III. ITEMS FOR REVIEW
1. MINUTES OF OCTOBER 18, 2017
Recommended Action: Approve October 18, 2017 Minutes
MOTION: A motion was made by Committee Member Stratton, seconded by Committee Member Wheeler,
to approve the minutes of the October 18, 2017 meeting. The motion passed unanimously.
2. REVIEW STREETSCAPE IMPROVEMENTS AND PROCESS
Recommended Action: Review and Discuss
Associate Planner Zdeba introduced Public Works Director Dave Webb and Assistant City Engineer Mike
Sinacori.
Public Works Director Dave Webb expressed concerns about the accuracy of some of the estimated costs
on the list of improvements. For example, he recently purchased trash cans for Balboa Island at a cost of
about $400 each.
Chair Diane Dixon clarified that the Balboa Village Advisory Committee (BVAC) wanted less expensive, but
nice trash cans and bike racks.

Director Webb suggested Public Works staff begin developing plans and adding elements, which BVAC
can review, make selections and approve. The goal is to meet BVAC's budget or possibly even save
money.
Committee Members discussed coordinating BVAC projects with other City projects to save money without
using BVAC funds for the other City projects.
Committee Member Grace Dove suggested including the City’s Municipal Operations Department to obtain
their input on maintenance costs.
Director Webb recommended placing more costly trash cans in visible areas and less costly trash cans in
out-of-the-way areas as an option.
A member of the public, Kelly Carlson, expressed her wish to remove the plastic trash cans. Chair Dixon
concurred.
Director Webb advised that the City installed 11 trash cans on Little Balboa Island. They are made of
concrete with double texture to prevent graffiti and have a flap covering the opening on the top.
Chair Dixon recommended BVAC select the same trash cans as installed on Little Balboa Island at a cost
of $400.
Committee Member Jim Stratton inquired whether the pots at $700 each were new.
Assistant City Engineer Mike Sinacori did not know. Staff needs to review the project list and determine
whether the estimates are accurate and include installation. Staff cannot develop a project with costs until
they have more information. He suggested another tour of Balboa Village to review the existing conditions.
Ms. Carlson commented that many business owners did not care for the plants in the pots, so that the pots
became ash trays and trash receptacles.
Associate Planner Benjamin Zdeba explained that extraordinary maintenance was included in the budget,
but routine maintenance was not. It was stated that BVAC would need a contractor to maintain potted
plants.
Committee Member Marcel Ford questioned whether potted plants would be needed if landscaping is
improved.
Chair Dixon stated pots with plants are optional, and a maintenance plan will be needed if they are selected.
Assistant City Engineer Sinacori wished to include the City's urban forester in reviewing the existing
landscaping and developing plans.
Director Webb indicated staff will tour Balboa Village to reevaluate the list of improvements and then present
BVAC with ideas and costs.
In response to Director Webb's inquiry about the 15th Street median landscaping, Committee Member Dove
reported the trees are too short. People cannot walk under them.
3. GENERAL UPDATES
a. Commercial Facade Improvement Program
Associate Planner Zdeba reported that the City has 25 signed agreements for facade projects, 18 of which
have been completed and 7 are in progress. In addition, he received 4 incomplete applications and 2 recent

inquiries. With respect to the possibility of discontinuing the program and using funds for other projects,
the Community Development Department’s administrative analyst advised him it is best to deplete the funds
and allow the program to fade away. Program funds were specifically earmarked for facade improvements
and cannot be easily used for other projects.
b. String Lights on Main Street
Associate Planner Zdeba provided conditions under which lights can be placed along Main Street. Lights
must be more of a permanent fixture, provide a clearance of 15 feet for vehicles, and be strung building to
building. Lights cannot be strung across light poles or trees. Stringing the lights will require a building
permit and City Council approval of an encroachment permit for electrical to run across the right-of-way.
He suggested the Balboa Village Merchants Association (BVMA) work with merchants and property owners
to determine interest and willingness to comply with requirements.
Committee Members discussed issues around willingness of building owners to participate, payment of an
electricity bill, and liability for lights crossing the street.
Director Webb advised that poles for lights may have to be installed where buildings are too low.
c. Village Walkabout
Associate Planner Zdeba reported he will coordinate a walkabout to review the list of improvements.
In reply to Chair Dixon's inquiries, Associate Planner Zdeba advised that power washing of sidewalks is
being done. He is working with Code Enforcement regarding the Balboa Pavilion's trash being visible to
the walkway.
d. Current Applications and Upcoming Projects
Associate Planner Zdeba reported the Mithrush building project received building permits, so construction
can begin at any time. A tenant for the building is not currently known.
Committee Member Ford requested the older "Fisherman's Casino" sign on the side of the building not be
painted over. Associate Planner Zdeba advised that planning staff worked to ensure improvements to the
building complied with the Balboa Village Design Guidelines. Committee Member Dove noted that the
historic element in the General Plan should provide protections for such a sign. Associate Planner Zdeba
indicated penalties or fines for failure to comply with the Historic Resources Element in the General Plan
are nonexistent.
Associate Planner Zdeba reported the Balboa Theater project will be presented to the Planning Commission
in January for entitlements. An application for 500 East Balboa Boulevard has also been submitted.
In response to Committee Member Ford's inquiry about the bike shop, Associate Planner Zdeba indicated
he would review the situation.
In answer to Associate Planner Zdeba's question, Chair Dixon cancelled the December 20 BVAC meeting.
At Committee Member Stratton's request, Deputy Director Jim Campbell provided an update regarding the
Coastal Commission's review of the resident permit parking program . Coastal Commission staff will not
consider the Balboa Village parking overlay without understanding the full context of the City's parking
management strategy for Balboa Village. Staff is struggling to package the parking management strategy
in such a way that the Coastal Commission will approve it without retaining control over components of the
strategy.
Committee Members discussed requests for waiving parking requirements.

This project provides for a new wayfinding program in the public rights of way to assist residents,
commuters and visitors find destinations and attractions in Balboa Village. The project aims to integrate

Re: Parking Management Initiatives Update

The City adopted the Balboa Village Master Plan in 2012. The plan included
several parking management initiatives. The City has not yet implemented the
Parking Management Overlay and the Balboa Resident Preferential Parking
Program (“RP3”).
Balboa Village Parking Management Overlay (“Overlay District”)
The Overlay District affects properties within Balboa Village between Adams Street
and A Street and does the following:
1. Eliminates required off-street parking for most commercial uses.
2. Maintains existing off-street parking facilities.
3. Allows shared use of parking facilities.
4. Suspends existing and future in-lieu parking fees.
These changes were incorporated within the Zoning Code in 2014 (Title 20 of the
Newport Beach Municipal Code [NBMC]). The City attempted to incorporate
identical regulations in the Local Coastal Program (LCP) Implementation Plan
(NBMC Title 21), but at the insistence of the Coastal Commission staff, the City
agreed to process it as a separate amendment after certification of the LCP.
The LCP Amendment requires review and approval by the Planning Commission
and City Council. Staff anticipates hearings in March and April of 2018, with
submission of the amendment to the Coastal Commission late Spring or early
Summer. Preliminary indications from Coastal Commission staff suggest there
may be some changes to the Overlay District if it is approved.

Balboa Resident Parking Permit Program (“RP3”)
At the request of residents, the City has developed a potential overnight resident
preferential parking program. The streets proposed to be regulated are Adams
Street to Medina Way with a second phase expanding the program to Island
Avenue. Non-resident parking would be prohibited between the hours of 4 p .m.
and 9 a.m., excluding federal holidays. Residents and property owners were
surveyed in 2014 and 2015, and a majority of respondents to the ballot survey
favored the program. The draft program is attached (Attachment 1).
In October of 2015, the City Council authorized submitting the program to the
Coastal Commission for approval. The City Council did not adopt an ordinance at
that time, which is required in order to enforce the parking restrictions pending
approval by the Coastal Commission. A Coastal Development Permit (CDP)
application was submitted to the Coastal Commission for the program, that was
later withdrawn after consultation with Commission Staff that highlighted concerns
about potential impacts to public access.
The City now has a certified LCP and can act on the RP3 program locally. Local
action to approve the program could be appealed to the Coastal Commission by
an aggrieved person or the Coastal Commission itself. Due to the concerns raised
with regards to potential impacts to public access if the program were approved as
planned, staff has developed several changes (i.e., conditions) that might address
public access concerns (Attachment 2). Given the length of time since the
community was surveyed, staff felt it would be appropriate to brief the BVAC before
taking any additional steps. If the Committee agrees, staff would also like to
schedule a community forum at Marina Park on March 21, 2018, where the
community can be brought up to speed before proceeding with a local CDP
application.

Balboa RP3
Project Description
Residents of the Balboa Peninsula near Balboa Village have historically experienced
parking shortfalls. Late night or overnight parking demand from commercial uses within
Balboa Village (east of Adams Street) and commercial boating uses are contributing
factors that reduce parking availability in the residential area to the west of Balboa
Village. Residents from this area have proposed, and the Balboa Village Advisory
Committee and City Council have supported the creation of an overnight Residential
Parking Permit Program (“RP3”) to eliminate "spillover" commercial parking onto the
nearby residential streets. If enacted, overnight parking on the specified streets would
require a parking permit. Residents who live on the affected streets would be eligible
purchase permits for their vehicles and a limited number of guest passes.
The streets proposed to be regulated are shown on the attached map. The proposed
hours of parking restriction are 4:00 p.m. to 9:00 a.m. daily excluding Federal holidays.
Displaced commercial patrons and employees who presently park in the residential area
can park in the public parking lots within Balboa Village that are shown on the attached
map. Parking data collected by Nelson Nygaard (enclosed) shows the availability and
adequacy of existing parking in the commercial areas of Balboa Village most of the time
and in this way, significant impacts to public parking in the area will be avoided. Permit
restricted parking will also create an incentive for some residential properties to better
utilize existing off-street parking or create it. Additionally, restricted parking will also
provide an incentive to use alternative transportation and carpooling.
The proposed parking program makes no physical changes to existing public access in
the area. Existing lateral access along the bay and beach by two separate public
walkways and bike path will not change. Parking spaces will not be removed. Existing
vertical access provided by public streets in the area will also not change. The only
physical change will be the installation of approximately 100 small regulatory signs
approximately 3 square feet in size on existing signs and vertical structures.

Balboa RP3
Public Participation
The Balboa RP3 is a resident-driven proposal to address limited parking availability
during overnight hours due to parking demand from commercial uses within Balboa
Village (east of Adams Street) and commercial boating uses. Residents surveyed the area
between Adams Street west to 7th Street in 2011. The door to door canvasing revealed
significant support. The City conducted an independent surveys of residents, absentee
property owners and mooring permit holders as the City included the parking program in the
Balboa Village Master Plan adopted by the City Council in September of 2012.
Since September of 2012, the City continued to discuss the program with the public through
the efforts a City Council led, citizen’s advisory committee called the Balboa Village
Advisory Committee (BVAC). The committee held numerous public meetings where the
program was debated. The program was considered by the City Council in late 2014, at a
noticed public hearing. The City Council requested additional public input given that the
City’s Municipal code requires that a majority of residents must support the adoption of a
parking program. A noticed town hall meeting was held at the Balboa Pavilion in February of
2015, and a second advisory ballot was sent to residents, property owners and mooring
permit holders. A majority of ballot respondents favored the program. In looking at the
results on a block-by-block basis, it became clear to staff and the BVAC that support for the
program was higher in the easterly block of the study area where the effects of commercial
parking in the resident area were most acute. Ultimately, BVAC recommended the two
phased parking program for a smaller area east of Island Avenue to and including Adams
Street. The recommendation was considered by the City Council at a noticed public hearing
on October 27, 2015, where the Council approved the program for submission to the
Coastal Commission for consideration. The City Council did not adopt an ordinance at that
time, which is required in order to enforce the parking restrictions, understanding that a
Coastal Development Permit would be required prior to adoption of an ordinance. In
summary, there has been extensive public participation at the local level.

Balboa Residential Parking Permit Program
Residents of the Balboa Peninsula have historically experienced parking shortfalls. Late
night or overnight parking demand from commercial uses within Balboa Village (east of
Adams Street) and commercial boating uses are seen as contributing factors that
reduce parking availability in the residential area to the west of Adams Street.
Residents from this area have proposed, and the City supports, the creation of an
overnight Residential Parking Permit Program (“RP3”) to reduce "spillover" commercial
parking onto the nearby residential streets. The preferential parking zone would prohibit
non-resident parking on public streets between Island Avenue and Adams Street as
shown on the attached map.
The RP3 would be implemented in two phases.
1. Phase 1 includes all streets between Medina Way and Adams Street including
both streets.
2. Phase 2 includes streets west of Medina Way to Island Avenue, but not including
Island Avenue and not including on-street metered parking stalls at the median in
Balboa Boulevard. Implementation of Phase 2 would occur if Phase 1 is
successful and there is a need for Phase 2.
ELIGIBILITY: All residents who reside on the affected streets and Mooring Area C Permit
Holders would be eligible to purchase parking permits.
HOURS: On-street parking restricted to valid permit holders between 4:00PM – 9:00AM,
7 days per week, excluding federal holidays.
NUMBER OF PERMITS: Four (4) permits per household
Six (6) overnight guest permits
PARKING AVAILABILITY: Permit holders would not be guaranteed an on-street parking
space but would be allowed to park in the preferential parking zone during the posted
hours wherever parking is available. Non-permit holders would be prohibited from
parking on the street in the preferential parking zone.
PERMIT COST: $16 for each annual permit
$1 for each guest permit for each overnight period
PERMIT TYPE: Non-transferable parking permits would be issued annually and may be a
sticker affixed to a resident’s vehicle; a rearview mirror hangtag; or linked to a vehicle’s
license plate number. The method of permit is to be determined.

1.Beach Public Parking. A minimum of two (2) on-street parking spaces per street shall
remain available for general public use at the oceanward terminus of Coronado Street,
Medina Way and Island Avenue, or within 100 feet of the intersections of each of these
streets with West Balboa Boulevard. These spaces shall be marked and/or signed to
communicate that a RP3 permit is not required for parking and shall remain available
for general public use at all times, except for street cleaning days and times. The City
shall impose a maximum hourly time limit on these spaces, which shall be no less than
two (2) hours nor more than four (4) hours.
2.Bay Public Parking. A minimum of one (1) parking space per street shall remain
available for the public at the bayward terminus of Fernando Street and Montero
Avenue. These spaces shall be marked and/or signed to communicate that a RP3
permit is not required for parking and shall remain available for general public use at
all times, except for street cleaning days and times. The City shall impose a maximum
hourly time limit on these spaces, which shall be no less than two (2) hours nor more
than four (4) hours.
3.Impact Report. The Zoning Administrator shall review the implementation of RP3 no
later than three (3) years following implementation. Prior to the end of the review
period, the City shall prepare a report providing provides data, analysis, conclusions
and recommendations regarding the impact of RP3 on public parking and public
access to the beach and bay. The report shall include, but not be limited to, the
following:
a.A parking study documenting parking utilization of the streets adjacent to RP3
including Ocean Avenue. The parking study shall include at least three non-
consecutive summer weekends between, but not including, Memorial Day and
Labor Day. The parking study shall also include a parking survey for the three
non-consecutive summer weekends documenting purpose of trip, length of
stay, parking location, destination, and frequency of visits;
b.The number of permits, including overnight guest permits, purchased during
the review period and location of permit holders;
c.Relevant available information regarding factors such as weather, water
quality, water temperature, surf conditions, special events, etc. that may affect
visitation patterns.
4.Zoning Administrator Review. The Zoning Administrator shall review the Impact Report
at a public hearing conducted no later than three (3) months following the end of the
review period. The public hearing shall be noticed in accordance with the Zoning Code
(Title 20 NBMC) and the certified LCP Implementation Plan (Title 21 NBMC). The
Zoning Administrator may reduce the hours and days when on-street parking is
restricted to permit holders as necessary to mitigate any impacts to public parking and
public access to the beach and bay identified in the impact report or otherwise
presented at the public hearing.
