I am a resident of Newport Beach and I am concerned about continuing attempts by builders and developers to
circumvent zoning regulations and build larger and taller structures that are out of character for the
neighborhood. Height and size limits are put in place for a reason, and they should not be amended or ignored through
variances just because a wealthy developer or resident wishes it to be so.
I know many other residents of our city agree with me. I hope that our views will find representation in the upcoming
general plan update process. I am not able to attend the meeting on Tuesday, but I wanted to voice my concerns.

I am strongly opposed to what I see as a growing epidemic of over -sized homes in my Corona del Mar
neighborhood, as well as Newport Heights and all over the city. Especially big boxes sprouting up all over the

I am writing to express my concerns about the size of residential building going on in Corona del Mar. I have lived
in CdM since I was 8 years old so I remember and miss the way the "'village" used to look. I have been a
homeowner in CdM since 1975. My husband and I bought out first house on Marigold Ave.
I realize that beach cottages have to grow to make the most out of the lots they are built on but the planning
commission needs to stick to the city's building size codes. Height and square foot restrictions need to be followed
to try to maintain the charm that has always been a part of CdM.

As we approach the General Plan update process, may I respectfully request that the errors of past General Plan updates
not be repeated? In 2006 and 2014, a Greenlight vote was required to approve the General Plan as substantial new
developments had been added. Despite this, the ballot question for the election asked if the voters would approve a
General Plan that reduced traffic and density. I'm requesting total transparency for this General Plan update rather than
the duplicity of the past. If additional development is added to the General Plan, residents have the right to know what
has been added. For the 2014 General Plan update, that information was not available through any city website or
readily accessible document.

I recommend the City investigate the need to amend its existing General Plan to reflect recent
State legislation and to include goals, policies and objectives for new technologies in its updated
General Plan. In summary, I recommend the City consider the following:

OVERVIEW
1. Accessory Dwelling Unit Legislation and Affordable Housing Legislation
a. State Bills
I'd like to call the city's attention to 20 bills recently passed by the State of California.
Three were passed in 2016 and 17 have been passed thus far this year. All bills have the
potential to impact the future build -out of the City.
These bills are an attempt by the State to meet its 1 - 1.5 million unit housing shortage
through construction of Accessory Dwelling Units (ADUs) and to satisfy California's
need for affordable housing. It is presumed a high percentage of ADUs will be
affordable.. Some of these bills take land use controls away from local jurisdictions
(cities and counties) and incentivize property owners to construct ADUs. There are no
sunset provisions in these bills. Therefore, their effects are long-term.

In response to Assembly Bill No. 2299, Senate Bill No. 1069 and Assembly Bill No.
2406 (effective 1-1-17) the City of Newport Beach adopted Ordinance 2017-11 (August
8, 2017). At that time, the City identified approximately 9,000 existing residential lots
within the City that could build ADUs.

The future environmental impacts of these bills are yet to be determined by the City or by
any other government agency or planning organization. However, the legislature's intent
is clearly stated in the text of these bills.
Any increase in construction of ADUs within California has the potential to decrease
existing infrastructure capacities and has the potential to increase impacts on public
facilities and services within cities, and counties. Any increase in construction of ADUs
within California may decrease existing federal infrastructure capacities within the state
and has the potential to increase impacts on state and federal facilities and services.
Regional planning organizations throughout the state have not yet addressed the effects of
these legislative bills.
I recommend the City analyze the impact of these and other related bills to determine
what effects they will have on the City's future plans and its environment. It is my
understanding city and county growth projections are provided to regional and state
planning organizations (SCAG, AQMD) for their use in determining regional effect and
needs, and compliance strategies for state and federal regulations.
The existing General Plan and its California Environmental Quality Act (CEQA)
document do not account for these legislative changes in circumstances. These bills were
adopted after the CEQA document was certified and the General Plan approved.
I recommend the City evaluate the existing General Plan and its CEQA document to
determine the need to address the effects of these new bills.
I recommend the City investigate the defensibility of any Project Finding which relies on
the existing General Plan or any other regional planning document which does not
address these new bills.

b. Public Health and Safety
I am concerned by State bills which take land use authority and environmental review away
from regional and local governments and the effects of these bills on re -development of built -
out communities. I recommend the City fully investigate measures to protect public health
and safety and incorporate the effects of these bills in its General Plan update.
2. New Technologies and Their Effects Prior to the Updated General Plan's Horizon Year
a. Autonomous Vehicles
There's no all-encompassing prediction for how autonomous (self -driving) vehicles (cars,
buses, trucks and equipment) will impact cities. What can be said is that people and
commerce rely heavily on transportation and advancements will bring new possibilities,
challenges and unforeseen effects. Autonomous vehicles have the potential to reshape
development patterns and the urban landscape.
I recommend during the General Plan update process the City evaluate Autonomous vehicles
and incorporate this technology into goals, policies and objectives to augur in a new era of
efficiency, mobility, economic growth and heightened environmental quality.

b. Use of Electric Bicycles and Development of a Smart Circulation System
Due to recent improvements in battery technology, the City is experiencing a significant
increase in the use of electric bicycles, along it streets, sidewalks, public trails and coastal
board walk. The increased use of electric bicycles presents both opportunities and
constraints. The use of electric bicycles can replace vehicular trip ends, vehicular emission
from fossil burning vehicles and be an efficient form of transportation most times of the year.
The use of electric vehicles can also represent safety constraints to the bicyclist and the
public.
I recommend during the General Plan update process the City evaluate the increased use of
electric bicycles and incorporate this technology into goals policies and objectives for a smart
circulation system to augur in a new era of efficiency, mobility, heightened environmental
quality and environmental protection.

c. Commercial Use of Unmanned Aerial Vehicles (UAVs/Drones)
i. Quality of Life
The economic implications for commercial drone use are undeniable. A recent study
estimates over the 10 year span from 2015, to 2025 UAV integration within national air
space will account for $82.1 billion in job creation and economic growth.
Every delivery by UAV is one vehicle less trip -end by ground vehicle. Reductions in
total vehicle miles traveled by fossil fuel powered vehicles will reduce harmful air
emissions improving the quality of life within the City, the South Coast Air Basin and
reduce the City's dependency on fossil fuels.
Use of UAVs has the potential to greatly affect the quality of life within the City, both

However, there is a clear direction. On October 17° 2017 the Los Angeles Police
Commission approved a one-year pilot program for the use of drones by police.

The National Aeronautics and Space Administration (NASA) is working with the Federal
Aviation Administration (FAA) to develop software for the commercial use of UAVs.
Many estimates predict FAA approval for the widespread use of commercial UAVs by
year 2020 - 2021.

I recommend during the General Plan update process the City evaluate the potential use
of UAVs and proactively establish goals, policies and objectives to augur in a new era of
efficiency, mobility, economic growth, heightened environmental quality and protection
in the event this technology receives federal and state approvals.
ii. Transportation
Every delivery by UAV is one less trip -end by ground vehicle. Will UAVs fly line -of -
sight pursuant to FAA regulations, or will UAVs fly designated routes within in the City
consistent with FAA regulations? I recommend during the General Plan update process
the City establish goals, policies and objectives for private and commercial us of UAVs.

iii. Health and Safety
As with any form of new and evolving technology, commercial UAV use promises to
expand and revolutionize industries across the United States. Before it can do that,
however, a number of safety and security issues have to be handled. As the technology
continues to advance, the FAA is ironing out regulations and beginning the process of
granting permissions to business throughout the country.
Current FAA guidelines limit commercial UAVs to a maximum height to 400 feet and a
package weight of 40 lbs. Commercial UAVs may also fly beyond the line of sight.
Inherent with any flying object is the risk of damaging personal property, personal injury
and impacts to sensitive environmental resources.
The FAA is concerned about businesses accidentally violating privacy rights during
commercial drone use. UAVs have the ability to maneuver into areas that people may be
unable to access and many can carry payloads of photographic and video equipment. The
possibility of capturing images and data belonging to individuals without their permission
exists.
I recommend during the General Plan update process the City proactively consider goals,
policies and objectives to protect and improve the quality of life from the commercial use
of UAVs within City.

d. The Effect of New Technologies on Employment and the Quality of Life
i. Automation and Robotics
Advances in computer technology from improved industrial robotics to automated
translation services may mean the replacement of many types of jobs as these powerful
new technologies are increasingly adopted not only in manufacturing, clerical, and retail

work but in professions such as law, financial services, education, government and
medicine.
For some employees, the use of technology may impact whether they retain their jobs
through acquiring new skill sets or if the use of technology will make them dispensable.
Employees whose jobs duties threaten to be replaced through the use of automation and
technology solutions will either need to learn new skills or possibly face employment.
Technology improves training opportunities for employees. Goals, policies and
objectives to improve the quality of life and financial viability of the City should be
included in the updated General Plan.

ii. Quality of Life
The General Plan update should evaluate potentially adverse impacts to individuals
and families within the affordable income categories from admirable planning goals
such as, the ability to walk -to -work (which reduce vehicular ADT and VMT, thereby
reducing traffic congestion, use of fossil fuels/vehicular emissions and improving the
quality of life within the City) and the potential for replacement of these jobs with
automation and robotics that may occur within the General Plan horizon year.
