TITLE: Resolution No. 2018-13: Acceptance of Oil Spill Response
Equipment Grant Funding from the California Department of Fish &
Wildlife Office of Spill Prevention and Response
ABSTRACT:
Staff recently applied for, and successfully obtained grant funding from the California
Department of Fish & Wildlife's Office of Spill Prevention and Response. The funding
provided by the grant will be used to procure oil/fuel spill response equipment and will be
located and pre -positioned at the City's Marina Park facility for immediate deployment by
Harbor Operations staff in response to oil or fuel spills in the harbor.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Adopt Resolution No. 2018-13, A Resolution of the City Council of the City of Newport
Beach, California, Accepting Grant Funds from the California Department of Fish and
Wildlife, Office of Spill Prevention and Response for Oil Spill Response Equipment;
and
c) Approve Budget Amendment No. 18BA-031 recognizing $35,000.00 in grant revenue
from the California Department of Fish and Wildlife (13501-431385-18H12) and
appropriating $35,000.00 to Account No. 13501-980000-18H12 (Oil Spill Response
Equipment).
FUNDING REQUIREMENTS:
The Budget Amendment records and appropriates $35,000.00 in additional revenue from
the California Department of Fish & Wildlife and $35,000.00 in increased expenditure
appropriations. The revenue will be posted to Contributions Account No. 13501-431385-
18H12, and the purchase will be expensed to the Oil Spill Response Equipment account
in the Public Works Department, 13501-980000-18H12.

DISCUSSION:
Newport Harbor is one of the largest small -craft recreational harbors on the West Coast,
as well as a favorite and welcoming port to many boaters as they cruise the Pacific and/or
tour local waters. The harbor also serves as home to approximately 1,220 public
moorings, private docks, various charter operations, public & private marinas, and yacht
clubs. With 23 square miles of ocean waters, 1.25 square miles of bay waters, and 1.25
square miles of harbor waters covered by the City, in addition to adjacent County and
State tidelands and waters, the need to protect local waters and resources from vessel
pollutants such as oil is highly important.
This last summer, the City Harbormaster and staff attended a local meeting of
Dockmasters within Newport Harbor. At this meeting, the California Department of Fish
& Wildlife's (DFW) Office of Spill Prevention and Response (OSPR) gave a short
presentation on oil spill mitigation. Subsequent communications between the staff and
DFW representatives led to discussions on grant funding opportunities that could assist
the City in obtaining desired oil spill response equipment for the Harbor.
In November 2017, staff submitted an application to the OSPR. As part of the application
process, DFW OSPR conducted a site visit at Marina Park in January 2018 to discuss the
application, equipment needs, and the ability of the City to store and deploy the
equipment. On February 12, 2018, staff was notified that the DFW had completed their
review of the City's application and awarded a grant to the City.
There are no matching fund requirements or out of pocket expenses to the grant. The
City of Newport Beach may use the funding to procure a standard response equipment
package that consists of:
• Mobile trailer
• 1,000 feet of boom (various types available)
• Absorbent materials
• Personal protective equipment (PPE)
• Tool box
• Decontamination equipment
Alternatively, the City has the option of modifying the equipment list to better cater to the
needs of Newport Harbor. Purchases shall be made per the City's administrative
purchasing procedures through OSPR rated suppliers. In addition to the grant funding, a
boom deployment -training course will also be provided to City staff and conducted by
OSPR officials. The equipment shall be owned by the City and may be used without
obligation or limitation.
Harbor Operations staff hopes to use the equipment in support of first responders to
sinking vessels (such as the Harbor Patrol and U.S. Coast Guard) in preventing leaking
oil and fuel from spreading, and will follow the necessary guidelines for spill reporting and
disposal of used materials. In cases where the equipment is not in use, OSPR or their
contractors may access equipment if needed, and will clean and/or replace after use.

ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, ACCEPTING
GRANT FUNDS FROM THE CALIFORNIA DEPARTMENT
OF FISH AND WILDLIFE, OFFICE OF SPILL
PREVENTION AND RESPONSE FOR OIL SPILL
RESPONSE EQUIPMENT
WHEREAS, the City of Newport Beach ("City") is desirous of preserving and
promoting uses that contribute to the charm and character of Newport Harbor;
WHEREAS, the City of Newport Beach ("City") is committed to maintaining the
water quality and local natural resources of Newport Harbor and its surrounding waters;
WHEREAS, the State of California Department of Fish & Wildlife is authorized to
distribute grants through the Office of Spill Prevention and Response to local agencies
that may be at risk of an oil spill occurring in their jurisdiction or are in close proximity to
ecologically sensitive sites;
WHEREAS, the City of Newport Beach applied to the California Department of
Fish and Wildlife, Office of Spill Prevention and Response for oil spill response equipment
for the City of Newport Beach; and
WHEREAS, the California Department of Fish and Wildlife, Office of Spill
Prevention and Response has approved the City of Newport Beach to receive $35,000.00
in grant funds for oil spill response equipment and to secure the necessary training, and
now requires a resolution accepting these grant funds.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby accept the Grant, made available
through the Oil Spill Response Equipment Grant and administered by the Office of Spill
Prevention and Response.
Section 2: The City Manager is hereby authorized to execute any documents
necessary for the City to secure payment of the Grant Funds and effectuate the purposes
for which the Grant was awarded.
Section 3: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 4: If any section, subsection, sentence, clause or phrase of this resolution
is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this resolution. The City Council

hereby declares that it would have passed this resolution, and each section, subsection,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
Section 5: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
Section 6: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
