PROCEDUP.E FOLLOWED BY PLANNING COMMISSION: Notice of public hearing was duly published in the Newport Harbor News Press on May 9, 1960. One public hearing was conducted on May 19,, 1960. FINDINGS OF PLANNING COMMISSION: At the time the subdivider filed the final map the Cosssssissrion conditioned approval thereof subject to the area being rezoned to an Rn1-B District. the Cemmission concurs in the setbacks requested by the subdivider, subject to the following condition: Gutters to be installed wherever the front overhang comes within V of the brow of a bluff. The further requests that: District Map No. 33 be made a part of the Muni. Code so as to show the zoning and ssethacks thereupon. RECOMMEN€iATIONS OF PLANNING COMMISSION: The Planning Cemmiusion recommends to the City Council that this amendment to establish setbacn.s and zoning be approved. AND ESTABLISHING CERTAIN SETBACK LINES FOR SAID PROPERTY The City Council of the City of N --Wort Beach dues ordain as follows: SECTION 1. The map designated Districting Map, Newport Beach -- California, Map No. 33, three copies of which are on file in the offiwe of the City Clerk, is hereby adopted by reference pursuant to Section 415 of the Charter and is made a part of Article IR of the Newport Beach Municipal Code, in accordance with Section 9102.2 thereof. SECTION 2.. The following described real property in the City of Newport Beach, County of Orange, State of California, to wit: Lots 1 to 142, inclusive, Tract 3519, as per map recorded in Book 17.5, pages 18 to 21, inclusive, of Miscellaneous Maps, Records of Orange County, California, as shun on said District Map No. 33 referred to in Section 1 of this ordinance, be, and the same is, hereby rezoned from an Unclassi- fied District to an R -1-B District. SECTION 3. Building setback lines for the following de- scribed real property in the City of Newport Beach, County of Orange, State of California, to wit: Tract 3519, as per map recorded in Book 125, pages 1.8 to 21, inclusive, of Miscellaneous Maps, Records of Orange County, California, as shown on said District Map No. 33, be, and the same are, hereby established as follows: The front building setback line for Lots 1 to 142, inclu- sive, in said Tract 3519 shall be as follow: Lots 29 through 39, 56 through 64, 74, 75, 87 through 94, 17.7, and 134, six feet (6,); Lots 48, 54, 55, 55, 86, 102, 103, and 117, ten feet G01); Lot 73, twelve feet (12®); Lots 14 through 28, 46, 50 through 53, 659 66, 76 through 84, 95 t1%rough 1.01, and 104 through 116, fifteen feet (15'); Lot 118, eighteen feet (18'); Lots 1, 49, 72, 131 through 133, and 135 through 142, twenty feet (20'); Lots 47 and 119, twenty-two feet (22a); Lots 40, 67, and 120 through 122, twenty-five feet Lots 68 and 123, twenty-six feet (261); Lots 71 and 124, twenty-eight feet (28'); Lots 2, 3, 41 through 45, 69, and 70, thirty feet (30') Loc 125, thirty-four feet (34'); Lots 4 through 10, thirty-five feed: (35'); Lot 11, thirty-six feet (361); z ,?t= 12 and 13, 4hirty-seven feet (37'); Loi 126, forty feet (40'); Lot 128, forty-three feet .(43') ; Lots 129 and 130, forty-four feet (449). This ordinance was introduced at an adjourned regular meeting of the City Council of the City of Newport Beach held on the 20th day of June, 1960, and was adopted on the day of July, 1960, by the followleag vote, to wit: 2.
