The following comments on items on the Newport Beach City Council agenda are submitted by:

Government Code § 54957(b)(1)
Process
Seeing the surprise agenda notice saying the Council will be meeting privately to conduct
interviews with candidates for City Manager (which we know from the July 24 closed session
report will be with three finalists), and possibly doing everything legally allowed to be done in
closed session under that heading, but that "the City Council will not be appointing a new City
Manager at this meeting," gives me pause to think this Council is going down the same path
earlier ones did, and, like them, does not fully understand its public reporting obligations under
the Brown Act (California Government Code Sections 54950 - 54963).
1 suspect the previously -announced August 13 interviews are being moved up to July 30 so the
Mayor can begin negotiations with the person selected (from among the three) in time to have a
contract accepted by him or her and ready for final Council approval at its August 14 meeting.
This is relevant because in previous City Manager recruitments (such as in 2009), the Council
seems to have operated under the fiction that action on an appointment has not taken place
until both parties have agreed to contract — allowing closed session protections to used to the
hilt up until that point, including sharing the identity of its selection, and final contract terms, with
the appointee, but not with the public.
I do not believe that was ever how the Brown Act was intended to be interpreted, and I certainly
don't think that's how the people intended for it to be interpreted after passage of Proposition 59
— demanding, as it did, that after 2004 its words be construed broadly when such an
interpretation favors openness, and narrowly when a proposed interpretation would deepen
secrecy (see California Constitution, Article I, Sec. 3(b)).
To clarify, under the terms of our City Charter, we rely on a City Council of seven elected
members that acts collectively, and can take action only by majority vote (normally discussed
and taken in public).
By its own words, Government Code Section 54957(b)(1) (the Brown Act section under which
the present closed session is being held) allows such a city council to meet privately "to
consider the appointment, employment, evaluation of performance, discipline, or
dismissal of a public employee." But while this allows the details of the discussion to be kept
secret, it cannot be used to hide the results of the discussions.
Indeed, Gov. Code Section 54957.1(a)(5) requires that "Action taken to appoint, employ,
dismiss, accept the resignation of, or otherwise affect the employment status of a public

employee in closed session pursuant to Section 54957 shall be reported at the public
meeting during which the closed session is held."
And "action taken" is broadly defined by Section 54952.6 as meaning "a collective decision
made by a majority of the members of a legislative body, a collective commitment or promise
by a majority of the members of a legislative body to make a positive or a negative decision, or
an actual vote by a majority of the members of a legislative body when sitting as a body or
entity, upon a motion, proposal, resolution, order or ordinance."
Moreover, Section 54953(c)(2) requires that the council "shall publicly report any action
taken and the vote or abstention on that action of each member present for the action."
In other words, any result agreed to by the Council as a result of the allowed private discussion
of matters related to the stated employment matters must be reported at the end of the meeting
at which the agreement is reached.
If a decision is made to narrow the field of candidates, the public is entitled to know that decision
was made, and by whom. If a decision was made to select three finalists, the public should
know who the finalists are and who voted to select them. And most importantly, if a decision is
made to offer employment to one of the finalists, the public is most certainly entitled to know
who that offer was made to, and which Council members voted for and against the decision. It
is the public's constitutional right.
The contrary idea -- that an "appointment" has not been made until some later date when an
employment contract has been approved -- is flawed for multiple reasons.
Among them, Government Code Section 54953(c)(3) and Section 54957.6(a) both require final
action on contracts affecting executive compensation to be taken in open session. It would
make no sense for the Brown Act to require a report to be given at the end of a closed session
on actions taken in private regarding appointments if such actions require an m contract and
therefore are not allowed in closed session.
More logically, the decision to appoint happens and is reportable as soon as a majority of the
Council settles on a pick. The possibility that the subsequent contract negotiations could fall
through is simply a fact of life irrelevant to whether an appointment decision has been made:
any contract could fail at any time.
If the City Attorney still wants to assert a decision to offer an appointment is not an
"appointment" as long as it remains contingent on some subsequent act (such as the signing of
an employment contract), then I would assert he would be confusing it with the reporting
requirements for agreements settling lawsuits, which indeed don't have to be reported until both
parties agree. Unfortunately for the City Attorney, there is no such language, no such savings
clause, in the reporting requirements related to closed session personnel decisions.
As a result of all the above, I firmly believe that, irrespective of any confidentiality agreements,
the public has a constitutional right to know of any decisions reached by the Council in
closed session on July 30 and what the vote was on those decisions.

Clarity
Newport Beach City Charter Section 601 requires the City Council to set the qualifications for all
City officers and employees.
As indicated in connection with the July 23 special meeting, the Council's qualifications for the
position of City Manager were last established on May 26, 2009, and no change to them has
been debated or approved since then — even though the brochure prepared by the outside
consultant quoted an older, and outdated set.
Before considering a new hire, it would be good for both the Council and the candidates to
familiarize themselves with the correct qualifications,
Rumors
The rumor that Orange County Board of Supervisors Vice Chairman Shawn Nelson is one of the
candidates for the Newport Beach City Manager position, and that he may have been selected
as one of the three finalists, is troubling to me.
I have no idea about Mr. Nelson's managerial skills, but the whole idea of the council-manager
system of government is for city services to be provided in an impartial, objective and non-
political way by career administrative professionals, as opposed to earlier systems in which
residents had to rely on being in the good graces of elected city commissioners overseeing the
various departments. Indeed, the city manager skill set is a distinct specialty within that
universe of career professionals, specifically called out as a requirement for hiring in our City
Charter Section 500. 1 am not aware that Mr. Nelson has any experience in that field.
In addition, the Council must surely expect its selection to devote their full energies to the job of
managing and learning about the City, and until his term as Supervisor expires, I cannot
imagine Mr. Nelson having the time to do both jobs at once. Even he could, he would have
serious conflicts of loyalty, since the interests of his supervisorial constituents from north
Orange County might be very different from those he would be asked to advance on behalf of
the City on such issues as the Airport (to name but one).
The Downside of Secrecy
The fact that the public is commenting on the qualifications and desirability of Supervisor Nelson
without knowing if he actually is a candidate or finalist, and, similarly, the fact that the public
does not know, and is unable to comment at all on the other candidates, highlights the problems
the secrecy that envelops the process has generated.
The Council, without much, if any, public discussion seems to have bought into the idea that
disclosure of the names of candidates would endanger their current job positions, and allowed
the recruiter to offer promises of confidentiality — promises the Council now feels it must honor.

But particularly since passage of Proposition 59 in 2004, it is not clear the Council can honor
those promises, any more than it can honor the disclaimers found at the bottom of public
correspondence sent to it, saying the contents are confidential and can't be disclosed to a third
party.
The overwhelming number of Californians who voted for Proposition 59 were assured by its
proponents that, if passed, the "constitutional right to know what the government is doing" it
acknowledged would allow them, in the future, to answer such questions as: "Who is the
Governor considering for appointment to a vacancy on the County Board of Supervisors? Why
was the superintendent of the school district fired, and who is being considered as a
replacement?"
I think the Council should honor that constitutional promise, and the City of Newport Beach will
be the better for it: a robust public discussion of the pluses and minuses of all the potential
candidates for City Manager — certainly the finalists and not just Mr. Nelson (if he is even one of
them) -- is needed.

The City Council has in its search process to date, identified 3 Finalist candidates for
consideration to hire as our
New City Manager.
Our City has entered a stage where it must transition from ad hoc ideologically driven decision
making, to
mature its public policies and practices for such essential functions as:
• Well balanced fiscal policy- right sized operating and capital budgets, and judicious
management of revenue streams
• Land use planning and related codes and regulations- maintain attractiveness/value
and integrity of our residential neighborhoods and natural environment,and moderate
commercial development, commensurate with community and infrastructure
framework
• Public health and safety
• Development and enforcement of regulations to preserve aesthetic, healthful,
nuisance -free environment ---needed to maintain our City's Value proposition
• Maintenance of a Public process which truly listens to constituents, and provides
legitimate forum for public input, participation, and voice
We do NOT need a "Yes Man/Woman" to tow the political line for certain Council
representatives ---we need a candidate with demonstrated success as a Public policy maker
and manager. Of the three candidates on the table, two appear to demonstrate those
qualifications and one,
Mr. Nelson, clearly does not.

Dear Council Members:
If ever there was a time in recent Newport Beach history for a resident to make
a clear, unequivocal statement against what is transpiring within the confines
of the current City Council, it is today.
If I could be there today, I would be. As, I can barely contain my indignation.
As an engaged and active resident and homeowner in Newport beach for over
50 years, and as a 'weekender' for another 16 prior to that — I can and will
proffer remarks with regards to the current troubling comportment of certain
City Council members (the so-called 'gang of four') as it applies to, among other
things, the hiring of Dave Kiff's'replacement'.
First and foremost, the disgraceful disappearance of open, true and honest
leadership on a fundamental issue, in this case, the appointment of a new city
Manager — dramatically affecting the future of our city - suggests the
emergence of a moral rot within the current City Council.
A rot, a stench, a cancer of clandestineness that sadly, has become a plague on
this city as exhibited by Messrs. Duffield, Muldoon, O'Neill and Peotter's utterly
callous display of unwarranted privilege and entitlement. Culminating in
probable illegal acts, clearly displaying a yet -to -be -explained convulsive sense
of fealty towards the obviously under -qualified Mr. Nelson.
Despite hollow denials of these four to the contrary, the well documented
history of contumacious obdurate intractability by Messrs. Duffield, Muldoon,
O'Neill and Peotter to acknowledge, let alone respond to legitimate concerns
repeatedly proffered well informed and engaged citizenry defies the long-
standing precedent of those honest men and women that came before them.
The total absence of a long, overdue clear and defining explanation of their
'logic', as to their actions, Messrs. Duffield, Muldoon, O'Neill and Peotter's
behavior can only be considered as despicable and the cowardice shown,
nauseating.
This bad faith 'diplomacy' and persistent illegal behavior must be replaced by
transparent and honest leadership immediately.
Newport Beach deserves better, as does its citizenry.

I strongly object to the move by City Council to advance the
date of this extremely important meeting. The results of this
final selection of our new City Manager will have a long term
effect on our city's future. It is hard not to assume that this
move by the Council majority was done to stifle adequate
92625 public input.
My husband and I are greatly dismayed by the city manager
recruiting process. Please insure that the next city manager is
fully qualified and not a political appointment. The citizens of
92660 NB deserve this and are watching the Council's actions!
I am shocked by the back room maneuvering by certain
members of the Newport Beach council and you can not count
on my vote when your name is on the ballot. Note: I am not a
supporter of many of the policies of Line in the Sand, but 1
92625 agree with them in this case.
If you vote for the unqualified candidate you will have to
92625 answer to the voters in November!
The selected candidate should have past experience as a City
Manager and should not have experience in the elected
political arena. Additionally, the candidate should possess the
qualities and characteristics that Dave Kiff brought to the
92663 City Manager position.

Why have you suddenly moved the date of your meeting to
select our next City Manager?? Why the haste?? We want
you to choose a qualified person who has experience as a
City Manager!!!! We do NOT want an attorney/politician who
has no background as a City Manager to replace our very
excellent and highly esteemed Dave Kiff!!!! Find another Dave
Kiff (or at least as close as you can get.)
I am quite concern that the majority of members of the
Newport Beach City Council has changed the announced
interview dates for the three finalists for City Manager without
sufficient time for public input. This is a VERY important
position for the City Council to fill. All citizens of our city will
be affected by your choice for City Manger. There is NO other
employee of our city that is as important as this selection for
City Manager. Most residents have not had time to become
acquainted these three candidates, and, I feel that may be
true for other City Council members as well as the members of
Team Newport. To rush through such as important decision is
foolhardy, and, unfair to the citizens of Newport Beach.

I am very unhappy that you have called a special, sudden
council meeting at Monday 9:00 am to discuss the 3 finalists
for City Manager. The public needs to be able to know who
these 3 finalists are, investigate each, and give input to the
Council. It is our taxpayer dollars paying this salary so we
need to know who the candidates are! This process you are
using makes me suspect the motives of the Council.
Please select the most qualified applicant not the one who will
do bidding of the majority councilmen.
Please do not hire Shawn Nelson for city manager. We
deserve a competent city manager to replace our wonderful
city manager Dave Kiff, whom you forced to retire early. Don't
make things worse than you already have.

City Manager is the most important position in our city.
Therefore, we need adequate time to review the applicants for
the job. I am definitely opposed to the attempt by certain
Council members to move the selection date up. It should
remain at Aug 13, and even delayed further if we do not have
an adequate candidate. Dave Kiffs performance sets the bar
very high, and we should strive to get someone with proven
credentials that come close to this bar.
The selection of a City Manager should be made in the public
interest and not in the interest of securing the advantage of a
faction of the City Council.
I've been upset with the Council for many reasons. First of all
the awarding of the contract to build the City Hall, which I think
was under Mr. Kiffs watch. There were only two bids received
which were double the engineer's estimate and then the huge
cost overruns on the contract. I think the Council should
encourage more public input on decisions they make. It's
obvious that there are many people here in Newport Beach
who've had success in a lot of personal endeavors that would
be willing to share that knowledge with the Council if asked.
My own personal experience has been that contacting Mr. Kiff
and the Council with a problem or concern has never done
any good as they've never replied.
As far as Mr. Kiffs dismissal I think it's long overdue as I
would have done it years ago. My suggestion would be that
the public be involved with his replacement as after all we end
up paying the bill.

After reading Jeff Herdman's email and the SPON warning

regarding the hiring of the new city manager, I am once again
filled with a feeling of deep concern. Ever since the election of
the so called "team Newport", I have felt that this group of
people DO NOT have the best interests of our community on
their agenda. I was pleased that Jeff was elected because he
does understand the heart of NPB. I was horrified to see Dave
Kiff brutally tossed aside. He is the quintessential city
manager. Our new city manager should be modeled after him
not a puppet to please "team Newport". Shame on you for
being surreptitious in this matter. Once again it proves to
those of us watching that you are untrustworthy. It will come
back to haunt you at the ballot box. It is imperative that you do
the right thing for this community by hiring the MOST

Very disappointed in the way the city council has handled the

7/29/2018 Keller Sheila 92625 The taxpayers of Newport Beach deserve an apolitical city
23:04:32 manager with proven managerial and administrative
experience -- not a career partisan politician and crony of a
faction of the City Council. Our city has become polarized
enough by the divisive politics of four council members, which
is a sad departure from the past. Demonstrated competence
in the administration of city government should be the number
one criterion. Political neutrality should be another. I am
appalled that taxpayer money has apparently been wasted on
a search firm that may have been hired merely to provide
cover for those who had already chosen their political ally as
the next city manager. There is no other explanation for how
Mr. Nelson made it into the final three. I would like to see an
independent audit of the search process to determine how this
happened.
