WASHINGTON -The Senate voted 90-9 Tuesday to confinn the
nomination of Judac David H. Souter to the Supreme Court. The only
dissenting votes came from liberals who fear he wiU oppose abortion
rights.
The New Hampshire jurist was approved less than 2Y> months after
he was tapped as President Bush's first nominee to the high court. It was
too late to put him on the court for the start of its session this ~k but.
at age 51, he'll probably participate in its rulinp well into the next century.
The Supreme Court announced th•t Souter would be sworn in as the
first item of business next Tuesday morning. before the court begins the
second week of its session.
At the White-House, prcsideotiaJ spokesman Marlin Fitzwater said:
.. We're obviously very pleased that Conpess confirmed this nomination.
We think Judge Souter will be an outstanding justice for many years."
Fitzwater said Bush hoped to attend Souter's swearing-in.

We were fonunate enouah to be selected by the readers and
the editon out of somethina like 97 writcn. After 1the dust had
~learc!d and editor Bill Lobdell and I had a sit-down, the only non·
neoatiable term was that It had to So·
I am really quite without vanity and am by no means a movie-
idol type.
However, nor am I the u murderer or malevolent puppy
mo~ter that picture depicu. The editor aareecS that the ori&inaJ
photo was a human traaedY and quickly arranged for another ono
to be liken.
The new photo, quite civilized I thin~ bas run ever since. ~
old one, it was reasonable to assume, had been destroyed •
But no. There II was qa:io. Not only that. it was blown up to
twice the normal lid! If it were Halloween, I could maybe So alona
with the pa. To have to see that thins apin-on a Monday
momina. no less-is cruet and inhuman.
It was so bad, people called to tell me about it. so bid my dop
wanted to ... use it.
What next? Leave it up to the Editor's Hotline? Can't you just
see the question of \he week? "Should we run the decent picture
of Fred, or the depraved one?"
Actually, maybe that's not a bad idea. Hotline caJlen saved
Nancy. Tumbleweeds and kindly old Judge Parker. On the other
hand, they can play pretty roUJh. They miaht say to go ahead and
run the old photo. Serves him right.
Oh. well. If that's the way it turns out. at least the paper could
run the numben and anat date that go under it. a
A Tall Pnblem: If you weren't frightened off by the picture and
read Monday's column, you learned a little about a wonderful
orpnizat1on called the Tall Oub of Oranat County.
While the column was mostly about TCOC's Miss Tall Oranac
County Pqeant (at which we had a srand time beina a Judfe). we
used the words~of the contestants to pve you some idea of what
ifs like beans a tall woman in a mostJy average to short world.
They talked about the stares. the cruel jokes. the tncrtd1bly
rude comments.

fully suina the American Civil Liberties Union for violating
his own civil ri&hts.
But for Riclwd Long, a Newport Beach police sergeant
assigned to the depanment's robbery and homicide division.

.. It's l 0 years old. rm tired of it. I'm sure everyone is
glad that it's over," Long commented after the U .S. Supreme
Court upheld the officer's $46,000 judgment against an
ACLU attorney.
The case dates back to an October 1980 public meeting
the ACLU held at Newport Harbor High School. One of the
topics the ACLU planned to discuss was police espionage at
political events.
Long. then the police department's community relations
officer, attended the meeting -paying an entry fee. wearing
a name day and even greeting several of the participants.
But as the day wore on. participants claimed they
observed Long tape recording the meeting. The officer was
eventually accused in publit of .. spying." Humiliated, he left
the meeting and though ACLU attorney Rees Lloyd later
went outside and invited Long to return, the officer declined.
The ACLU later filed suit. claiming the police main-
tained files on civil rights groups and tned to infiltrate them.
The legal challenge was later dismissed.
Long then sued the ACLU himself. allcgrng d1scrimina-
tioo and a violauon of civil nghts. He won the case and. with
attorney fees tacked on. was awarded $46,000. The ACLU
appealed and appealed and appealed, losang round after
round.
On Monday, the case finally reached the highest court
in the nation and -without comment or fanfare -1he U.S.
Supreme Court refused to hear the AC LU's challenge.
bringing the long-playing lawsuit to a conclusion.
And if it's an odd position for the ACLU to find itself
in, it's also proof that an organization that generally takes
on the battles of nghteousness and injustice can be called on
the carpet as well.
No one. and no one organization. has the comer o n c1v1l
rights.
