Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov Jennifer Nelson, Assistant City Clerk Appointment to the Finance Committee The annual vacancies on the City of Newport Beach's ("City") Finance Committee occurred on June 30, 2018. At that meeting, Mayor Duffy Duffield also appointed Council Member Scott Peotter to fill Council Member Kevin Muldoon's seat on the committee. This change created an opportunity for Council Member Kevin Muldoon to appoint a citizen advisor to one of the scheduled vacancies. The citizen advisors have annual terms that are subject to City Council confirmation. The City Council is being asked to confirm Council Member Muldoon's appointment to fill the scheduled vacancy, pursuant to Resolution No. 2017-58. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Confirm Council Member Kevin Muldoon's appointment of Patricia Eckert to serve on the Finance Committee for a term ending June 30, 2019. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk prepared and posted a Notice of Scheduled Vacancies on Thursday, May 10, 2018, in the City Clerk's Office, at the Central Library, and on the bulletin board in the City Council Chambers. The Notice was also placed on the City's webpage on Thursday, May 10, 2018, and was published in the Daily Pilot on Saturday, May 12, 2018. As per the Notice, applications were accepted by the City Clerk's Office until noon on Thursday, May 24, 2018. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
