TERMS AND .CONDITIONS OF ENCROACHMENT PERMIT
Encroachment Permits maybe taken out by the owner of benefited property or a licensed contractor. A licensed
contractor must provide a `Letter of Authorization" to allow another party to pull a. permit An approved cony. of the
permit and construction plan shall be kept at the job site at all limes. Work, which has been done prior to issuance'
a perk. is subject to regnficnifine. City reserves the right in void permit if work does not commence within
after date of issuance
The Perittee agrees to defend, indemnify and hold the City. its authorized agent, officers, representatives and
employees harmless from any responsibility, liability, suit or action of any description arising out of any accident, loss
or damage to persons or property occurringas a result of work undertaken under this permit
All work shall be done in accordance with the approved plans. Standard Special Provisions and Standard Drawings
of the City of Newport Beach, and in compliance withall applicable State laws and City ortlinances.
Pennitteeguarantees an work performed under this permit to be free of hidden and latent defects. Any failures shall

All trenching and/or resurfacing shall conform to City Standard 105-L for parkway/madway and CityStandard 140-L,
in the alley, where as minimum half -alley width resurfacing shall be provided, unless otherwise directed by the Public
Works Dept Contractors shall obtain permits to perform excavation or trench work from the California. Division of
Industrial Safety prior to commencing underground construction as required by State law. Walls and faces. of an
excavations over 5 feet in depth shall be protected by a shoring system, sloping of the ground, or other equivalent
means. Trenches less than 5.feet in depth shall be guarded when hazardous ground movement may be expected.
The Public Works .Department inspectors must inspect all work in the Publicright-of-way. Fors and subgrade must
be inspected and approved before concrete is. orderedipoured. Sewer, pipelines, and subgrade construction must be.
inspected and approved before backfiiling, or applicant: may be required to excavate site. Separate Utilities
Department. or General Services Department inspections may be required depending on scope of work performed.
All trench restoration must be inspected by the Public Works Department No utility insfallation(s) shall be allowed
over or within 5 feet of any City utilities, unless approved by the Public. Works Department Locate and pothole

CdM Christmas Walk and Happy Holiday Banners (Corona Del Mar BID)
The following is the Encroachment Permit N2017-0536 conditions of approval for the installation
of the Christmas Walk banners:
• All work shall be per City Council Policy L-16 Temporary Banners Extending Over the
Public Right -of -Way.
• Banners are to be installed only on the 27 streetlight poles as indicated on the attached
exhibits.
• The mounting hardware shall be per the Council Policy: "All banner brackets on
streetlight poles must be installed using stainless steel band clamps and the brackets
must be sufficiently strong enough to withstand wind -load generated by ninety (90) mile
per hours wind."
• Poles or standards must be wrapped with forty five (45) ml thick black rubber sheet or
other pre -approved material under all steel brackets and clamps and no portion of any
bracket shall be in direct contact with the surface of any streetlight pole or standard.
• The contractor shall check the integrity of the existing brackets and hardware before
installation. The contractor shall replace any damaged brackets or hardware.
• Contractor shall contact the Municipal Operations Department at (949) 644-3011 at least
forty-eight (48) hours prior to the installation of any banner on streetlight poles.
• All banners shall be removed within thirty (30) days after the date of installation.
o Christmas Walk Banners: Installation on Friday, November 3, 2017 and
removal on Monday, December 4, 2017.
o Happy Holiday Banners: Installation on Monday, December 4, 2017 and
removal on Tuesday, January 2, 2018.
• Banners shall not be installed on any steel poles, including traffic signal poles.

• Banners shall not obstruct any traffic signage.
• A minimum of two 5-inch wide half -circle wind slits per banner are required to minimize
the wind load.
• The applicant must provide on -going maintenance of the banners and brackets
• If needed, the City may require removal of some banners to allow other organization to
install banners at the same location and during the same time period.
• Traffic control shall be per the latest edition of WATCH manual and the attached traffic
control plan. The work hours are limited to 9 AM to 3 PM.
• Banners cannot be installed on the same streetlight standard as ones with the City's
wayfinding signs.
