FINDINGS OF PLA.ed M C ISSION:
In order to qualify for gas tax funds for street improvements on arteriii,
highways it was necessary to a rad.the Subdivision Ordin nee so that street
widths and improv eats would conform' to County, standards.
RECOMKENDATI(.41S OF PLYING C MISSION:
;he Planning Com aission recommends that the City Council concur in these
amendments and cleat Article IXC (Subdivision Regulations) be amended to
effect same.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEALING
SECTION 9254.14(f) AND AMENDING SECTIONS 9254.11,
9254.14, 9254.15 AND 9254.16 OF THE NEWPORT BEACH
MUNICIPAL COBE RELATING TO STREETS AND HIGHWAYS
The C ty Council of the City or Newport Beach does ordain
as follows:
SECTION 1.

SECTION 2. Section 9254.11 of the Newport Beach Municipal
Code is amended to read:
„SECTION 9254.11. The street and highway design, shall
conform both in width and alignment to:any Master Plan of
Streets and highways (and all•amendments thereto heretofore
or hereafter adopted), and the regulations and standards
established therefor, approved by the City Council, and
right-of-way for any such street or highway indicated on
said Master Plan shall be dedicated. Minimum pavement
width between garbs for any such street or highway shall
be as follows:
(a) Sixty-four (64) feet for a secondary street or
highway.
(b) Eighty (SO) feet for a primary street or, highway.
(c) One hundred (100) feet for a major street or high-
way. to
SECTION 3. Section 9254.14 of the Newport Beach Municipal
Code is amended to read:
„SECTION 9254.14. Strects and highways not shown on any
Master Street and Highway Mau or not affected by proceedinga
initiated by the City Council or approved by the City Council
upon initiation by other legally constituted governmental
bodies shall not be of less width than those set forth here-
under, except where it can be shown by the subdivider to the
satisfaction of the Planning Commission that the topography
or the small number of lots served and the probable future
traffic development are such as to unquestionably ,justify a
narrower width or a special typo: of development satisfactory
to the Planning Commission. Increased widths may be required
where streets are to serve commercial property or where
probable t7 .ffi.c conditions warrant such. Approval or
determinat:.on of street or highway classification shall be
made by the Planning ConWission.
(a) major streets or highways -- minimum right-of-way,
one hundred twenty120feet; minimum pavement width between
curbs, one hundred (100) feet.
(b) Primar streets or highways -- minimum right-of-way,
one hundred (100 feet; minims pavement width between curbs,
eighty (30) feet.
(c) Secondary streets or highways -m minimum right-of-
way, eighty-four (84) feet; minims pavement width between
curbs, sixty-four (64) feet.

(d) local streets -- minimum right-of-way, sixty (60)
feet; minimum pavez=t width between curbs, forty (40)
feet.
(e) Cul-de-sac streets and service roads when not over
three hundred and fifty (350) feet in length -- minims
right-of-way, sixty (60) ferret; minimsm pavement width be-
tween curbs, forty (40) feet.
(f) -level streets -- minim im right-of-way, sixty
(60) feet -- variable according to grade; pavement widths,
two sections each twenty (20) feet curb face to curb face.

Department, and adopted by City Couucil, pertaining to park-

SECTION 4. Section 9254.15 of•the Newport Beach Municipal`
Code is amended to read:
14SECTION 9254.1.5. Service Roads and Off -Street Parking.
When the front of any lots abuts any major, primary or
secondary street or highway, they subdivider shall le requtred
to dedicate and improve a service road to provide ingress or
egress to and from such lots or, in lieu thereof, if approved
by the Planning Commission, subdivider my dedicate for public
use and improve an area approved by the Planning Commiasion
and adjacent to such lots for off-street parking purposes.
When the front of any Iota proposed for residential usage
abuts any freeway, state highway -or parkway, the subdivider
shall dedicate and improve a service road at the front of
such lots unless such is already existent as a part ' of such
freeway or parkway. In addition to any requirement for a
service road, they Planning Commission may require adequate
-off-street parking areas for all.Lots proposed for co ercial
or industrial usage.ee
SECTION 5. Section 9254.16 of the Newport Beach Municipal
Code is amended to read:
f4SECTION 9254.16. Non -access and planting Strips. When
any lots abut any major, primary or -secondary street or
highway, the subdivider shall be required to sxecute and
deliver to the: City an instrument, deemed sufficient by the
City Attorney, prohibiting the right of vehicular ingress
and egrees to such lots across the side lines of such streets
or highways, +=less specifically exempted from such require-
ment by the Planning Commission and such exemption is ap-
proved by the City Council. In addition to the icregoing,
the subdivider may be required to dedicate pedestrian access
across the side lines of such streets or highways. When the
rear of any lots abuts any freeway, state highway or parkway,
the subdivider may be required to dedicate and improve a
planting strip adjacent to such freeway, stater highway or
parkway. `+
SECTION 6. This ordinance shall be published once in
the oZficial newspaper of the City, and the same shall be effective
30 days after the date of its adoption.
