funding upon approval from OCTA's Board of Directors to fund the Project as part of the Program. Section 3: The City Council does hereby agree to provide matching funds for the primary implementation and ongoing maintenance and monitoring of the Project, as required by the Guidelines Manual for OCTA's Comprehensive Transportation Funding Programs. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
